. Memorandum from Shaun P. Burke, Director of Planning and Development, and
Richard Lewis, Environmental and Conservation Planner re: Draft Local By-Law
for Comprehensive Permits - Selectman McCue noted he had a question:
Section 5.03 - They may dispose of the application in the following manner. He
noted "to deny a permit because it's not consistent with local needs. 1/ Selectman
MacCaffrie suggested it relates to the 10 percent of the population
requirement. Selectman Amoruso pointed out that wh1'le the Zoning Board of
Appeals has the power to deny the application, the applicant has the ablÏity to
appeal the decision. It would be the decision of the Court as to whether to
uphold the decision. Selectman MacCaffrie noted all other applicable

specified. Selectman McCarter noted he's pleased that the by-law amendment
provides us the ability to establish fees. Selectman Amoruso suggested we
could also force the issue with a developer if we fall just under the 10 percent
to have the developer put in an additional number that would enable us to reach
the 10 percent.

Thomas Scott, a visitor from Mansfield, England, was introduced to the Board. He
is here on the first stop of a ten stop tour. He graduated from high school this
year and will be starting college in the fall. He noted Mansfield, England is about
the same size as Mansfield, MA, but we have about one-third of the population. He
will be traveling to Connecticut, New Jersey, Pennsylvania, Ohio, Arkansas, Louisiana
and Texas. He'll be working at the Mansfield (MA) News for two weeks while he's
here and will be continuing to write for the Mansfield News over the next few
months. Selectman Amoruso presented Thomas with a wrestling baseball cap and
wished him an eventful trip.
To authorize a proclamation for Mansfield, CT and another for Thomas Scott to be
r sent to him.

Selectman MacCaffrie offered his praise to the Police Department for their
handling of a serious situation during the Ozzfest. He noted there was a serious
injury; the police officers took a large amount of abuse and showed significant
restraint. He stated there were three police officers in the immediate area at the
start of the sod throwing incident to control several hundred patrons, but other
officers and security personnel quickly moved in and acted in a most professional
manner. He thanked the police officers for their calm temperament.
Chief O'Neill noted any organization is only as good as the people of which it's
comprised. He pointed out they worked well even during "controlled chaos" and said
they did a great job. The incident was brought under control quickly and he said
he's proud to be associated with such a great group of men.

Attorney Mangiaratti introduced himself as Town Counsel. John Manni of 1405
Plainfield Street in Johnston, RI, was in attendance to represent the license
holder, Amruta Corporation, and Mr. Patel was with him at the meeting. Mr. Manni
noted Mr. Patel surrendered the license to the Selectmen this afternoon. Based on
the fact that the liquor license has been turned in and Amruta Corporation is no
longer a license holder in this community, the Board has no jurisdiction to hold a
hearing or to offer sanctions.
Attorney Mangiaratti noted his understanding that the license has been turned in
and a surrender document has been signed. He recommended, however, that due to
the seriousness of the allegations and because the hearing has been duly noticed, it
would be best to proceed. In the interest of the people of Mansfield, he stated it
should be heard and the Selectman allowed to make a statement. He requested the
Board's permission to simply present documents from the Police statements and
give a summary of the facts. Detective Lawrence Crosman and Chief Arthur O'Neill
were present on behalf of the Police Department. Attorney Mangiaratti noted
there were serious violations of the alcohol laws which should be addressed.
Motion: To go forward with the hearing

Attorney Mangiaratti introduced the following:
· Chapter 138 Section 64 of MGL authorizing the Selectmen as licensing
authority to take action regarding a violation of the law
· Chapter 138 Section 34 which prohibits the sale of alcoholic beverages to
persons under the age of 21
· A letter from this Board dated August 2, 2001 to the license holder, noting
this is not the first offense. The same license holder had his license
suspended for one day for the same offense in 2001.
· Police Report with respect to the incident involving sale to minors
· Two signed statements from the minors and
· A third Police report regarding allegations and subsequent charges against
Kenny Patel for intimidating witnesses.
Attorney Mangiaratti noted the license holder is Amruta Corporation doing
business as Dias West Mansfield Variety.
r On June 28, 2002 Detective Crosman was on duty and was parked on Coach Road in
an unmarked car. He observed two males hanging around the parking lot. After a

r period of time Mr. Patel waved to them from the store and motioned for them to
come into the store. They did so and a short time later walked out. One of the
young men was carrying a box labeled "caffeine free Diet Coke" which in fact
contained twelve cans of Busch beer. They were charged $13. for the 12-pack and
had waited outside the store while Mr. Patel was waiting on other customers. When
he finished, he motioned to the young people to come back in and he gave them the
beer in the soda box. Both minors stated they have purchased alcohol from Mr.
Patel in the past. Detective Crosman arrested Mr. Patel for selling alcohol to
minors. Subsequent to the arrest there was additional contact of the minors by
Mr. Patel, whereby he offered to compensate them if they would change their
story. He suggested they tell the licensing board they were nervous at the time
they signed their statements and they just said what the Police wanted them to
say. He offered them money and other compensation to do so; however the youths
went to the police to report it. Their testimony is recorded on audio tape which
Mr. Mangiaratti said he's listened to. He suggested the Selectmen acknowledge the
license has been voluntarily surrendered but, based on the severity of the matter,
that the Board take action to cancel the license, thereby making it void.
Selectman MacCaffrie asked how this would affect the license holder's ability to
obtain another license in Massachusetts if it is canceled and not revoked. Attorney
r Mangiaratti suggested they could both cancel and revoke the license.
Chief O'Neill noted he was sworn in 28 years ago as a police officer and since that
time has never seen a more blatant violation of the law as has been seen with the
action of this licensee. He noted our responsibility to other city and towns in the
Commonwealth, stating his understanding that Mr. Patel also holds a license in
Scituate, MA, and that we must convey the message that we take this very
seriously.
Attorney Manni summarized that it is his position the Board has no authority to act
on this since the license has been surrendered. He asked that they take no action
to either cancel or revoke, noting the police reports are simply hearsay and there is
insufficient evidence for the board to act on.
Selectman Donovan noted the licensee's prior violation. Attorney Mangiaratti noted
the Selectman have a right to weigh hearsay evidence in an administrative hearing.
There has been no evidence to contradict the evidence of the Police Department.
The facts are undisputed and suggested the most extreme action.

Selectman McCue noted the prior one-day suspension was with the understanding
they would not see a reoccurrence of the violation. He noted his regret that we do
not have the right to refuse the surrender of the license so as to remove any doubt
of the weight of the Board's rebuke, stating this offense shows egregious
premeditation. It is an affront to the community and the Police Department--and
the Board is right in revoking and canceling the license. He stated we also have the
right not to accept the surrender of the license and he's sorry we no longer have
r that ability.
Selectman McCarter noted had it not been surrendered and we had gone forward
and heard the evidence he would have had no difficulty, given the circumstances
presented, revoking and canceling the license and would have done so.
Selectman Amoruso stated by taking this action we're electing to take significant
action, whether the license was turned in or not. Much of what we read from the
Police Department was said word-for-word the last time-showing premeditation.
Town Counsel Mangiaratti advised the Selectmen he will prepare the decision for
their signature.

r Light Department Director Jack Beliveau, Engineer Ann Langille, and Line foreman
Gary D'Ambra presented the plans for the project. It consists of 3700 feet of
conduit. The purpose is to eliminate the multiple circuits and poles to get
electricity to the east side of town. She noted there was no room for them to go
down the middle of the street. They started out going close to the end of the
road, but encountered private property. Beginning at Hampshire Street she
detailed the route on the plans, which she noted has been revised several times.
She showed the existing manhole at West Street and noted working diligently with
the Water and Sewer Departments. Ms. Langille also pointed out the various road
crossings. Mr. D'Ambra stated there will not be the need for a road closure, as half
the road will be done at a time. Ms. Langille entertained questions regarding the
project. She noted their hope to complete the work prior to the start of school to
avoid problems with bus access. Mr. D'Ambra stated there will be road closure in
the area of Stratton Road and they've asked the contractor to work ten-hour days
to complete the project quickly. Mr. Beliveau discussed the reason for the project.
We currently have three circuits on this section of the road and need to have an
additional one due to the increase in population in this area. To avoid major
blackouts and improve service, it is necessary to put the lines underground. No
power outages are expected as a result of the work being done. The poles will
remain as they carry other utility lines. Mr. D'Ambra has met with many of the
(" abutters and will continue to be available to answer their questions. He stated at
the beginning of the project there will be an interruption in water service and 24-
hour notification will be given to the three houses involved. Three 8-inch services
are being replaced.

The hearing was opened at 8:50 p.m. A memorandum from Health Agent Scott
Leite was read, noting Mr. Cerullo is now serving food. Chairman Donovan said he
stopped by there today and food was available. Selectman McCarter reviewed the
facts as he is aware of them, noting the renewal of his license could be in jeopardy
if he doesn't have a kitchen. He stated the Board is trying to work with Mr. Cerullo

as he is attempting to get the renovations completed. Mr. Cerullo noted he does
have food available and he now has it listed on the menu board.
Selectman MacCaffrie said he asked for the hearing because of the notification
from the Health Agent that no food was visible. Since we now have a memo that
food is available, he's satisfied. He cautioned Mr. Cerullo, however, that he does
not plan on giving him a third chance.
Motion: To take no action based on the fact that there was a prior
misunderstanding, the Health Agent has been supervising the situation, and at this
point food is available for patrons should they choose to avail themselves of it.

· Reported on the July 11th MassHighway meeting, noting it was a positive
meeting of the District Commissioner, with all of our representatives
present. The current on-going State projects were summarized, followed by
site visits to other problem areas. Construction is expected to start on the
Elm Street bridge mid-August and we will be provided with notice. The
bridge will remain open to two lanes of traffic for the duration of the
project. They expect about three weeks of continuous night work for each
side of the bridge. There will be a pre-construction conference for the

r
School Street bridge and it will start sometime in September, with
completion expected in 2003. Selectman Amoruso noted the need to notify
the School Department prior to the setting of the bus routes. The
discussion of lights at West and Forbes was revisited. They will see about
leaving the temporary lights in place. The Route 106 railroad bridge
underpass will be expedited by MassHighway and they will evaluate it.
Senator Sprague's office called today regarding the cost of the work to be
done. Williams Street bridge will be advertised in October. Route 106
reconstruction - the new church school was brought up. The reconstruction
is on the TIP for 2004 and it is a top priority project. Copeland Drive/Route
106 intersection was also discussed and they said they'd go back and try to
get it going again following Lance Lawson's report. Route 140 through
Mansfield has been the subject of many complaints. The road will be
reconstructed in the spring of 2003 and they will be doing a t inch overlay
this fall to address the most serious problems. The bikepath was
advertised. Selectman Amoruso noted MassHighway is committed to the
Route 495 southbound access ramp.
r
· Mill Street/Wilson Place/Otis/Columbine paving was scheduled to begin
today. It has been postponed and they will be starting tomorrow.
Selectman Amoruso noted a cutout of pavement at Otis Street with no cone.
He found the cone down the road and replaced it, but asked if there is a
better way of alerting motorists to the problem.
· Water was provided to Norton yesterday due to a crisis situation they were
experiencing with the shutdown of one tank, causing low pressure. We were
able to supplement their water supply for approximately 24 hours without
creating any difficulty for Mansfield. Selectman McCarter questioned the
existence of an inter-municipal agreement. We don't have a meter there,
but will be getting together to estimate flows. It was noted by Selectman
MacCaffrie that it's a safety issue and a people issue and it was the right
thing to do.
· Reported on the status of the Morrison Well, noting the first report has
been received on the monitoring of the water level of Cedar Swamp. There
are a few items of additional information they are looking for. We test ran
it and we're hoping to be able to start it up next week.
r-
· Followed up on items from the last meeting -Town Hall sign; signs at Samoset

year and we'll be replacing faded signs and getting some new street signs.

Responded to Selectman's MacCaffrie request on special projects being
done on overtime. He will provide the information he's looking for.
·
Mill Pond Dam/Canoe River - he visited the site and spoke to Mr. Gonsalves.
The bridge abutments are being repaired this week; the dam will be a more
long-term project and will need to be looked at as a capital project in the
future.
·
Essex Street parking lot - the dirt pile has been removed. The sign has
disappeared. Selectman MacCaffrie noted it was down and lying in poison ivy
when he last saw it. It was initially the sign and the post. He believes
someone stole the post and didn't want the sign, so threw it in the poison ivy.
A new sign will be made if it cannot be found.
r
Selectman McCue:
· Is interested to see the Town Manger's report on early retirement and will
bring it up when the Town Manager returns. He noted most of the
communities in the area that have accepted it are large communities.
Selectman MacCaffrie noted a letter from Lt. Andrew Barr and stated he's
had a couple calls from the Fire Department. They brought up the amount
of sick leave and vacation time they're eligible to buy-back, noting new hires
would not be eligible for this. He suggested that this be taken into account
when doing the analysis. He pointed out older firefighters are more prone
to injury and the new firefighters make up in training for the experience
gained on the job by older firefighters. Selectman Amoruso noted
discussing it with the Town Manager and said it wJ1l be discussed further
when he returns from vacation. He stated a limit can be established within
categories.
Chairman Donovan:
. Received a couple of complaints about speeding from the East Street
intersection with the Common and Route 106. Mr. Azinheira will notify the
Police Department of the need for additional enforcement and will look to
see if a couple more signs are warranted.
r-
Board of Selectmen Minutes of July 24, 2002
11
r Selectman MacCaffrie:
· Received calls following the Light Commissioners meeting and stated one
more time that he believes the vote taken is just another tax placed on the
citizens. Selectman McCue agreed and noted his concern with going back to
the Electric Department for more money to balance the budget. He stated
he does believe there should be a Payment In Lieu Of Taxes (PILOT), but
suggested it needs to be handled better in the future. Selectman McCarter
stated the PILOT was less than what we've had in the past and expressed
his hope that it would stabilize, as it is a cost to the ratepayer. He noted
the difficulty of starting up under one process and finishing up under
another. He expressed his hope that it was made clear that we want Mr.
D'Agostino and Mr. Beliveau to work out a better solution in the future.
Selectman MacCaffrie expressed his belief that the policy has been set for
a $300,000 PILOT plus a 10 percent contribution. Chairman Donovan stated
we're working in the right direction and the problem was brought to the
forefront by Messrs. D'Agostino and Beliveau. Selectman Amoruso noted
the need to reallocate pensions and the assessment to each department.
r
· E-mailed John on June 21st and it was his understanding there are a couple
more parcels available at the intersection of School Street coming up.
These were parcels of five and seven acres, and he suggested we look at it
for use by the Local Housing Partnership.
· Reread Dick Lewis' limit of work memo and he disagrees with him - that
incidental clearing beyond the limit of work area is not okay.
· Went to the Conservation Department today and asked for the DEP
requirements. He asked that the Corps of Engineers determination on Great
Waves property be obtained.
· Asked about AT&T putting the wires underground - Mr. Azinheira reported
meeting with Verizon and they've agreed to put the cabinet on their
property.
· Spoke of a July 15th letter in the reading folder confirming a vote taken on
April 17th.and stated he hoped it was just a typo.
Selectman McCue:
· Supplemental tax assessments on new construction - when a house is
constructed between tax cycles, the taxes don't catch up with the owner
r until the next cycle and it's lost revenue. He suggested it's something that
needs to go before the voters. Selectman MacCaffrie suggested that when

the Building Dept. issues an occupancy permit, the assessors should be
sending out a tax blÏl Selectman Amoruso noted he's been told they are

selective enforcement issue. Chairman Donovan suggested the BulÏding

Questions and Com
George Dentino, Gladiola Terrace - noted an inaccurate statement made by
Chairman Donovan regarding Mr. Beliveau and Mr. D'Agostino recognizing the
problem with the PILOT and are doing something about it. He stated it was Mr.
Beliveau who recognized it in June of 2000 and Mr. D'Agostino who created the
charges.
Stated the meeting Monday night was both interesting and appalling. He noted
there was a meeting prior to the vote, attended by Mr. Boucher, Ms. Stoyle, Mr.
Beliveau, Ms. Kearney, Mr. O'Neil, Mr. Amoruso, Mr. Donovan and Mr. D'Agostino, at
which the upcoming vote was discussed and an agreement was reached that the
proposal was going to be $180,000. Subsequent to that it came out that Mr.
r Gazzolo and Mr. D'Agostino met themselves privately and decided to go back and
ask for another $83,000. Chairman Donovan said to take it to Mr. Gazzolo because
he knows nothing about it. Mr. Dentino said he finds a meeting of people outside of
the meeting of the people who'd already met to come up with a request for another
$83/000 to be totally inappropriate. Chairman Donovan repeated it needs to be
taken up with them and he wlÏl not entertain another word about it because he
knows nothing about it.
Brought up statements made by the Finance Committee through Mr. Gazzolo that
they didn't care whether the budgeted amount was in excess of legitimate
charges-the budgeted amount was the budgeted amount and the Light Department
should pay it. He asked if the Light Department could estimate revenue in excess
of $180,000 and not receive it and expect the Town to pay it. Chairman Donovan
repeated he knows nothing about it and Mr. Dentino should ask the right people.
Selectman McCarter said he believes Mr. Gazzolo was trying to say there was a
budget number agreed to and it would not be right not to fund it. Selectman
Amoruso noted there was an agreed upon amount that the Light Department had
agreed would be their portion of the budget. He spoke of the difference between
the PILOT and the actual charges, noting they are two separate things, agreeing
they were overcharged on the actual expenses. Selectman McCue noted we
r wouldn't be having this discussion if we hadn't seen the breakdown of the figures.
It appeared initially that we were covering a shortfall in the Treasurers

13
r Department when in fact we were covering a budget shortfall Selectman
MacCaffrie disagreed with the word "shortfalll/ because there is none. The bottom
line is we're turning money back to the Town and we shouldn't need to take money
from the Light Department for expenses that aren't theirs.
Brought up the Town Manger's raise. Chairman Donovan said he's not going to
discuss it. It's been brought up many times and it's over and done with. Mr.
Dentino asked what the vote was, noting the necessity of telling the Townspeople
what the actual vote was. Chairman Donovan said he believes it was 3-2. There was
a question as to whether there was a vote. Chairman Donovan noted he voted for it.
Others who voted for it are no longer on the Board. Selectman McCarter said he's
not sure the vote was ever taken, but rather a vote was taken to ratify the action
taken by then Chairman Amoruso in signing the payroll change form.
