ZBA application for Finding - 64 Campbell Street The application is for a second floor addition to a pre-existing, non-conforming home. Mr. Burke said the footprint will not change, and suggested a positive recommendation to the ZBA. Motion: To send the ZBA a positive recommendation (Tonnan-Armstrong) All in favor. PASSES 3. ZBA application for Variance -land off Noreen Road The application is for a variance from frontage and lot width requirements. Mr. Burke explained this land is off the end of East field Estates and gets its frontage from Noreen Road. It was originally submitted as a four-lot subdivision, then was reduced to three lots. During the Conservation Commission hearing, there were discussions about vernal pools and wildlife habitats and the possibility of requiring a complete biodiversity survey. Rather than doing that, the landowner has resubmitted a single lot without the required ftontage or lot width. Mr. Burke said he understood the landowner's position that a single lot would have less impact than three lots, but said he wasn't sure this meets the hardship test. " Mr. DeMassi said his house on Lewis Road abuts this property. He said a house buih on this land would be behind houses on Noreen Road. Mr. Holmes asked if the remaining land would be donated to the town. Mr. Burke said he understood the entire 15 acres would remain with the homeowner but would have a 13.3-acre restrictive area. Mr. Burke suggested a negative recommendation to the ZBA. The board discussed the fact that the lot is oddly shaped and slopes significantly. Mr. French said if a new subdivision road were built, the houses on either side of it (on Noreen Road) could become non-conforming because they would be corner lots. Motion: To send the ZBA a negative recommendation because the application does not meet the statutory requirements for a hardship (Tonnan-Annino) All in favor. PASSES 4. Surplus material removal request - 500 East Street. The request is for the removal of 1,000 cubic yards of unsuitable surplus material ftom the DPW garage. Mr. Buckley said there had been discussion about fire equipment access and said he has met with Deputy Chief Towne and revised the plans to show the path of the pumper truck around the site. They also discussed the ladder truck, and Deputy Towne said it would be able to hit the building ftom the corner rather than going into the site. Deputy Towne has sent the board an email indicating his satisfaction with the plan Mr. Buckley explained the site requires seven handicapped spaces, which have been provided. He said there are enough handicapped spaces to service each of the buildings, with van accessible spaces. The dumpster pad has been moved to the current location of a shed, which is 10 feet off the building. The pad will be screened and fenced. The location of the mechanical units has not been decided, but there is a note on the plan indicating the units will have to be screened, wherever they are located. Stop signs and striping have been added within the travel aisles. Department Head Comments The clerk read a memo ITom Deputy Chief Towne, indicating his largest piece of equipment will be able to enter and exit the site. The clerk noted there is a copy ofthe ZBA special permit decision in the file. Mr. french asked if the plan shows the changes allowed under the special permit. Mr. Buckley said he had not seen a copy of the approval; Mr. Armstrong read the decision, which does not have any conditions. Mr. Buckley said in that case, this plan is the same as the ZBA saw. Board Comment Mr. Jenkins asked about the delivery area. Mr. Buckley said there are no loading dock areas shown on the plan. Mr. Burke said he has reviewed at the plans and discussed them at length with Mr. Buckley, and is satisfied. He noted a special permit for this building had been granted a few years ago, but was allowed to lapse, and suggested granting the special permit. Mr. French asked if the lights are 400-watt metal halide. Mr. Buckley said the proposed lights match the existing lights. Mr. French said 250-watt lighting would be more appropriate. Mr. Buckley said he could make that change. Motion: To grant the special permit for the construction of a 28,880-sf office building with associated parking with the following conditions: 1. Sheets 1-10 of plans are incorporated by reference; 2. Department head comments be completely and satisfactorily addressed; 3. Lighting will be changed ITom 400 watts to 250 watts; 4. French - In favor. The benefits outweigh the detriments, especially with regard to fisëal impacts, the site is zoned for this use and the special permit conditions relative to salt alternatives will protect water quality in the Reservoir District. This is an appropriate project for the location. Annino - Abstained. Six in favor. One abstention. PASSES Motion: To close the public hearing (Torman-Holmes) Six in favor. Annino abstained. Mr. Annino asked about the Medco site on West Street; Mr. Burke said the earthen berms have been installed, but the boulders have always been there. Mr. Annino said the boulders were not shown on the plan and should have been removed. Mr. Burke said he met with the landowner and building inspector and the site will be regarded and a swale installed to get the water off the street and into the catch basin.
