1. Informal discussion with Gary Jacobs
Re: the fiber optic project on Rte. 495
Mr. Jacobs explained that he works for Northstar Industries and is a consuhant on a Fiber Optic project
along the Rte. 95 median strip. Work on this project is already occurring in the northern area ofRte.
495, with the work taking place in the grassy area adjacent to the roadway itself. Usually the work is
20-feet off of the edge of pavement, except in the case of ledge or wetlands. In the communities where
the work has begun, the filing of a Request for Determination has been the normal approach, with the
applicant asking for a Negative Three Determination with appropriate conditions. The work trench is
covered every night and seeded and mulched after the conduit is installed. An Inspector is on the job at
all times. It was the consensus of the Commissioners present that a RDA filing is okay. After wetlands
have been flagged, the application will be filed.
2. Request for Determination of Applicability George Covett
Re: Land off of Maple Street, adjacent to Eastfield Estates
Mike Trowbridge began the presentation and Ralph Maloon picked up half-way through. A portion of
the area has been reviewed as part of the discussion on Eastfield Estates. Flags 1-18 are by Carr
r Research Lab and Flag 100-147 are by RIM Engineering. The RIM flags are about one month old. The
Commission set a site walk for 3/10/01 at 8:30 AM, at which time the Commissioners can also inspect
the restoration work by Folkman and Zola on Eastfield. The hearing will be continued to 3/12/01 at
7:00 PM. Said dates and times set by a Motion (MatthewlHanlon] and Voted 5-0-0.
3. Notice of Intent Hearing - Michael Fandel 53 Tanya Drive
Re: Construction of garage and house additions with grading and associated work within 100 feet of a
wetland resource area.
Michael Trowbridge and Mr. Fandel were present to discuss the plan. Michael Trowbridge presented a
revised plan that addressed some of the concerns raised by D. Lewis in an initial review of the plan.
This revised plan pulls the garage farther away from the resource area. The driveway is proposed to be
16 feet of the area marked as a potential Vernal Pool. This proximity is of a concern to the Commission.
M. Trowbridge will review pulling the drive closer to the house and away from the resource area. The
site is within an Estimated habitat area and the Natural Heritage Program will be commenting on this
project. Abutter Ken Fallon, who lives next door has reviewed the plan and does not have any problems
with the proposal. Motion (HanlonlBean] to hold a site walk on 3/10/01 at 8:00 AM and continue the
hearing until March 26th at 7:45 PM; Voted 5-0-0.
4. Continued Notice of Intent hearing for James Shalek - SE 211-642
Re: 1283 R East street, Castle Hill Estates subdivision
Ralph Maloon presented a marked up plan that shows the new 200-foot Riverfront Area. When D.
Lewis and B. Bean did a site walk, they came across a channel of the Canoe River that was about 12-feet
r down gradient of the wetland shown on the plan. The channel was flowing and therefore should include
the 200-foot protection benefit of the Rivers Act. R. Maloon indicated that a revised plan would be

prepared which shifts the two Exclusive Use areas for Lot B and C. C. Matthew raised the idea of a
Conservation Restriction on land within the Riverfront Area that will be in private ownership. Ralph
will look at this issue. It was decided to send a letter to the Planning Board supporting a modification to
the plan that will shift the Exclusive Use Areas. Motion (MatthewlHanlon] to continue the hearing to
3/26/01 at 8:00 and send the letter to the Planning Board; Voted 5-0-0.

Discussion with Mike Ahem, DPW Dept.
M. Ahern updated the Commission on several projects. Work on the improvements to Memorial park
will continue this Spring. The removal of the loam on the inside of the High School track has begun and
will continue when weather permits. At Plymouth Street, there is about one weeks worth of work in the
front and some additional work in the back section. There is the possibility that the US Army Corps
may come and perform some work for the Town. Plans are for the new fuel tanks to be installed at the
Highway Garage this Spring or early Summer. He suggested that it would be helpful for the
Commission to send a letter of support to the Planning Board on this project. Finally, he said that the
trash clean-up at the Library area ahs been completed and the clean-up at the High School will continue
this Spring when that construction project is completed. Motion (HanlonlBean] to send a letter to the
Planning Board on the fuel tank project; Voted 5-0-0.
6.
Request for Certificate ofCompIiance for Lot 5A, 15 Sean Drive SE 211-343.
All of the work on this house was completed over 5 years ago and D. Lewis sees no problems in issuing
a Partial Certificate. Motion (HanlonlMatthew] to issue a Partial Certificate; Voted 5-0-0.
Discussion on the Consultant for the Review of the Massapoag Realty Trost project on Gilbert St.
D. Lewis prepared and distributed Requests for Proposals from four firms: BSC Group, New England
Environmental, LEC, and Wetlands and Wildlife. All four responded with proposals. There was
significant discussion on the four candidates. Criteria, including credentials, how they will prepare
material for the Natural Heritage Program, hourly rates, location and travel costs, were considered.
Another criteria considered was the size of the company and the question of knowing who the
Commission would be dealing with. After considerable discussion, it was the consensus of the five
member present to enter into a contract with Wetlands & Wildlife. D. Lewis will contact Michele
Grenier and double check on her availability to start this review in a timely fashion. Assuming no
problems, D. Lewis will get a contract signed and begin the process of working out schedules and
coordinating activities with Ms. Grenier. On a Motion [ReadylHanlon] to hire Wetlands & Wildlife
for this consuhing project with fees, up to $7,500 , to be paid by the applicant, Massapoag Realty Trust.
Voted 3-2.
Motion (BeanlMatthew] to Adjourn; Voted 5-0-0.
