The Town Manager excused himself from the meeting to go down to the Planning Board
meeting for five minutes.
(
Town Engineer John D. Sullivan, Jr. presented permanent landtakings and temporary
easement documents for the Selectmen's review and approval. The process is similar to
what was done for the Williams Street Bridge project and they have made significant
progress since November. Appraisals have been done where necessary, the Order of
Taking has been reviewed by Town Counsel and his comments are provided. There are
eleven relatively smalllandtakings, two of which are already owned by the Town. They
are all at intersections where improvements are being made to the turning radius. All are
under 300 square feet. In addition to the takings there are ninety-two temporary
easements to allow for regrading of the affected properties following the construction.
Easements have been received from all but thirty-three residents to date. Chapter 90
funds have been approved to use for the necessary cost of the easements and donations
will take precedent. It is necessary to get the work done in a timely manner as it is part of
the Transportation Improvement Plan (TIP). The Canoe River bridge is being included in
the project which results in it being more than the cost awarded. We have been assured
that MassHighway will pay for it. If for any reason that changes, the bridge will be done
at a later date and the Route 106 work will still be completed. There are four individuals
concerned with the poles. He has met with Verizon to try to work out a solution. This
projects goes from Hope Street to Flint Farm.
Chairman McCue asked if it would be valuable for Mr. Sullivan to go the next
Metropolitan Planning Organization (MPO) meeting on February 25th if he is unable to
do so. Mr. Sullivan agreed to either go or prepare documents for Chairman McCue to
take to the meeting.
Mr. Sullivan presented the Orders of Taking and 19 plans that must be signed.
Motion: To sign the Orders of Taking
(MacCaffrie-Achille) 5-0 Passes
A five-minute recess was called in order to get the Orders of Taking and
accompanying plans signed and notarized.

Police Chief Arthur M. O'Neill acknowledged he was not sure what the Board would like
addressed. Selectman Achille thanked the Chief and other members of the committee for
their work in reviewing the current parking regulations that were adopted in 1938. He
referred to page 5, section 3 of the parking policy and asked if the Chief believes the
language allows the prohibition of other parking bans. The Chief noted it does, but he
would like the seasonal overnight parking to be kept separate from that. It is his belief
that section is intended to facilitate emergency or temporary "no parking". With regard
to the seasonal overnight parking ban, he believes it should remain in effect. He noted
that even with newer weather predicting technology, some people still do not get the
message to remove vehicles from the street in the event of a sudden snowstorm. He
understands the difficulty in moving cars around.
Selectman Achille asked what types of incidents occur during the day when there is a
storm and cars are on the street. The Chief noted people are more active and available.
They see the snow and move the cars. They can work with the public more easily during
the day. If a storm emergency occurs during the night most people are sleeping. It is
also necessary to get cars off the street to prevent damage to the vehicles when it's icy
and the sanders are used. Selectman Amoruso noted two people telling him they were
denied their request to park overnight due to a special situation. The Chief pointed out
the exceptions that are made. Selectman Achille asked if there are any areas where the
elimination of the overnight ban would create a problem. The Chief referred to the
heavily populated areas. Selectman McCarter stated he can see both sides of the issue.
Selectman Amoruso noted youth are out until 1 a.m. or 2 a.m. and have been ticketed.
The Chief said they have to be there more than an hour after midnight to be ticketed.
Selectman Achille reported he has heard from various people and believes this year there
was one storm that prohibited parking on the street. In 1938 when the regulations were
written, we did not have the same ability to predict major storms, nor did we have the
technology to notify people quickly. He does not believe the public should be
inconvenienced throughout the entire winter when there are only a few occasions when
it's necessary. Selectman MacCaffrie noted other towns announce when there will be a
parking ban and people don't move them until it starts to snow. Then in Summerville
they towed the cars and it didn't snow and people were upset. Chief O'Neill pointed out
a state of emergency has to be declared in order to remove the cars. Selectman Achille
said he would like to weigh in on the side of "freedom", noting we don't live in a snow
belt. In the ten years he's been here there have only been a couple of snowy winters.
Selectman McCarter asked how would people be notified.
Chief O'Neill stated some winters have been nasty and you can't be a "little bit right".
Chairman McCue noted while he appreciates what has been said, his preference is to
defer to the Chief. When it comes to public safety he believes we need to err on the side
of caution. The Chief pointed out that even without snow the winter has been brutally
cold with an increased amount of fires. Cars parked in the road hinder access by the Fire
Board of Selectmen Minutes ofPebruary II, 2004
Department. Selectman McCarter said he is not sure in Mansfield we have the ability to
( notify the public adequately.
Selectman Amoruso spoke of the number of years this issue has been wrestled with. He
has to go into the laboratory at 2 or 3 a.m. on occasion and doesn't see many cars parked
on the road at that time, summer or winter. The problem is that families for a brief time
have children with cars, resulting in four or five cars in a household that cannot just be
jammed into a yard. He believes we have sufficient communication capability to at least
give it a try. Chief O'Neill responded, saying the problem is on the small streets--they
will not be passable. Selectman Amoruso suggested people should be given a chance to
make it work..
Selectman Achille said he appreciates the Chief coming in and noted he brought up many
good points. One of them was particular streets or districts where maybe the parking ban
should be kept in place. He suggested trying it for a year beginning next year and in the
interim to come up with ways to make it work.
Motion: To suspend the winter parking ban from December 1, 2004 to April 30, 2005
with a snow emergency provision as provided under Section 3.
(Achille-MacCaffrie) If it does pass, we would have time to work out a plan to
notifY people, educate the public, determine if there are streets where it should not be
suspended The Chief pointed out it has to be reasonable or no ban at all.

Eileen Murray of Mansfield Women of Today and Mansfield resident Cheryl Erlandson
were present to discuss plans for restoring the Middle Common. Cheryl Erlandson
presented a design she prepared for the re-design of the Middle Common.
Town Manager D' Agostino reviewed prior discussions about the re-design and the
installation of a sprinkler system. He noted the Middle Common would incorporate the
"Mansfields of the World" directional sign, a new Town clock, and the Rotary
monument. The "Middle Common" became known as such because the Rotary Club
adopted it and that is what is on the monument at that location. Mansfield Women of
Today, Together We Can, and the Rotary Club have volunteered to take on the project
and we will start a gift account to fund it. We're proposing to improve the lighting, cut
one tree down, move and replant another. The root structure of one of the trees is
growing into the underground utility lines.
Ms. Erlandson showed two general planting areas, the clock being the centerpiece. The
walkway would be redone to match the South Common, and a four-sided lighted clock
will be erected. Lighting will be at three designated points. There will be three pedestals
with urns planted in the spring, summer and fall. The Rotary Monument will be
relocated and mounted higher. The utility lines also have to be taken into consideration.

Town Manager D' Agostino reported a presentation was made to the Planning Board at
their first Downtown Revitalization Meeting. Their only objection was the clock. We
will have collected about $35,000 to do this project. Together We Can is buying the
clock from the proceeds of their fundraising projects. Women of today will hold an
auction on March 19th at Lakeview Pavilion in Foxboro to raise funds for the project.
Chairman McCue recognized these and other town organizations for their work in
making Mansfield a better place to be in.
Motion: To establish a gift account for the refurbishment of the Middle Common

Selectman McCarter asked how much authority the Selectmen have over towing issues.
None except through the Town Manager. There is no appeal of his decision unless his
decision is deemed to be arbitrary or capricious. Selectman MacCaffrie noted some of
the other changes made to the policy, adding that his questions have been answered. He
pointed out the policy does not state that a Mansfield company has to be used to do the
towing , inspections and financial interests have been added, and the interchangeable
employees issue has been omitted. The regulations do not require that a Mansfield
company or resident must be called for towing. The Chief noted that although it doesn't
specifically say they must be, his policy has always been for them to be in Mansfield.
Selectman MacCaffrie said he has an issue with restricting it to two tow companies and
believes it's stopping free enterprise. The Chief responded, noting he doesn't tell anyone
to go out and buy certain equipment. If they choose to make that investment it's their
decision. It's a serious investment that's needed to get into the towing business and there
is not enough work at this time to justify another towing company. Selectman McCarter
acknowledged that the decision as to which tow company to use rests with the Chief, but
wants to make sure it's open to others who would like get into the tow business if they
are a Mansfield resident or business owner. Since he's been Chief three people have
come to him--one was from Foxboro, one was rejected for many reasons and is not in
the tow business anymore, and the third one has been lobbying but he doesn't think it's
right to cut into the business of the other two. Officers need competent well-equipped
operators they can rely on. He's seen it over the years where operators have less than
adequate equipment or are incompetent and he would not like to see the issue politicized.
The Town will grow and the need will increase. When it does, another tow operator will
have to be used.
Chairman McCue noted the message has been heard by the Chief. He disagreed with
Selectmen Achille and MacCaffrie, noting his belief it's a public safety issue that should
be left up to the Chief.
Motion: To accept the towing policy
(MacCaffrie-Achille for discussion)
Selectman Achille stated he believes there's a de facto cap of two on the towing list and
believes if someone has the equipment, is qualified, and wants to be on the list they
should be allowed to be on the list. He is comfortable with a free-marketplace.

Selectman McCarter said he's glad to see under the new policy that people are not
excluded.

Town Manager D' Agostino asked the Chief to discuss the tiered fine structure at the
Train Station. The Chief reported he's researched the matter. It would require a great
deal of administrative work to determine how many offenses have occurred There is one
system he's seen that uses a P DA type device that's about $5,000. There are others that
he's looking into. Selectman Amoruso noted it was not his intention in talking about
tiered enforcement to have a sliding fine structure. His intent was when a car owner does
not pay the fee, a ticket is put on the car and they can pay double the fee before the end of
the day or receive a $25 ticket. This would give them a second chance. The Chief
expressed philosophical differences with that type of reinforcement. He suggested that
some type of control gate may be the best approach. Chairman McCue stated we need to
maintain the lot and we should stay with a system where the Town gets the fee.
Selectman McCarter said he will establish this as a goal and objective of the Town
Manager for the next year. Steve - have to be established with something using an up-to-
date technology.
r
Chairman McCue noted the use of the same Town Manager's Performance form as in the
past that has now been completed and a consolidated report compiled. The Town
Manager has been provided with a copy. Chairman McCue proceeded with the review:
Legislative Relations: Average 8.75 on a scale of 1-10. Consensus is the Town Manager
has good communications with State legislators, is generally well-prepared, has a
continuing relationship with the Superintendent of Schools.
Public Relations and Communications: Average 9 Reflects his outreach to the Town. A
couple of comments were made due to his handling of criticism that comes up at
meetings, which he has been handling better recently. Selectmen McCarter stated he has
always been impressed with Mr. D' Agostino's ability to speak publicly.
r
Budget Preparation and Administration: 8.375 Average; general consensus is that he's
very good at preparing the budget. There have been occasional questions regarding
communications with the Finance Committee. Selectman McCarter pointed out the
financial circumstances over the past couple of years has made this particularly
challenging. He believe the Town Manager handled the money of the Town well and has
done the best job possible with the resources available without making drastic cuts.
Selectman Amoruso noted the buck stops with John and he's done an excellent job.
Town Manager D' Agostino noted it's not easy to with a growing community and a pent-
up need for services. It requires creative initiatives to get money donated to take up the
budget slack and the people of the community should be commended for their ability to
do so. Selectman MacCaffrie stated budgeting is one of John's strongest suits. He

('
respects his budgeting capabilities and thinks this year his strengths and weaknesses will
be the ones that make us or break us. Last year we were down over 3% from the prior
year. Even going back to zero is unacceptable this year, but that's probably what we'll
try to do, and we'll get hit with the balance from the other side. He emphasized the need
to take a united stand, stating last year the Town Manager led the way and showed the
way. This year's challenge appears to be even greater.
Managerial Skills Average 8.25 - the desire to disconnect with Light Department was
brought into the evaluation. There were also comments on the need to tighten up the
Town Manager's report.
Direction and Supervision of Town Organization Average 8.5 - comments indicate a
recognition of budget constraints hurting the ability for new growth, which is not the
Town Manager's fault. He accomplished goals and objective set forth more often than
not.
Personal and Professional Grown of Town Manager Average 8.33 generally high marks;
Chairman McCue noted Mr. D' Agostino is thought of very highly by his peers;
Selectman McCarter pointed out opportunities have been limited because of budget
constraints. He knows Mr. D' Agostino takes it seriously and makes the most of the
opportunities available. Selectman Amoruso said he has done a lot that has improved the
town and is well recognized by other towns and the State.
r Overall Rating included one C+ given and a numerical average of 8.575.
Chairman McCue noted unfortunately we didn't set goals last year. He has always made
clear his desire to get involved in an ETA and the Town Manager did pick up the mantle
and joined with other communities along the Route 495 corridor. As a result of that and
his support of businesses in town, we're seeing interest from some desirable businesses.
He also pointed to the completion of the Train Station and Rails to Trails that were
previous goals. With respect to the Chapter 40B issue, he put together a Housing Task
Force to develop a comprehensive plan and brought in Habitat for Humanity to discuss
building affordable housing on Town-owned land.
Selectman Achille stated it is his first year on the board and throughout his first few
months John has been very accessible, professional, and knowledgeable and he has
confidence in the stewardship he's shown. He thanked him for his help and work for the
Town.
r
Selectman McCarter stated the Town Manager has the most difficult challenges to face.
Not everyone is a fan and we have to work through that. He's handled it well. He noted
it's not easy to work for five people who all have different viewpoints and Mr.
D' Agostino understands that and works to the best of his ability with each of us. When
he goes to MMA meetings, he still sees that he's a cut above other Town Managers and
he's accomplished things that others have to tried to do without success. He also
remembers at Bert Cook's retirement party Mr. Cook saying that John is the best ever and
Board of Selectmen Minutes of February 11,2004
he considers him a credible source. He looks forward to being able to continue to work
r with him and try to improve our relationship with some of the detractors.
Selectman Amoruso stated Mr. D' Agostino's greatest asset is his inventiveness and
creativity. He sometimes likes to say "no" just to see him come up with another creative
way to do something-and he usually does. And it generally turns out better than it
would have. Budgeting is a piece of that, but his creativity and innovative approach is his
greatest asset.
Selectman MacCaffrie noted he gave John a C+ only because everything on the form is
slanted to reach a certain direction. He noted the budget is a great strength and most of
the negative comments came from him due to his perception of certain agendas that come
up where he believes his full attention could be devoted to other matters.
Town Manager D'Agostino thanked the Board for their comments and feedbacks. He
noted goals and objectives were never developed for the past year, but in reading his
annual Town Manager's report he will see those he established for himself reflected. He
noted the importance of getting together to develop a mission statement and thanked
them for their comments.
r
Chairman McCue asked each Selectman to identify a couple of goals after giving it some
thought throughout the week and next week he would like to set aside some time to
establish some personal goals and objectives. The Board is attuned to their shared goals
and the next chairman may choose to use a different form of evaluation. Selectman
MacCaffrie said he would like to first see what the Town Manager's goals and objectives
are. Chairman McCue agreed that the Board doesn't want to exclude what the Town
Manager would like to identify, but he would still like the Board to set some. He
suggested that Town Manager D'Agostino provide them with a copy of his annual report
to give them ideas of things they may like to add.
Town Manager D' Agostino reported:
· We have not yet awarded a contract for the HV AC system. He detailed the history of
the funding and bid process, noting the bid was structured to get a base bid and an
alternate bid. We do not have enough money to complete the Police Station HV AC
and will get the information for Selectman MacCaffrie as to the the number of bids
received. Selectman MacCaffrie noted that from the time it was originally priced to
the time of the bid award, costs rose dramatically. He felt at Town Meeting the
numbers were reasonable based on that point in time. Town Manager D'Agostino
pointed out they were hoping that Governor Romney's desire the change DCAM
certification requirements would improve the situation.. We need to go forward with
the Library/COA. It failed again recently and the poor seniors were sitting there with

their coats, hats and gloves on to keep warm. Selectman MacCaffrie questioned why
engineer missed by $60,000-$70,000.
.
On February 9th the Board received an update on the status of Verizon, as well as a
followup to the Wellesley recycling program. Wellesley does not have curbside
collection. The have eleven employees at the recycling center and a population of
27,000. They had a $5 million capital improvement program to set up the site and
have a transfer station they converted to recycling. The program is run on a parcel of
20 or so acres with a $1.8 million budget. Selectman MacCaffrie suggested we could
still get a dumpster for steel. He stated we need to approach paper companies and
steel companies to see if they'll take it away. Our labor is going to be there
regardless. If it's going to be taken away for free because they'll get money for it,
that's an expense we won't have. Selectman Achille said he has discussed it with the
Town Manager and would like to see it on the agenda in the next month or so.
Chairman McCue questioned if we've had enough time to get a good assessment of
how the sticker program is going and said he would prefer to wait for an analysis of
that. We have some preliminary numbers. Based on the sticker structure process,
we're not going to make anywhere near the amount needed to cover the costs. The
initial proposal put together by staff would have covered the costs. We've raised
approximately $15,000 from the sticker program and the cost is about $64,000.
Selectman MacCaffrie noted the decline in the number of CPU's and LP tanks being
brought in. The Town Manager said that has not been factored in at this point and the
numbers have been generated on last year's volume level. There will be differences.
He will be happy to do it, but would prefer to wait longer.
· Annual Town Meeting Warrant closes March 1,2004. While we have yet to actually
set a date for Town Meeting, Charter establishes it for the second Tuesday in April.
The intent and practicality of a suitable date was further discussed.
Motion: To hold Town Meeting May 18,2004
(MacCaffrie-Achille) 4-1 with Selectman Amoruso opposed (who made the point
it would be the first week of Sister Cities and there will be a conflict with the use
of the High School Auditorium).
· Will do budget message next week. FinCom would like to meet with the Board on
budget priorities.
Selectman MacCaffrie:
· Spoke of the grant money that comes into the Police Department and asked about
using some of it to purchase wrist radios for Alzheimer patients such as those being
used by Norfolk Sherrif s Department if someone is lost. The Town Manager said he
find out on this issue.
· Asked for update on Fuel Depot and when we will be able to pump gas.
Board of Selectmen Minutes of February II, 2004
( . Asked if the Fire Station repairs would be a Capital Improvement Project? The Town
Manager asked the Chief to put that on. As well as the kitchen area. Drainage will
come under the Inflow and Infiltration Program.
· Received the information provided on the Bristol County Retirement Fund and has
lots of questions for when someone comes in to explain it.
· Asked if we are still going to send out a request for proposals for combined auditors
for the Town and Light Department and see what we get for a response.
· Brought up the subject of legal bills for South Walnut Street, noting he understands
from Dick Lewis the Engineer's bill has been received and sent over to the defendant
for a response. He asked that it be checked on it so it doesn't keep running up.
Selectman McCue:
· Received a letter from Easton Town Administrator telling him Carla Goodwin is not
running for re-election. He had met with her and Norton Selectman Bob Kimball on
common interests. Easton has designated another selectman and doesn't want to lose
sight ofthe goal. They will pick up again after Town Meeting.
Selectman Amoruso:
· Reminded everyone of Sister Cities coming in May and said they are still looking for
r hosts. Call him at 339-6740 directly if additional information is needed.
Selectman McCarter:
· Asked about water issues on West Street
· Asked if there would be a warrant article to delete the stipend for the Board of
Assessors if we're going to get a full-time assessor and asked how much we currently
pay them, noting he doesn't think it would be fair to cut them off at this point.
Selectman McCarter:
· Received a memo from Pat Burns of the Ad Hoc YMCA Committee noting there's a
meeting February 18th at 6:30-8:00 at Library for skateboard planning and design. He
is looking for input from potential users. $37,209 has been collected, with $16,000 in
pledges outstanding, for a total of $53,209 towards the $71,784 goal. He noted the
generosity of people is amazing and will make it a reality.
Selectman Amoruso:
· Jo Ann Sprague has announced she will not run for re-election. He suggested the
Board send her a letter of thanks as she's been an advocate for us and a great

supporter of our projects. She has always been around and accessible and her
retirement will be a great loss to our district.

· Gave a statement addressing comments made about him in the newspaper so his
"silence" on the issue would not be misunderstood. He referred to the article of Mike
Gelbwasser in The Sun Chronicle that produced more heat than light. He turned
down his offer to respond in the paper, but he believes he has a responsibility to the
citizens of Mansfield to set the record straight. His appeal has been filed on a 40B
project approved by the Zoning Board of Appeals for Turner Brothers Construction to
build on the parcel of land adjacent to his business. He would not consider building a
40B project on his property in Mansfield. Turner Brothers allegation in the
newspaper report is an attempt to damage his reputation. He further explained the
reason for the appeal and noted he has not been involved in participating with any
40B project in order to avoid a conflict of interest. He has also filed a disclosure with
the Town Clerk regarding his financial interest in this parcel. The project proponents
chose not to work out the problem and his only recourse was to go to Court. He's
open to discussion, but they have not chosen to do so. He has a philosophical
objection to using industrial land for such a purpose and believes this is a personal
attack. He further stated his thoughts are always on what's best for Mansfield and he
will continue to represent the citizens of Mansfield even when inaccurate and
irresponsible remarks are reported in newspaper.
r Selectman McCarter said he has known Selectman Amoruso for a long time and
" knows what was reported in the newspaper is not true. Chairman McCue noted it was
ludicrous and inaccurate.
. Chairman McCue:
Asked where we stand with the Industrial Development Commission. The Town
Manager reported he scheduled another meeting and did not reach a quorum to hold
the meeting. He needs to get them back on track but has to devote his full attention to
the budget issues at this point. He will try to get them started on a plan to reach their
goals and working on the marketing brochure. Chairman McCue noted money was
appropriated to produce a marketing brochure and he's looking forward to seeing it.
· The Capital Improvements Committee is beginning to meet and has asked who the
Selectmen representatives will be. Selectmen Achille and McCarter agreed to work
on the committee

appeal this 40B. He noted the Selectmen had previously considered appealing it

themselves, but didn't do so because Town Counsel told us there was no recourse we
could take. He asked if the Board would like to reconsider the possibility of doing so,
recalling Norton did so. Once they had an abutter appeal they were able to join in
that appeal. He's called Norton to ask them where that stands and what the
procedures were. He would like to re-visit the issue and see what standing we have.
He asked that Town Manager check with Town Counsel to see if this opens the door
and what pitfalls may be encountered. He also specified that Selectman Amoruso
would be excluded from any appeal filed by the Board of Selectmen.
Selectman MacCaffrie:
· Has a problem with accounting and fiscal years, noting he just got 2002 and asked
when we get 2003. A discussion regarding the calendar year and fiscal year
accounting procedures ensued, with it being stated that it has no influence on the
budget. It's a basic recap of our financial situation, and evaluates checks and
balances used in daily control. We can't accrue anything. The Town Manager said he
does not believe we're behind schedule, but will check on it Selectman Amoruso
agreed that it does seem like a long time and suggested it may be appropriate to ask
the Town Accountant about it.
Selectman McCue:
· Asked that a letter be sent to Home Depot thanking them for their $2,500.
