MOTION: Ms. Wall made the motion to approve the Consent Agenda, with the
reorganization tabled until the February meeting. Ms. Memory seconded the motion.
Motion passed 4 -0 -0.
Visitor: William Ross, Town Manager. Discussion concerning the Hercules, Incorporated
landfill site off Stearns Avenue.
Mr. Ross told the board the town acquired the site years ago and the site was cleaned up and
capped with the approval of DEP.
While not necessarily hazardous, Mr. Ross said the contamination travels in the groundwater
and into private wells and it is not advisable to use the water for drinking purposes. He said
the town extended public water to all the homes in this area because of the contamination.
Mr. Ross explained the town entered into an agreement with Hercules to prohibit drinking
water wells in this area but he said it would be very difficult to prohibit private wells. Because
public water is available to the entire area, he suggested the BOH could adopt regulations
prohibiting drinking water wells within the area downstream of the landfill. Irrigation wells
would still be allowed for lawn watering and other non - drinking purposes.
Mr. Ross said the concern is that if a well restriction is placed only on certain properties and
the restriction is registered with Registry of Deeds, it would show on a title search of the
property, causing problems for potential buyers applying for a mortgage. With a general
regulation prohibiting drinking water wells within a specific site, not on specific properties,
it would take away the stigma. Ms. Wall agreed the restriction should be site - specific
instead of on specific properties.
A regulation prohibiting drinking wells has been drafted by Mr. Leite. Mr. Ross said Town
Counsel is aware of the environmental issues concerning this site and believes Hercules will
accept Mr. Leite's regulation. He told the board if the regulation is not acceptable to
Hercules, the town will have to look at other ways to address this issue.
Mr. Leite said it would be good to prohibit certain types of wells within all landfill sites in the
Town of Mansfield. If restricting wells to landscaping purposes only, he said it would have
to be done through deed restrictions. Mr. Ross said if Hercules accepts the proposal, deed
restrictions would be placed on the properties, making future buyers aware of the well
restrictions.
Ms. Memory asked how the wells would be tracked. Mr. Leite said wells are noted on all
septic plans when a system is repaired or replaced. He told the board there are currently no
drinking wells within any of the landfill sites in town. He said that all drinking wells go
through a rigorous testing process.
Mr. Healey said nothing will be placed on the deeds unless the homeowner applies for a well
permit.
Mr. Ross said Hercules wanted a blanket document in place and attached to each of the
property titles stating no wells for any purpose are to be allowed. Ms. Memory said the town
already agreed to restrict the use of groundwater in this area for drinking water purposes.
Mr. Ross will consult with Town Counsel's Environmental Attorney.
Mr. Healey asked that all the landfill sites in the Town of Mansfield be identified on a map.
Mr. Leite said it would be helpful to know the flow of ground water. He will work with the
GIS Department to develop a map and the ground water information.

S. Health Agent's Report
1. Community Visiting Nurse Association Request: At the December meeting the board
voted to decline the request for a 4% increase in the contract for public nursing
services. Mr. Leite said he suggested HealthCare Options might want to consider
charging health insurance carriers for vaccines, etc., to bring in additional revenue
before asking the town for an increase. Ms. Trier said she would look into this. He told
the board HealthCare Options had asked for a 2% increase in the contracts from the
other towns the public health nurse services, with no difference in coverage per town.
2. Septic Pumpers: Mr. Leite did annual inspections of the pumper trucks on December
5th. Companies not at the first inspection were notified by Mr. Leite that an additional
inspection would be held on December 19th' Four companies did not appear for this
inspection and a letter was sent informing them their permit would expire on
December 31, 2012 and they were to cease pumping in the Town of Mansfield until the
next inspection on January 16, 2013.
Mr. Leite said he does not feel the inspections are necessary because of changes in the
industry. He explained that Title 5 regulations require the inspections but do not
specify annually. Mr. DeGirolamo said the annual truck inspections should continue to
be done.
3. 263 Otis Street: Mr. Leite updated the board on on -going problems with this property.
He said the door to the cellar is always opened. The new tenants claimed the landlord
had shut off the heat to the rental unit. Mr. Leite said the electrical bill was not in the
tenants' name; they were paying for electricity through the landlord, who had the
meter pulled. The tenants have since moved out.
4. NEFFA: In the past, the Board of Health has had communication problems with NEFFA.
Mr. Leite told the board he now is in constant contact with the vendors and the
organizer.
6. New Business: Ms. Wall showed the board an electronic cigarette brochure she picked
up at a kiosk in the Emerald Square Mall.

8. Adjournment:
