Public Hearing /Dog Complaint
The Clerk read the complaints (2), filed by Daniel W. Backstrom, 16 Rock
Street, and Robert Ferestien, 360 Central Street, Foxboro; the Clerk also
read the Dog Officer's report. The owner of the dog is George Mahoney, 146
Park Street; his mother and father were present at the hearing as well as Mr.
and Mrs. Backstrom, Mr. Ferestien, and other neighbors. The dog frightens
children in the neighborhood, killed a cat in Ferestien's store and is not
kept restrained. The Dog Officer considers the dog viscious and recommended
it be put to sleep for it will only cause a similar problem if placed in
another home /area.
The Mahoney's attorney, Steven Lechter from Attleboro, spoke for them. He
advised the Board that the Mahoneys recognize they have a responsibility;
there is illness in the family and the dog is a comfort. He pointed out that
he had not heard one report that the dog has bitten anyone, and recommended
that there be an order issued to keep the dog restrained at all times; other-
wise the dog may be disposed of. The Dog Officer said he had been to the
Mahoney residence several times and advised Mrs. Mahoney that a rope is not
sufficient to keep the dog restrained.
Selectman D'Onofrio asked who was the owner of the dog and why wasn't he pre-
sent tonight. He went on to say his inclination is to listen to the Dog Offi-
cer, asking "What kind of guarantee does the Board have ?" Mr. Ferestien said
the son is not capable of controling the dog, and there are neighbors who are
afraid to come to the hearing. The hearing was closed.
Selectman D'Onofrio said on many occasions the Dog Officer tries to see if
a complaint can't be worked out between parties, he is very compassionate to
dogs. He then advised the Mahoneys that if the Board's decision is not to
their liking, they do have the opportunity to appeal. He feels in this case
the Board would be remiss if it did not take the Dog Officer's recommendation.
MOTION: That we follow the Dog Officer's recommendation. D'Onofrio /Mahana
VOTED: 3 -0
MOTION: Apparently the Dog Officer is so concerned he would like to take
custody of the dog for the interim period and board him in a kennel.

Selectman D'Onofrio said the committee had identified one area that it
would like to inform the Board of; they will draft a letter for the Board
to review the item and consider it at next week's meeting.
New Business
a) The Chairman introduced Leonard Flynn and Eric Butler, of the Zoning Board
of Appeals, who were present to discuss issues in connection with the
multi - family project known as Village at Mansfield Depot. The gentlemen
had plans for the Board to refer to. The first issue was a secondary ac-
cess for emergency vehicles, which they propose as a bicycle path and is
presently a dirt road. The developer would regrade and develop it; it
comes out at Hope and Shields Streets. For this they need an easement
across Town property. Town Counsel has reviewed it and sees no problem,
but recommends a Hold Harmless Agreement in the form of insurance. Acting
Town Manager, Joan Cutillo, said she had read the law and as long as the
land is not owned by any other board or committee, the Board of Selectmen
may grant said easement. The developer has said he will do all the legal
and engineering work and meet all DPW standards; sidewalks will be included.
Secondly, the developer proposes to install a 36" drainage pipe to take
care of drainage, generated by the development, which residents in the
area are concerned about. The developer suggests a CDAG Grant, but such
a grant must be applied for by the Board - it is a drainage type grant.
The developer asks that the Town assure him that future users of the ditch
be required to share in cost of maintaining it. The Zoning Board recom-
mends whether or not a grant comes through, the developer go through with

his plan, even if the ditch remains open. The developer will retain owner-
ship of the property and manage it for at least 15 years. Commitment to
continue maintenance of the ditch is to be a deed restriction.
Selectmen D'Onofrio and Mahana said they commend the Zoning Board for work-
ing out such a good deal with this developer and project.
* MOTION: To accept the proposal as presented in principle.
D'Onofrio /Mahana VOTED: 3 -0
