John Chartier from RIM Engineering is representing the applicant. He outlined the
project, highlighting the three individual houses and the drainage system that are within the
jurisdictional zone of the Commission. It was noted that that some of the proposed work shoW'a
on the submitted plan was within the 25-foot no-disturbance zone of the local by-law; the plans
will be revised as necessary. Discussion of including in the Order of Conditions a requirement
that the engineer of record certifY in writing to the Commission that the sihation control barriers
have been installed per plan prior to any construction. Resident Peter DeTrollio raised concerns
about Hodges Brook and potential flooding, especially water backing up onto his property.

50 DisctalSion on Eastfield Estates, Maple St. Folkman & Zola project
Scott Goddard, from Carr Research Lab, represented the project proponents. Also
present were Jay Zola, Paul Folkman, and area residents Jim Starr and Ron Buck. S. Goddard
explained the recent events. There was accidental cutting in the 30-foot drainage easement; this
1
/
r- area was not intended to be cut, but should have been left alone as a natural drainage pathway
extending from the drainage basin and outlet swales. He has walked the area and flagged the
wetlands and performed soil examinations. Plan submitted shows 5480 sq. ft. of cutting and
disturbance in the buffer zone, but this number includes area where slash was deposited, so actual
disturbed area is approximately 4600 sq. ft. He submitted a written narrative outlining the
restoration plan. Area is within Estimated Habitat area as defined by Natural Heritage program,
with Mystic Valley Amphiods known to be present.
Paul Folkman states that Folkman and Zola Builders are taking full responsibility for the
mistake. There was discussion about getting something in writing from Chris Ross at DEP and
Pat Huckery at Natural Heritage on the question of how to deal with this problem - requiring a
NOI or using an enforcement order. Jim StalT hands out an excerpt from the DEP superceding
Determination on the entire subdivision that talks about the need for a NOI.
Additional fieldwork will be done to identify the locations of the stumps in the cut zone.
These will be where the new trees will be planted. Other restoration work will be conducted as
outlined in report from Carr Labs. Restoration plan will be blown up to a 10' scale showing these
locations.
Discussion on this issue will be brought up at the next meeting on 4/24/00.
