1. March 6, 2002 Minutes
Motion: To approve the minutes as submitted (Dolan-Cook) All in favor. PASSES
2. ZBA application for Variance - 157 Dean Street - 4.2.1, Front Yard Setback.
The addition was erected several years ago, at which point the front yard was
measured incorrectly. While planning another addition, off the back of the house, the
applicant realized he should have gotten a variance for the flfSt addition. The
variance is being requested as a housekeeping matter.
Motion: To send the ZBA a positive recommendation because the only option,
removing the existing addition, seems "Draconian."
(Frank-Dolan) All in favor. PASSES
3. ZBA application for Variance - 8 Northridge Road - 4.2.1, Side Yard Setback The
application states the homeowners had been told they had enough land to someday
add a garage. Mr. Frank asked why the 6-foot mud room couldn't be dropped; he
said they might not even need a variance if the addition was pushed back about 10
feet.
Motion: To send the ZBA a negative recommendation because the applicant has
shown no reason why the mud room can't be eliminated and the addition pushed back
10 feet or so (Frank-Cook) All in favor. PASSES
4. ZBA application for Variance - 430 South Main Street - 4.2.2, Frontage; 1.5.17a,
Lot Width. The applicant wants to build two office buildings. In 1989, the zoning in
II was 50 feet; in 1989, the frontage requirement changed to 200 feet; the lot existed
prior to that change in 1989. Mr. Frank said the fact that the lot isn't wide enough
isn't a hardship. Mr. Burke said the lot is skinny in the front and opens up in the
back, so it is an oddly-shaped lot.
Motion: To send the ZBA a positive recommendation
(Dolan-Cook) All in favor. PASSES
5. Request for Release of Surety - Canoe River Drive Cul-de-SaclMemo from Jack
Smith, Subdivision Inspector, recommending the release of $11,051.
Motion: To release $11,051, leaving a balance of $5,000
(Dolan-Frank) All in favor. PASSES
6. ZBA decision - Spring Street - Carl Nelson - Denied (Negative Recommendation)
