Memorandum from Andy Gazzolo re: Current and Next Year's Budget
Town Manager D'Agostino noted money was appropriated and we're already
moving forward on many of the items. The concern, he believes, is that we w¡j/
have a significant revenue reduction from the State in the FY2004 budget.
Those items in the FY2003 are considered a contract obligatIon and w¡j/ be
funded There will be some transfers made at the Special Town Meeting within
the Annual if necessary. The economy, which we've been told is on a slow
recovery cycle, is beginning to provide additional revenue. We will not see that
for sixteen months following an economic recovery. Free Cash will not be
certified in time to fund the FY2004 budget. Selectman McCarter asked about
the system for approval of purchase orders to assist in monitoring large

expenses. Selectman McCue asked if we could delay some large CIP purchases
for a week to consider them further. The document processor is a posslbl1ity.
We are going to implement a quarterly revue of all revenue and expenses for all
departments, including all Enterprise Accounts, and will be meeting with the
Finance Committee quarterly to monitor our expenditure and revenue patterns.
We are also about to implement a purchase order encumbrance process using
MUNIS that will give us more information on expenses against revenue.
Purchases in excess of $5,000 are now required to be approved by the Town
Manager, and he w¡j/ ask staff to advise him of any purchases of $1,000 or
more. Chairman Donovan asked that Department Heads be copied on Andy
Gazzolo's memorandum.
Memorandum from Southeastern Regional Services Group requesting that the
Board re-vote the contract award to Northeast Reclamation Corp. and rescind

on the parking lot for 15 Park Street elderly.

Letter from Kathryn Fellows re: condo trash pick-up with the request that the
Town transition to fee-for-service trash pick-up for all residents
Selectman MacCaffrie noted after reading the letter he would like a tax rebate
on sewers because he doesn't use them and a rebate for the school portion of
his taxes because he doesn't have any children in schoo/. Selectman McCarter
noted the Town has historically endorsed not going to "pay as you throw" trash
collection. DPW Director Lee Azinheira will be responding to the letter.
Applications were received to fill terms expiring December 31st on the following
boards, committees and commissions:
r Board of Assessors - one three-year term ending 1/1/06
Board of Selectmen Minutes of December 4, 2002

f
Michael K. Eagan, 10 Patricia Road (applicant for re-appointment)
Karl Clemmey, 750 South Main Street (new applicant)
Mr. Eagan said he has been on the Board for 3 t years, has enjoyed serving on the
Board, and noted working with the public has been a pleasure. The community
invested in a new computer system that is working well in providing information in a
timely manner. There is also a GIS component of the system and he complimented
the staff on their ability to answer questions from the public.
Mr. Clemmey noted the licenses he holds, as listed on his application. He stated he
would bring knowledge of the laws and his experience. He would not want the
$7,000 per year that the Assessors are paid. He's served on six Town boards over
the years and feels he will bring extreme knowledge to them. As a businessman and
taxpayer he is surprised at some of the things the Assessors are missing and noted
he has the time, knowledge and ability to serve as an Assessor. He noted it's time
for a change and his time and availability would be an asset. He called for more
communication between the Board of Selectman and Board of Assessors, noting we
need a full time assessor.
r
I
Selectman Amoruso asked Mr. Eagan's thoughts on having a full-time assessor. Mr.
Eagan says they've talked about it, but believe our approach is right. They often
disagree, but with three of them they work it out and come to a common
agreement. A full time assessor would be just one person going out to look at
property and make a recommendation. Mr. Clemmey noted the benefit of having a
full time assessor, with so much building going on in Mansfield. He spoke of the
comparable sales presented to the Selectmen last year as an example, pointing out
the Board of Assessors has not put apartments into a separate category as
required by the Commonwealth of Massachusetts. Mr. Eagan noted everything is
based on fair market value.
Selectman McCarter asked about annual revaluation. Mr. Eagan noted we comply
with State statute with revaluation every three years. We have the right to make
interim adjustments each year and have looked at that, but determined it was not
significant and does not change the amount of money the town has to spend. The
fastest growing segment is residential at this time.
Selectman Donovan asked about each applicant's ability to work with people.
Selectman McCue asked their opinion about supplemental assessments. Mr. Eagan
noted he supports it. Selectman McCue also asked their opinions on tax
classifications as opposed to a single tax rate. Mr. Eagan favors a straight rate.
r Mr. Clemmey said he would like to give the residents a break.

Airport Commission - two three year terms ending 1/1/06
Louis F. Andrews, 255 Fruit Street (applicant for re-appointment)
Howard fiske, 73 Spring Street (applicant for re-appointment)
Paul S. Diette, 59 Lancashire Drive (new applicant)
Randall Moore, 154 Essex Street (new applicant)
Dennis Buckley, 1125 School Street (new applicant)
Howard Fiske said he's been on the Commission for five years and feels they've
worked hard and worked well together. The Airport has become a show place for
Southern New England and the Town of Mansfield. He brings input from other
departments, having just retired after 41 years on the Fire Department and a has a
working relationship with the Police Department.
r
I
Lou Andrews said he's finishing his first full term with the Commission. During the
last year they negotiated with the Fixed Base Operators (FBOs) and just came up
with a lease agreement for King Aviation and Casey Aviation. Prior to this the Town
was only getting $1,000 per year and they will now get up to $50,000 from the
Airport, making it self-sufficient. He'd like to stay on the Commission to complete
negotiations for the lease and, for the first time, they've been given funds for the
improvement of the Airport. He would like to be involved in the Quadrant 4
improvements. There is also a great need for hangar space, which they will be able
to fund from money coming out of the Airport. There are many safety and security
improvements needed that he would also like to be involved in. He noted his
relationship with Town officials as an asset.
Paul Diette said the Airport Commission should include a highly qualified member of
the pilot community, which he is. He is a nationally recognized expert on aviation
and spoke of his experience in the field. He's a 25-year pilot with a degree in
aviation science. He would like to bring his knowledge and experience, along with his
intelligence, integrity and honesty, to the Commission. He would like to see the
Airport Commission do a better job reaching out to the businesses in the community
and provide related education within the community. He would also defend the
flight school's continued operation at the Airport. He has a marketing
communications background which he could also offer to the Commission and is
motivated to be here because he was not happy with the lease negotiation process.
He noted the Airport belongs to the citizens of Mansfield and the Airport
Commission's decision should reflect their will.
r
Randy Moore said he is a registered professional engineer with marketing skills and
would like to be involved. He is also a licensed pilot and a user of the Airport.

Selectman MacCaffrie asked Mr. Diette if he thinks there should have been more
bidders or more money obtained through the lease agreement. Mr. Diette said he
feels the bid was constructed to favor King Aviation and much of the process was
done behind closed doors. He thinks the leasee should be required to provide
services. He does not consider the bidding process successful.
Selectman McCue asked each of the applicants their impression of the effect of
the loss of the flight schoo/. Mr. Andrews said there's some question in his mind
with Bridgewater State, which is a State school, not going out for funds. He
questions how New Bedford got the contract without going out for bids. Mr. Diette
said it would probably put the FBO out of business, noting losing the flight school
will mean a loss of at least 50 percent of their revenue. Mr. Andrews said the
Commission has talked with the FBO and they acknowledge there will be a loss of
income, but believe they can sustain the loss. Mr. Diette noted both King and Casey
Aviation submitted their bids based on income they would receive from the Flight
School.
Selectman Amoruso asked each candidate about their vision for the Airport. Randy
Moore said he would leave it the same as a viable community airport. Paul Diette -
likes it the way it is, but knows the infrastructure underserves the existing pilot
base. More apron space is needed, new hangars are necessary, along with
renovation to existing hangars. Business use needs to be encouraged, especially
with the opening of the TPC Golf Course. Lou Andrews would like to keep the same
feel of the Airport while recognizing the needs of the pilot community. He noted
funding was approved for additional hangar space and apron space. It will take a
million dollars just to do the necessary environmental studies. They expect to
expand the apron space and get the aircraft off the grass. Discussions are on-
going as to additional hangar space. He does not see the Airport growing as far as
larger aircraft and they have no plans to equip it to handle larger aircraft. They
are not equipped to handle jet aircraft and he would like to see it remain that way.
Howard Fiske agreed with Lou Andrews that it should be a community asset enjoyed
by all. He noted with aviation growing as it is, it is necessary to keep the facilities
at top level. He concurred that hangar space and apron space need to be improved
and expanded. Mr. Andrews noted the infrastructure has fallen below the level
they would like it to be at because they had very little money to work with under
the terms of the old lease. They expect that to improve with the new lease.
Selectman Donovan asked if the applicants feel the Airport is secure or if security
needs to be improved The candidates noted some concerns - fencing that is not
high enough to keep deer out; the need to clear overgrowth from the fence by the
Civil Air Patrol trailer. Mr. Andrews said they've submitted for funding for
Board of Selectmen Minutes of December 4, 2002
6
r-
security improvements, noting the fence along Route 495 needs to be improved and
the gate also needs to be replaced. Massachusetts Aeronautics Commission (MAC)
have put those on hold. They've requested funding for a card system and as of
December 31st all users must have badges. They're also instituted a vehicle ID
system in order to bring a vehicle onto the tarmac. Cameras will be used to monitor
the gates going to the apron. The fuel tank is fully reinforced and has concrete
barriers protecting it.
Selectman McCarter asked if they would support housing emergency response
vehicles there. Mr. Fiske said they have priorities beyond that, but would favor
additional training for emergency response. If there's a need from the general
public and a need for space, they would consider it. Mr. Diette noted the Federal
Government does not allow the housing of emergency vehicles unless they're used
for the Airport.
Zoning Board of Appeals - two full member three-year terms ending 1/1/06;
one associate member three-year term ending 1/1/06
Richard Devine, 6 Morgan Road (current full-time member applying for re-
appointment)
Jack J. Vultaggio, Jr., 350 Gilbert Street (current full-time member
applying for re-appointment)
r Peter DeTrolio, Jr., 496 Elm Street (current associate member applying for
re-appointment)
Kevin Doyle, 35 Fruit Street (new applicant)
Karl Clemmey, 750 South Main Street (new applicant)
Paul A. Johnson, 19 Mayflower Drive <new applicant)
Mr. Clemmey withdrew his application for Zoning Board of Appeals (ZBA). He spoke
highly of the three applicants for re-appointment.
Jack Vultaggio said he is the current chairman and an attorney in town. He's been
on the Board for about ten years-the first four or five as an associate. He enjoys
the Board and noted they try to be consistent. They have many different opinions
and attitudes and the decisions are hard fought and discussed at length.
r
Paul Johnson has been a resident of the Easton/Mansfield area for the last ten
years-six and one half of them in Mansfield. He's participated in Town Meeting
and other board meetings. He's seen great collaboration and would like to be
appointed as an associate member because he would like to learn while being a
member of a board that makes a difference. He believes an understanding of the
town's and region's vision is important as a ZBA member and noted the importance
of keeping the town's vision in sight when making decisions. He noted challenges,
Board of Selectmen Minutes of December 4,2002
7
,,--
such as continuing growth, that will need to be addressed, along with State 40B
regulations.
Peter DeTrolio - was first appointed as an associate member and did two terms. He
was then a full-time member for one term and is now an associate member and
would like to be appointed as a full-time member. He noted the enjoyment he gets
from serving on the ZBA and spoke of the importance of the Town of Mansfield
coming first in any decision that is made.
Richard Devine said he has been on the ZBA six years and is a past chairman. He
spoke of their lively discussions, noting in the end they make the right decision.
Even when he's in disagreement with the decision, he respects it. He spoke of the
Chapter 40B applications that are before them at this point, noting the importance
of having members that have been involved in those hearings.
Selectman Donovan asked Mr, Johnson what changes he would like to see in 40B.
He would not like to see changes to 40B, but would like to see the vision of the town
kept in mind when dealing with them. Mr. Vultaggio spoke of the procedural things
that can be done to control the direction of 40B projects. He also noted the need
for continuity of long-term processes like 40B projects and the need to maintain
five members who have participated in the hearing process on each 40B application.
r He expressed his concern that if a member is removed who has participated in the
one current application, they would be down to only six members having the ability
to vote on it. They have the regulations for Chapter 40B applications in draft form
and will have them finalized for presentation in the next couple of weeks.
Selectman McCarter noted going to a 408 informational meeting at which the
necessity of local rules and regulations was stressed Mr. Vultaggio said their
hearing is on-going and the 30-day timeframe for making a decision does not begin
until the hearing is closed. Discussion ensued as to the legalities of asking the
applicant to pay for studies they deem necessary. The Zoning Board of Appeals'
delay in not getting regulations established for 40B applications was discussed at
length, with strong opinions being offered by all.
Mr. Devine said the Board's first responsibility is to administer Chapter 40A to see
if a variance application meets the stringent requirements. He noted 99'Yo of them
would be denied because they don't meet the requirement of the law, but they try
to look at it with reason and judgment even when the law says it should not be
granted. If it is detrimental to the neighborhood, he does not believe it should be
granted.
~
Mr. Johnson noted the Board has a purpose-to look at the letter of the law and
the requirements of the law. It must be interpreted by looking at the benefits of
Board of Selectmen Minutes of December 4,2002
8
the law, the applicant and town - and then blend them to interpret the regulations
r- and make the best decision for the applicant and the town.
Mr. Vultaggio noted it's a matter of balancing individuals' rights to use their
property with the rights of the State and the Town. As a Board and personally he
tries to find a hardship on every case he approves that is in keeping with the
statute.
Mr. DeTrolio noted an Associate Member can learn a great deal just by sitting
there for three years. Mr. Vultaggio explained full members always vote. An
Associate Member would vote only in the absence of one of the five full members,
but participates in the meeting fully.
Registrar of Voters - one unexpired term ending 1/1/05; one three-year term
ending 1/1/06
Martha J. Pierce, 386 Gilbert Street (current registrar applying for re-
appointment)
Paul Wayne Burney, III, 1 Wayside Drive (new applicant) also interested
in Library Trustees
r Paul Burney just moved to Mansfield from southern California a year and a half ago.
He believes voting is the most fundamental thing a citizen can do and he would like
to assist with that. He has a strong background in technology and believes he could
be of assistance in that area also. He would be willing to accept the unexpired
term.
Selectman McCue asked about his expressed concern about low voter turn-out. Mr.
Burney said he wants to do everything he can to get people involved in voting and at
Town Meeting.
Mr. Armstead passed out copies of a cartoon done in 1986 saying the system
"wasn't broke" but it is now. He believes the method of selecting members of the
Southeastern Regional School Committee needs to be changed. He suggested the
town's representative to the Regional School Committee should become a joint
appointment of the Selectman and School Committee rather than an elected
position. Currently they have to run in eight towns. A candidate recently lost by
4,000 votes in his home town, but still won the election. He stated an appointed
,f official would better serve the town he or she represents. He noted the current
Board of Selectmen Minutes of December 4,2002
9
r-
process is not fair. Incumbents are listed first on the ballot, with the new
candidates being listed alphabetically. If a person is appointed, he or she will
better represent the town and there will be better communication. To recall an
elected member requires many thousand signatures in each of the eight
communities, making it nearly impossible to get on the ballot.
Mr. Armstead stated that in the best interest of the Town we should go to an
appointed system. Every town making up the district would have to vote
affirmatively to change the way representatives are selected. He currently has a
letter of unanimous support from the Town of Easton. West Bridgewater has taken
it under advisement because one member was not present.
Selectman McCue noted this would be a dramatic change, although he understands
the reasons for it. Mr. Armstead said it used to be that you ran in your own town,
but it was changed. All scenarios were explored. The prior committee voted
against it, but he believes the next committee will vote in favor of it. Mansfield's
current representative does not support it.
Selectman Amoruso noted people are being disenfranchised now. Norton now has a
representative that does not represent them.
,..-. Mr. Armstead noted that with an appointed position, the town would have someone
that actually represents them. There is no stipend for the position. He is looking
for a vote of support from the Board.
Motion: To change the process from an elected position to an appointed position
with the specific wording to be determined, and to place it on the Town Meeting
Warrant for approval
(MacCaffrie-Amoruso)
Selectman Amoruso noted speaking to our representative about not voting for a
chairman within the power structure and was outright told "no". As a result they
languished without a chairman for two months.
Selectman McCue said he would vote for it, but in general is opposed to the right to
a vote being taken from the people.

· Betty from Betty and Bill's Toy Store is hospitalized in Sturdy Hospital and
asked residents to send cards to her at Room 314-1 or drop them off at Stan's
Barbershop.
· Bruce Kingsbury is celebrating his 56th birthday and his mother still looks
younger than he does. Stop by and congratulate him.
· There was a water main brea~ on Spring Street tonight affecting 15 homes. We
expect to have it back in service tonight.
· SRPEDD is requesting we appoint someone to the Multi-Community Hazard Team
and identify a contact person to head up our pre-disaster planning committee
for Mansfield. Red Button has expressed an interest in doing so. Any Federal
disaster funds need to be appropriated through this committee. The same
individual can fill the two positions and he provided the Selectmen with the
information, including a nomination form for each of the two positions.
Selectman Amoruso noted he assumes this wi'll also require the formation of a

has put together a team that responds (Haz-Mat Team).

. Kurt Gaffney has provided the Board with a water project status update. Our
treatment plant project did not get State Revolving Fund (SRF) funding and we
missed the cut off by.1. We ·received a 69.4 and the last project funded
scored a 69.5. However, in reviewing those projects that were approved and
the amounts, it will be clear that most of the available funding was taken up by
them. We have written an appeal letter because we feel there were 10 points
we should have received for items they did not take into consideration. Even
one point would qualify us. We are proceeding with engineering plans, but cannot
proceed with the construction of the water treatment plant because it was
contingent on the SRF funding. If our appeal is not successful, we may want to
consider going forward and borrowing the money because interest rates are
currently so low that we may be able to match the 2'0 interest of the SRF
funding.
. Selectman Donovan had asked for an update on the compost facility. According
to DPW Director Lee Azinheira he will be providing a written report, but there
are encouraging signs. We believe we have the ability to supply golf courses
with top soil based on a new procedure we're using. Golf courses will pay a
higher rate for this grade soil and it will provide us with a revenue source.
r
. The Board has a revised copy of the Town Manager's Performance Evaluation
Form. The categories have been kept consistent to reflect the Town Manager's
responsibilities, but the grading scale has been expanded at the request of
some Selectmen. Selectman Donovan asked that the evaluations be discussed at
the meeting of December ll1h. The Town Manager said he does not object to
the discussion being held in public. Selectmen McCarter and Amoruso suggested
tl cømptJ6ite evaluation be presented Selectmen Donovan and MacCaffrie
frwDred ~ them individually. The Town Manager asked that Selectmen look
at all aspects of each category and keep in mind the time period the evaluation
covers.
. """"'d needs to designate a voting member to the business meeting prior to
the 1AMA business meeting January 11th to be held January 11th at the Sheraton
Boston. Selectman MacCaffrie said he will do it and Selectmen unanimously
approved his offer.
. He will be submitting a letter to the Selectmen next week indicating his
intention to renew his employment contract. Selectman MacCaffrie noted the
Board, according to his contract, was supposed to act on the Town Manager's
raise during November.

Selectman McCarter:
· Asked if we ever found out if there was insurance on Clemmey Tank or the
Homestead. There was none, but even if there were we would not be able to go
after it.
· Asked for an update on the Train Station. Based on the amount of local match
money that includes work being done in kind, there is a sufficient amount of
money to complete the Train Station without cutting back on any aspect. The
bad news is the delay because of the questions of the MBTA taking the land in
the license. Once the license is signed, they wJ'l1 begin work There wJ'l1 be some

. Noted according to the Town Manager's contract we should discuss his raise in
November. Mr. MacCaffrie is correct if the contract is read literally.
However, we are going into negotiations with unions shortly and he would not

Selectman MacCaffrie noted the School Committee has already set the
precedent. Selectman McCarter noted the contract states "salary review
should take place November 1st." The Town Manager noted that in January
there wJ1/ be a lump-sum figure in the budget for what he believes will be
needed to settle contracts. He w/Ï/ set up an Executive Session with the Board
shortly to discuss strategy for the negotiations.
. Asked about the $15,000 for the HVAC system at the Library as to why we
need to hire an engineer to replace equipment. The Town Manager said he will
get something from Mike Ahern. From what he knows at this point, we're
looking to upgrade. Selectman MacCaffrie questioned why, noting that based on
all reports he's heard people were happy with the old system from the day it
was put in until the day it died. He does not believe if we replace in-kind that
we would need an engineer. Selectman McCarter noted that at CIP Ken Gay, who
is an engineer, supported it.

Selectman McCue:
· Asked if we know where the legal matters stand on the fight over title to the
old Clemmey Tank. Counsel will be here next week for an update.
Selectman MacCaffrie:
· Received a memo the other night on the Electric PILOT inconsistency. Chairman
Donovan has arranged a meeting to discuss it further. Selectman MacCaffrie
submitted his questions for inclusion in the discussion.
Selectman McCarter:
· Suggested the need for a lefthand turn signal at School Street/Route 140.
We could have Ptlm. Lawson study it, but it's a State intersection.
Selectman Amoruso:

. Noticed in the Globe that the MBT A is increasing the price of parking. For
Mansfield it would be $2. We should look at the contract to see if we're able to
do so in the Town lots at well. Selectman MacCaffrie said if we don't have to
and it's paying for itself we should leave well enough alone, as we'd just be giving
the money to the MBTA.
Peter DeTrolio - asked about the detour through the Industrial Park - Elm Street
bridge that is one lane says Speed Limit 30 mph. He doesn't think anyone sees the
sign and suggested it needs to be bigger. Selectman Amoruso stated the Light
Department will soon be cutting the power to the bridge and there will be no lights
whatsoever. We may also need to have the contractor do something. Mr. DeTrolio
also pointed out that there is a big pothole on the detour route when you hit the
train tracks and doesn't see why it can't be fixed. We'll have DPW look at it.
Selectman Amoruso said the stop sign at Plymouth Street is a joke because
nobody's stopping there. People (Shaw's Industries trucks) are not stopping coming
out of their driveway. He also thanked the Selectmen for coming to the TIPS
training. It had an effect and there are some regulations they would like to change
as a result.

Phil Finer, Vice President of the Airport Commission-thanked the Selectmen and
Town Manager for the help given them this year with the new leases. He addressed
Selectman McCue's question about how much business they would lose, stating Kelly
(Dinneen of King Aviation) thinks it would be 18'0 of her business as a result of
ComAir taking over the flight schools. Selectman Amoruso suggested that if there
is a "sweetheart deal" on the takeover of the flight schools being done, it's
something we should look into and offered the Town's help and support in fighting
it. Selectman MacCaffrie suggested the students should organize. Mr. Andrews
reported the FBO has sought legal counsel.
Mr. Finer went on to report that in the last twelve years there have been eighteen
projects done, with Mansfield getting several million dollars from MAC and FAA.
Some of the things we don't have were mentioned - tie down spaces and hangars.
We've been working on them for several years doing the environmental studies
necessary and expect to receive a $750,000 grant.

The funding is promised. Mr. Finer suggested that when people are interested in
applying for Boards they should come to the meetings and observe. Selectman
Amoruso noted they should also be at Town Meetings. Selectman MacCaffrie noted
that what we had here tonight was a decent representation of people who are
interested in the Board itself and not just using it as a stepping stone to get
someplace else.
Lou Andrews invited the Selectmen to come down and look at the FBO building.
King Aviation has renovated the first floor and an Open House is being held
December 15th. It has been vastly improved and Selectmen and Townspeople are
welcome to stop in any time.
Motion: To adjourn at 11:03 p.m.
