V. Boutu - Request for Determination of Applicability Re: Land at the end of Jennifer Drive-review wetland boundary & access for test pits Ralph Maloon, from RIM Engineering, presented the plans. A revised Plan "B" showed the wetland area that has formed in the flood compensation area that was created as part of the original subdivision. The Commission has not viewed this wetland line. A new Plan "0" was presented showing one singl~family house off the end of Jennifer with no wetland alteration shown. This plan will be provided to the applicant as an ahernative to the plan showing a wetland crossing for two houses. In answer to a question, R. Maloon indicated that the flood compensation area is approximately .8 acres in size. Steve Smargon, 14 Jennifer Drive asks about setbacks between wetland line and the house shown on plan "0". He was informed that the Board of Heahh regulations on septic systems and the wetland regulations on no-disturb zones would control the various setbacks. Motion [Flass/Smith] to continue to 7:45 PM on 11/5/01. Voted 4-0-0. 2. John G. Walsh - Abbreviated Notice of Resource Area Delineation Re: Land between School Street and Routes 140 and 495 Ralph Maloon, RIM Engineering, presented the plan along with John Walsh and Karl Drown, wetland consultant. J. Walsh explains that he has partners on the two different sections of the total property. He wants to determine wetland boundaries so that land can be marketed properly. D. Lewis and K. Drown reviewed the site walk held on 10/10/01. Generally speaking, the wetland boundary shown is accurate. There was one area where a connection was made between flags, eliminating a couple of flags in the middle. There were a couple of locations where the line was not closely reviewed since the 25-foot no disturb requirement of the by-law removes some areas from being possible work zones. In response to questions on fish in the pond and vernal pools, K. Drown says that fish are present in the pond and that he did not see any area where vernal pool habitat existed. Motion [Matthew/Smith] to close the hearing and issue Order approving the wetland line as discussed; voted 4-0-0. 3. Other Business a. He will ask OPW for that and rock[s] to block access point. Also, "No Hunting" sign at the Strese Property on Ware Street needs to be posted. e. Town received notice form the Division of Conservation Services that a $250,000 grant for the purchase of the Essex Street parcel was approved. Paperwork remains to be completed and the Open Space and Recreation plan needs to be completed and submitted to the state. A new round of Self-Help grants is opening with a January deadline. t: Copies of the Vernal Pool Certification forms for the Gilbert Street pools were received from Michele Grenier. r- r r I Conservation Minutes 10/15/01 page 2 4. Discussion with Lenny Flynn L. Flynn informs the Commission that he and the NR T have been approached about the purchase of certain land in the Canoe River aquifer for conservation purposes. Land is not directly on the river, but might make good recreation property since east Mansfield is lacking in this type of land. The title to the property is somewhat confused with several heirs having an interest, but that might create a good opportunity to purchase it an advantageous price. He is asking the Commission for a vote of confidence to proceed with any discussions. It is also noted that the Trust for Public Land might get involved as part of their work on the Canoe River watershed project. Motion [FlasslMatthew] to proceed with discussion on this parcel. . ous vote. By , .
