3. Health Agent's Report
Scott told the board the BOH budget was cut by 6.6% at the May 4th Town Meeting. The secretary's hours have
been cut from 22 hours to 17 hours. Scott is proposing to use some of the money in the 2010 budget for
4
supplies for the coming year. Some of the money will be used to amend the smoking and body art regulations.
He told the board there is $457.00 for operating expenses for fiscal year 2011.
a. Amendment to Body Art Regulations: Scott told the board the regulations are vague; he would like to
clarify what certifications are needed for licensing and how often they need to be renewed. He told the
board any changes to the regulations would need to be advertised.
Scott will draft an amendment and the board will discuss any changes at the June 10lh meeting.
b. Amendment to the Smoking Regulations: A tobacco vendor has asked for a permit to sell cigars at a car
show at the Com cast Center May 14-16, 2010. Scott asked the board If they want to require tobacco be
sold only at a permanent location/physical building or do they want to allow temporary tobacco sales at
places such as the Com cast Center. Scott is thinking of restricting sales and closely monitoring the sale
of tobacco products.
Scott told the board Comcast has smoking tents at certain events; does the board want to require a
permanent building? Catherine said by requiring a stand alone building, it makes it impossible to sell
tobacco products as Comcast is presentiy doing.
Scott told the board that Mansfield has a Zoning By-law that says you can't vend without a permanent
establishment.
Mike and Catherine would like to have the full board present to vote on an amendment to the smoking
regulations. The amendment to the tobacco regulations will be addressed at the next meeting.
c. NEFFA: The New England Foik Festival was held on April 23'd thru the 251h There was an incident with
one of the food vendors; NEFFA has not responded to inquiries about the incident. The vendor will not be
asked back next year.
Scott told the board it was hard to get all the vendors to apply for their permits so the applications could
be processed in time for the event. All applicants were asked to have the applications to the Board of
Health seven (7) days prior to the event.
d. Household Hazardous Waste Collection was held April 10, 2010. Scott said the event was not well
attended. Scott said normally the cost of the collection is between $7000-$10,000. This year the
collection cost $5,650.00; $1,740.00 of the cost was for set up and roll-off costs. He said the town might
want to consider doing the collection every other year.
e. 354 Mill Street On A~ril 261h , an ambulance was called to the location to remove the occupant for health
reasons. On April 27' , Dr. Martin issued an Emergency Condemnation for the house. On May 3'd, the
owner of the home called Scott to let him know the house had been cleaned and asked that Scott
inspect the premises. The Emergency Condemnation was removed.
f. 263 Otis Street Homeowner was arraigned on March 20, 2010 for non-compliance; she failed to fix
violations at the property. Scott told the board he went to court on Tuesday, May 41h. The homeowner
has fixed about two-thirds of the violations. The judge has given her another week to fix the remaining
violations.
Because the tenant at 263 Otis Street wants to clean up the basement and repair the basement floor and
install railings, a code requirement, Scott has ~iven the landlord a 2 week postponement as long as a 30
yard roll-off is on site by next Monday, May 10 h.
Scott has also called DEP. DEP has tested the asbestos on the pipes and the pipes need to be wrapped
properly; the landlord has wrapped the pipes in various locations with duct tape. A wet wrap should be
used as recommended by DEP. DEP verbally gave the landlord 1 year to fix the problem. Scott has
given her 2 weeks to properly wrap the pipes.
5
g. 153 Eastman Street: The resident has had no hot water since March when the cellar flooded; there is a
dispute over who should pay for the gas hot water tank, the resident or the homeowner. The resident is
supposed to be responsible for the day to day maintenance, the spouse is responsible for all other
maintenance.
While Scott was in Housing Court for 263 Otis Street, he asked about this case. Scott was told it is not a
Housing Court issue; it needs to be settled in Family Court to decide who is responsible for the fixing
or the replacement of the tank.
h. 1672 West Street: Homeowner needs to replace a failed cesspool and will need a variance. The system
is within 400 ft. of a town well, a Zone1. The well is not being used at this time. The town will be moving
the well farther back so eventually the house and septic system will be outside the Zone 1. Because the
cesspool has failed, Scott told the board the owner can replace the system and then apply for the
variance. The variance must be applied for within 14 days.
i. Scott told the board he received a complaint from a vendor for the carnival held at the Comcast Center
April 29-May 2. The vendor thought the cost of the licenses was too high.
4. Adjournment:
MOTION: Motion to adjourn at 7:35 pm
HealeylMemory Passed 3-0.
