The Executive Session for the purpose of discussing litigatiórfop.ened åt'fit'Õ§p.m.
Present were: Chairman Louis P. Amoruso; Clerk Michael W. McCue; Vice Chairman
Bradford E. Wills; and Selectman David W. McCarter. Selectman Daniel Donovan
arrived at 7:10 p.m. Also present were Town Manager John O. D'Agostino and
Attorneys Max Volterra and Susan Jacobs.
The Jordan Jackson roof was discussed during the first half of the Executive
Session.
r
Attorney Max Volterra advised the Board that litigation started three years ago
and eventually ended up before a mediator who put together the outline of a
settlement agreement. Since August, the details have been filled in and they're
meeting again next Monday with the hope of wrapping it up. An a-page scope of
work for the repair has been put together and consists of a detailed paint job of
the roof-thoroughly cleaning it, putting on a primer and a rubberized, weather-
proof membrane. The work is going to be done by a Topco-a subsidiary of GAF--
and the work will be done in the spring when the temperature rises sufficiently.
The work will have a ten year warranty without limitations and a maintenance
contract with Titan Roof for the ten years. Ed Stewart is the mediator who has
been making the arrangements. They are also paying $10,000 to Gale Associates to
inspect the job and perform yearly inspections thereafter. The warranty will be
better than the original warranty given on the job upon completion.
Town Manager D'Agostino brought up the one issue he has with the agreement. He
noted the only vulnerability in the agreement is that there is no performance bond
for Titan Roofing should they go out of business. He noted there is no guarantee
that he knows of that the rust inhibitor will prevent further corrosion above what
has already taken place.
