The new business space at 390 West Street (Erin Centre) is approximately 6000 square feet in size and is located in the same building as an existing Staples store with a separate front door entrance and rear loading dock. Bill Clemmey and Meagan Foley signed a 5- year lease agreement with Clemco, LLC commencing on January 1,2005 for the new proposed business. Based on the application submitted, Meagan Clemmey is the official Business Manager. Bill Clemmey noted that both he and his sister-in-law Meagan Clemmey plan to be involved in the management of the retail business. Mr. Clemmey confirmed property abutters were notified by certified mail as required, however a few notices were returned as undeliverable due to incorrect addresses. Postal receipts were provided to the Town Manager that evening. r Selectman McCue commented that having the word "Liquor" in the business name (identified as Cork's Fine Wines & Liquors) could be misleading or misappropriate since the license application would only permit the sale of wine and malt beverages at this location. Mr. McCue questioned Attorney Angley whether there is any legality that would prevent the applicant from using the term "Liquor" in the business name, based on the pending Application for a Beer & Malt License. Attorney Angley responded that having the word "Liquor" in the business name is an allowed use of the site within the special permit. Bill Clemmey confirmed that the intent ofthe owner's application is for the Board of Selectman to grant a Beer & Wine license, not for the sale of liquor. Town Manager, John D' Agostino noted that based on population information included in the Town's census report, the Board is authorized to issue up to a total of five Beer & Wine & Licenses. Town Manager indicated that two of the Town's five Beer & Wine Licenses are currently in use. Owner's Bill Clemmey and Meagan anticipate opening the retail business in February or March 2005, pending approval of the license application. r' Selectman Dolan stated intentions to approve the application subject to confirmation that taxes are paid and police report provided.
