Mansfield Co_rvation Commission Minutes of Meeting - September 10,2001 Present: Commissioners Paul Boyden" Shirley Hanlon, Carol Matthew, Chris FIass, Diane Ready, Jaek Smith, Bob Bean; Diek Lewis, Environmental Planner 1. Diseussion with Dennis Tague, 2 Short Street Per an earlier discussion among the Commission, Mr. Tague was sent a letter regarding the work [clearing and establishment of lawn area] on the left side ofhis house, with the work being within the 100-foot buffer zone. D. Lewis explained his meeting with the homeowners and his assessment of the work. The edge of the newly created lawn is approximately 36 feet away from the wetland line. The lawn is fully stabilized. Mr. Tague stated that he was not tJying to crate any problems or do the wrong thin& he was just not aware of the limits of work and the wetland boundary. The area that was cleared was, he said, full of poison ivy and he just wanted to make the area more usable and safe for area kids. The Commission expressed appreciation to Mr. Tague for coming in explaining the issues. Motion [plass/Smith] to send a letter to Mr. Tague outlining the issues and making it clear that no additional clearing work is to be done and that the current limit of work needs to be maintained. Voted 5-0-0 [Ready & Bean not voting]. 2. John Sullivan, Town Engineering - Requests for Determination of ApplieabUity Re: Repairs to bridges on Mill St. and Spring St. I. Sullivan explains that the projects involve the repair of deteriorated sections of these two bridges including filling of cracks and replacing flaking sections of concrete. In some places, the steel re-bar is showing through. The work will be almost entirely done by hand, with protective measures in place to keep concrete and other materials out of the river. The focus will be on the underside of the bridge spans. [Ready arrives] Question of notification of the state for this work. 1. Sullivan states that the bridges are not state bridges, so given the level of work, he sees no need to notify the state. Timeframe is for work to be done in the low-flow time of the summer of2oo2. Ifwork uncovers any re-bar that need to be replaced, then the bad section would be cut out and new section welded back in place. Motion [Bean/Hanlon] to close the hearings; voted 5-0-2 [Smith & Ready abstain]. Motion [HanlonlFlass] to issue Negative 3 Determinations for both hearings; voted 5-0-2 [SmithlReady abstain]. 3. Town oCMansfield - Request Cor Determination of Applieability Re: Environmental Assessment at Hercules Landfill, Stearns Avenue Ralph Penney, Penney Engineering, presented the project, which involves the installation of test pits, monitoring wells, and sampling of soil and water in the area of the former Hercules Landfill. The Town purchased the land in the 1960's. The Town has negotiated with Hercules, Inc. and they will pay for Y2 of the assessment costs. The state departments of Solid Waste and Hazardous Waste are involved in reviewing the project. The site investigations to date have found metals, cyanide, and other contaminates. The material excavated for the test pits is returned to the pits as evaluations are completed. Question raised with the vernal pools located on or near the project area. D. Lewis will check files on this issue. In the wetland areas, both bordering and isolated, the soils and water will be sampled by hand; this will help check for impacts resulting from surface run-otT. It is indicated that no heavy equipment will be used in any vernal pool area. Old ditches found on the site may have been used to help drain the lagoon area, where extensive testing will take place. This could have helped spread over a larger area the pollutants. Motions [HanlonlReady] to close the hearing and issue a Negative 2 Determination, with the condition that the consultant will maintain contact with the Commission office on where work is taking place and what is being found. Voted 6-0-1 [Smith abstains]. 1 f r- r r . Conservation Minutes 9/10/01 Page 2 4. Massa4:husetts Highway Dept. - Request tor Determination of Applieability Re: Repaving of Route 140, School St. to Foxborough Town Line 5. Tom McGuire, Mass. Highway Environmental Engineer, presented the plan for the removal of2 & ~ inches of asphalt and the placement of 5 inches of new pavement. Existing drainage structures will be raised, new guardrails installed, and pavement striping. The shoulders of the roadway will be repacked to make the transition between old and new pavement height. Question ofMEPA. T. McGuire says no MEPA thresholds are triggered. No work in culverts unless a broken flared end is found. Intersection of Norfolk Street will be slightly modified. Work is proposed for 2002. Motion [HanlonIFlass] to close the hearing and issue a Negative 3 Determination with the condition that the Resident Engineer for the project contact office regarding the placement and location of hay bales. Voted 7-0-0. Vasilio_ Boutas - Request Cor Determination of AppUeabiJity Re: Land at the end of Jennifer Drive, Review of Wetland Boundary 1 Access for Test Pits V. Boutas present. Two Commissioners visited the site on 9/8/01. The flagging of the bank of the Little Canoe River looked okay. There is a question of the status of the compensation area that was created as part of the original subdivision, and whether it is now a wetland area. Also, there is possibly a buffer zone line from the wetlands at the rear of Bird Rd. subdivisions that may fall on the site. The route of the test pits still has not been shown. There is no new information on any possible vernal pool on this lot. The pool could be contained within the wetlands to the right of the driveway on Lot 4. Motion [ReadylHanlon] to continue the hearing until 9124/01 at 8:00 PM and request that test pit route, any new buffer zone lines, and extent of the old compensation area be shown on the plan, along with an overall plan that shows all of the areas of wetland fill and compensation for the earlier lots and the subdivision. Voted 7-0-0. 6. V AM Realty T...t - Notiee ofIntent Bearing Re: 241 Francis Avenue Jim Dunn, of Dunn-Mckenzie, presented the plan. The 9/8/01 site walk found that the wetland line is accurate and that the wetland is isolated. The access road that will be constructed near this isolated area will be within area that is already partially developed with lawns or fencing. Question raised on the washing of the trucks and storage containers. Mr. Cannell~ of V AM Realty, indicated that they use a washing system that retains the wash water and recycles it. Some of the sub-leases may use a different system, but they will try to work with the other parties to control this type of operation. Motions [Hanlon/Ready] to close the hearing and issue the Order of Conditions as drafted with the change that the Project Engineer will contact and work with the Commission's office on the erosion control measures at the outlet of the large drainage basin which flows onto conservation land. Voted 7-0-0. 7. Other Business a. Question asked about final rePort from Michele Grenier on the Bonvie land on Gilbert Street. D.Lewis will check into this. b.
