Public Hearing notices - Attleboro Zoning Board of Appeals, Easton Zoning Board of Appeals, North Attleboro Planning Board 5. Meeting notice - MBTA - Fall River-New Bedford Line 6. Meeting notice - New England Planning Conference Mr. Frank arrived at the meeting. (' Mr. Frank asked whether the car dealer on Oakland Street was violating his special permit by having too many used cars on the lot. Dr. Torman asked about the plan for parking at the train station. Mr. Burke said the T plans to come back with the parking plan at another stage. He said there are approximately 300 resident-only parking spaces on land now owned or controlled by the town, so that number will not decrease. There will be a loss of spaces along Mansfield Avenue, but they will be made up elsewhere. Dr. Torman asked about notifying the landowners who will be affected about the possible zoning change at Special Town Meeting. Mr. Burke said legally, the newspaper advertisement is sufficient notice for a zoning change. Mr. French suggested asking the IDC to notify the landowners in the park. Mr. Burke said the Board of Selectmen needed Planning Board recommendations on the streets up for acceptance at Special Town Meeting. He suggested since the town is now the developer of Tara Estates, the board should support the acceptance of those streets. ( Motion: To support the acceptance of the streets in Tara Estates (Dolan-Cook) All in favor. PASSES Motion: To support the acceptance of the petitioned streets in Stearns Hill Estates, Sturbridge Drive, and Keli Green provided all punch list items are satisfactorily completed prior to Special Town Meeting. (Torman-Cook) All in favor. (Five in favor with Frank abstaining on Pilgrim Road) PASSES ,- Architect Joe DeLuca, Millenium Design Group, explained the plan for a 2,400 square foot drive-up dry cleaner with a covered drive-through. Traffic will flow one-way, counterclockwise. The originally proposed colors have been toned down, with a laminated architectural shingle roof and brick on all four sides up to 2'6". Because the existing building was built using asbestos, reuse was not an option. In response to Mr. Burke's comments, the lighting has been revised to show shielded fixtures. Mr. DeLuca explained there are also evergreens separating the parcel from abutters, which will help contain the spillover. Regarding signage, Mr. DeLuca explained the signs shown on the plan are typical specs for all the signs Zoots might use, but the pylon sign and building sign proposed for this site will comply with the zoning by-law. They do not plan to apply for a variance. ,- Joe Devine, Lenard Engineering, explained the one-way parking flow and 60 degree parking area along Chauncy Street. The landscaping setbacks have been revised from the original submission to provide a buffer 1/3 of the distance to the building. There will be 12 customer parking spaces and two employee spaces, with the drive-through on the Chauncy Street side, a dumpster in the back, and a lO-foot landscaped strip on the north side of the building. Zoots has applied for a special permit from the Zoning Board of Appeals for less than the required landscaping on that side of the building. The entrance to the site will remain on Copeland Drive, with the radius increased to a 20-foot return as required by Mass Highway. They have applied for but not yet received Mass Highway approval. The grading plan shows low points on the north, southeast, and southwest corners of the site. A third catch basin has been added, and the planting beds along the street will be graded up. The site will be connected to the water main in Chauncy Street, and a new gas line will be installed. They will use the sewer manhole to the west of the site. The system is designed for the 100-year storm, and the perc tests were done using a 2.0 safety factor with overflow for events above the 100-year storm. A silt fence will be installed around the perimeter of the site and at the catch basins. The catch basins will have deep sumps with hoods for pre-treatment and infiltration trenches. Department Head Comments The clerk read comments from Mr. Sullivan and Mr. Burke and a letter from the applicant addressing the comments. r- Mr. Devine said he will bring up the crushed stone per Mr. Sullivan's comments, and install a fence around the dumpster per Mr. Burke's comments. ;-- Board Comments Dr. Torman noted the light levels on the photometrics plan seem to spill over onto Chauncy Street and asked that those levels be adjusted. Mr. Frank asked whether pedestrian access from Chauncy Street would be required; Mr. Devine said they could add one if needed. Mr. Burke said there is very little pedestrian traffic at that intersection, and he would rather keep people on the existing sidewalk. Mr. Frank said he did not think a walkway would be appropriate, but suggested if it is required by the zoning by-law, the applicant should ask for a variance. Attorney Edward Valanzola, representing the applicant, said they had already advertised the public hearing for the landscaping issue, and it would be too late to add another issue. Mr. Burke said he and staff has met with the applicant a number of times, and the plan has been amended to address their concerns. He suggested a positive recommendation to the Building Inspector. Mr. French asked if there would be a sign directing traffic around the building. Mr. Devine said there would be a two-sided directional sign at the entrance. Mr. French asked for a painted arrow on the pavement at the entrance and exit. Mr. Devine agreed. r Mr. Frank asked that the building height be added to the plan. Mr. Frank asked about the width between the parking area and the landscaped buffer strip; Mr. Devine said it would be 15' wide, enough for two cars. Motion: To send the Building Inspector a positive recommendation provided the department head comments are satisfactorily addressed, the signage complies to the zoning by-law, and subject to the Zoning Board of Appeals' approval of the special permit for less than required landscaping. Request the Building Inspector review the issue of pedestrian access to the site, though the board does not think it is appropriate to include one. (Frank-Dolan) All in favor. PASSES The clerk read a letter dated September 25,2000 from the applicant's engineer requesting the special permit application be withdrawn without prejudice. Motion: To accept the withdrawal without prejudice (Dolan-Torman) All in favor. PASSES Motion: To close the public hearing (Torman-French) All in favor. PASSES Motion: To adjourn at 9:10 p.m. (Torman-Dolan) All in favor. PASSES Date of next meeting: October 11,2000 at 7:30 p.m. ~ ~ ~ ~.z:;-4L. n. ~ Signatu: of ~Ierk .,jj C · Date of Approval ..- (
