Clemmey and 14 others. Explanation: This article will change the Use of the parcel located at corner of Henry St. and Fowler St. from 83, Highway Business to R2, Residential 2. The lot is a stand alone lot that was originally a Residential lot but was changed to Business when the zoning was put in place in 1989. There has never been a business or even a building on the location. It was used for a few years as a playground for a day care center in the abutting professional building. The lot is currently non buildable as a Business Lot as it is only 100'x 50'in dimension and cannot meet any of the setbacks;50 front and 20 side and rear. As a residential lot, it could be built with a side setback (corner lot) variance as setbacks are less than business; 30 front and rear, 15 side. A house was recently granted the same variance on the lot across the street. This lot would match the surrounding four corners of the intersection of Fowler and Henry as they are all residential houses. This article would only change the zoning to R-2. The owner would still need to get a variance for Article 45—Page 2 the setbacks to build the house. The deed of this lot clearly shows it is 5000 square feet and there was never a taking for the corner of the intersection. Clemmey and 14 others. Explanation: This article will change the uses in the newly modified Highway Business District, 83 zone to align closer to pre-existing Business Use in the area; particularly along the Copeland Dr./Chauncy St. corridor. Today, along the Copeland/Chauncy B3 corridor there are approximately 28 businesses ranging from CVS and Rite-aid to Gas stations, Banks, Office buildings, restaurants, and convenience stores. Of the 28 business locations, 8 of them currently have drive-throughs; CVS, Rite-Aid, Wendy's, North Easton Savings Bank, Rockland Trust, Harbor One, Honey-Dew, and the empty bank (Webster). Since they already exist in the "new"83 zone, why shouldn't we allow other locations to have them. Afterall, this is the highway Business district so it would make sense that easily accessible drive-through service would be allowed. There are well defined requirements if you install a drive through and it would be implemented in an area where they already exist. It could possibly be considered prejudice against the businesses without Drive— throughs. This article does not change any other actual business Uses in the district but allows drive-throughs in the Uses allowed by right and by Special Permit. This may pave the way for a Panera Bread or Starbucks restaurant to be built in the area. ARTICLE 46-Vote I move that no action be taken on the subject matter of Article 46. Clemmey and 14 others. Explanation: This article will change the uses in the newly modified Highway Business District, 83 zone, along the Copeland and Chauncy St. corridor to allow for Mixed Use, Business/Residential with a By right Maximum floor Area Ratio of 1.0. Many of the locations in the 83 Zone abut Residential land and the allowance of a Mixed Use Residential/Business Use under special Permit would allow certain parcels to be developed to better coincide with the properties surrounding it.As opposed to a full retail development or office development, this would allow for a Mixed Use building to be built with Retail or office on the first floor and apartments or condominiums on the upper floors.
