Re: 44 Oak Street, Construction of new house with grading and associated work
Bob Colleran, Hutchins-Trowbridge Associates, presented the revised plan that shows the location of
the assorted debris that will have to be removed during the demolition and construction process. [Ready
arrives] Question raised on how this project relates to the Re-Development sections of the Riverfront
regs. After discussion, it was agreed that because the existing house was in place prior to 811/96, and
since the removal of the debris would result in a cleaner site and riverfront area, that the project was
approvable. Motion [BeanlHanlon] to close the hearing; voted 7-0-0. Motion [Hanlon/Smith] to
approve the proposed Order of Conditions as discussed; voted 7-~0.

Royal Oak Trust - R~t for Determination of ApplieabUity
Re: South Walnut Street, Assessor's Map 11. Parcel 28; wetland delineation and review
Paul Knapik, ofVHB, Inc. presented the plan; his findings conclude that the area in question is under
5,OOO-sq. ft. in size, is not a vernal pool, in not an Isolated Land Subject to Flooding, and not a BVW.
Therefore. the area, while providing for some of the interests of the act, is not jurisdictional under the
state or local regulations or by-laws. He stated that if any filling of this area were proposed, an
Individual Water Quality Certificate would be necessary. The area under review is not, he states
connected to the other isolated wetland area found in the corner of the property. The bubble area of the
subject area does contain more hydric soils that the longer rmger area. In response to a question, he
states that the area does flood, but not up to the jurisdictional levels ofILSF. The Town Engineer has
reviewed the drainage calculations. and is in agreement that jurisdictional thresholds are not met
Abutter Celeste Jones states that the area does get wet or flood seasonally. Commissioner Bean asks
about the agenda of Royal Oak Trust P. Knapik states he does not know of any future plans for the site.
Discussion among the Commissioners about sending comment letters to other boards or departments
[planning for subdivision review. ZBA for variance application, Building for construction permits]
relative to the fact that an Individual Water Quality Certificate will be necessary and also that, while the
area in question is not jurisdictional under wetland regulations, the area is sensitive for localized
neighborhood flooding concerns. These comment letter could include copies of the letter/certificate
from the Jones'. Mr. Jones also suggested that the connection between the two isolated areas found on
this property be opened up to allow for better management of the seasonal water. Motion
[ReadylHanlon] to close the public hearing; voted 7-0-0. Motion [ReadylFlass] to approve the
boundary of the wetland area as shown on the submitted plan; voted 7-0-0. Motion [ReadylFlass] to
determine that the area is not jurisdictional under the wetland act and regulations or the local wetland
protection by-law, but the comment letter discussed should be sent to the ZBA. Planning Board and
Building Inspector, and the documents from the Jones' and the review letter from the Town Engineer
will be attached to these comment letters; voted 7-0-0.

the top of the brook channel. Discussion about planting and re-vegetation of the disturbed areas
