Board Of Selectmen's Meeting February 27,2013 Page 1 of 12 The challenge was to see if the Committee could make cable more affordable. Currently customers are paying $3 per month for franchise related cost. Under the new license, the cost will be $1.60 per month, for a customer savings of $17 a year. Mr. August thanked the Town of Mansfield Cable Advisory Committee for very diligent work of negotiating the new contract, particularly Lou Amoruso and committee members. The new license has overall continuity as far as main feature benefits, ongoing level funding to the Community of the Access Corporation. Committee voted and approved for the license and reminded the Board of the continued opportunity this provides to local programming. Current license expires on March 8th. Mr. Dentino said the Committee has done a great job and felt through experience and trial and error it has become a streamlined process. Mr. Buckley noted that Mr. Moran has attended the negotiation meetings and not a lot of Towns has that, which is invaluable to have a member of the Board take part. Mr. Annino thanked Mr. Amoruso and the Committee for its work and he appreciated their time and efforts. Mr. Moran stated that the next expiration is in 10 years so this was his last negotiation. Motion: To open the public hearing on the dangerous dog complaint made by Ms. Dawn Hebert-Miller (Aptowitz/Annino) PASSES 5:0 Chairman Kozlowski stated that there were a few preliminaries that needed to be attended to prior to testimony. The Chairman noted that the Town Clerk, Marianne Staples, was present to ask participants, on their way in,to weigh in as to whether they intend to testify. The Chairman asked for Ms. Staples to step forward to swear in those that intend to speak or to testify. Ms. Staples asked all participants, who had signed in to speak or to testify to approach to be sworn in. The group was then sworn in by the Town Clerk. A list of the participants sworn in has been made part of the file. The Chairman gave a brief overview as to how the public meeting will run. The public meeting will be limited to the facts at hand for this case. It is limited to what happened on the day in question, the dog's history and to the extent options that may be available for the dog. The Chairman indicated that he would like to limit the general discussion about dogs, the pros and cons. The Chairman stated he would keep this limited to the facts to the case before the Board. Board Of Selectmen's Meeting February 27,2013 Page 2 of 12 The Chairman explained that the complainant will be called first and then witness/witnesses for the complainant will come forward to the podium to speak on behalf of the complainant. He reiterated to keep to the facts at hand for this case and the options available. The hearing will then follow the same format for the owner of the dog with witness/witnesses allowed to speak on their behalf. The Board will then hear from Animal Control Officers, followed by a brief opportunity for a closing remark from both sides. The Chairman called the complainant, Ms. Dawn Hebert-Miller forward. Ms. Miller is represented by Mr. Timothy J. Birmingham. By way of brief introduction Mr. Birmingham suggested to the Board and Townspeople that once the facts are heard they would come to the conclusion that this dog attacked Christian Hebert with no justification and caused severe injuries which necessitated approximately 400 stitches at the trauma care at Hasbro Hospital. As a result Christian is in treatment now and ongoing for quite some time. Ms. Hebert-Miller began testimony with questioning from Mr. Birmingham. Ms. Hebert-Miller gave a brief summary of number of children/ages/names and identified spouse, Seth Miller in attendance. Mr. Birmingham asked about the events of January 3rd and how Ms. Hebert-Miller found out about the dog attack on her son, Christian. Ms. Hebert-Miller stated at the end of her work day in Natick at 4:00pm she tried reaching her husband at home and work by phone. She reached Mr.Miller on his cell and could hear sirens in the background. Ms. Hebert-Miller was told by her husband that he was in an ambulance with Christian, who was attacked by Milo next door. Ms. Hebert-Miller was panicked and didn't understand. Ms. Hebert-Miller proceeded to speak with EMTs and continued to drive to Hasbro Hospital in Rhode Island where Christian was being transported. She was told by the EMT that Christian had a severe, extremely significant wound to his face. Once arriving at the hospital Ms. Hebert-Miller was approached by a nurse before entering her son's room to convey to remain calm and upon entering the room Ms. Hebert-Miller's worst fears were recognized. Mr. Birmingham then showed the pictures of Christian's injury to Ms. Hebert-Miller, the Board and then entered pictures of the child into the record. Ms. Hebert-Miller stated that Christian ended up having a 2 hour surgery, which Ms. Hebert-Miller was present for. Christian was taken home where he missed a few days of school. Ms. Hebert-Miller noted there was awful swelling the days following the surgery and was shown another picture, which was shown to the Board and entered into the public file. Ms. Hebert-Miller stated that the effect on Christian is in all areas. Obviously physically on his face and back of leg but he has nightmares, fears of dogs and his own dogs, he feels ugly and wants to know when it will go away. Christian is seeing a therapist to work through this. She noted Christian has missed school, gym and recess. Christian cannot participate in hockey or karate. Mr. Birmingham asked Ms. Hebert-Miller about the future of the injury. Ms. Hebert-Miller stated they have seen the Chief Surgeon twice, who would like to wait one year for the wound to mature before a decision can be made as to the repair. She reported that hopefully Christian can begin participating in activities again soon. Mr. Birmingham asked if Ms. Hebert-Miller has become aware of any information of previous dog bites by Milo. Ms. Hebert-Miller reported she heard from the family itself of Milo biting Michael Bailey, which required IV antibiotics. Also, Heather Bailey had shown puncture wounds to Ms. Board Of Selectmen's Meeting February 27,2013 Page 3 of 12 Hebert-Miller and told her that Milo had bit her. Ms. Hebert-Miller had heard from news reports that the dog has a food aggression. Mr. Annino inquired about the wound on the child's leg and if it required stitches. Ms. Hebert-Miller reported no stitches were needed and the wound was approximately 7 inches. Mr. Moran asked if Christian had been in the dog's home previously. Ms. Hebert-Miller reported that no he was to be babysat in their home. It was agreed that Heather Bailey would get Christian off the school bus and take Christian home and care for him there. She had no prior knowledge of Christian in the Bailey's home. Mr. Dentino referred to Steve Simmonds report, which stated that Milo had bitten Christian on the face and ankle, and inquired if the ankle injury is actually the thigh injury she spoke to earlier. Ms. Hebert-Miller was not sure but the injury is to the back of the thigh. Mr. Dentino also asked if Heather Bailey acknowledged to Ms. Hebert-Miller that Milo bit her. Ms. Hebert-Miller stated yes. Mr. Birmingham called Mr. Seth Miller to the stand, married to Dawn Hebert-Miller and Christian is his step son. On January 3, 2012 Mr. Miller received a call at his office (100 Copeland Drive) from Michael Bailey about a 911 call being placed. Mr. Miller drove home to 248 West Street where he found EMTs,police, ambulance and Animal Control.Mr. Miller climbed into the back of the ambulance where Christian was on a gurney. He was calm and Mr. Miller felt that to keep him calm was the most important thing to do. Mr. Miller spoke to the EMT who told Mr. Miller that procedurally they were to go to Sturdy or Norwood (closest hospitals)but in his opinion Christian needed a Trauma Center due to the severity of the wound. He advised Mr. Miller to sign a waiver and removed the gauzed to show Mr. Miller the wound. Mr. Miller signed the release and received a call from his wife. Mr. Miller noted Heather Bailey was also present in the ambulance. Mr. Miller spoke that his only communication at the time with Michael Bailey was on the phone about a 911 call and spoke briefly to Heather in the ambulance. Mr. Miller stated Heather told him that Milo had bit Christian in the face and was distraught over it. Mr. Miller was present in the operating room for Christian's surgery. According to Mr. Miller the damage was first assessed so that Christian would be sedated for stitches but once they began the damage was so extensive that layers of stitches were needed. Due to the length of the procedure, time had expired as to administering any more medication to Christian so he had to be allowed to wake during the remainder of the procedure. Pain medication was administered and they worked to keep Christian calm. Mr. Miller stated that there was a wound to the back of Christian's leg but the doctors were so worried about his face that topical treatment only was given. In regards to extra-curricular activities Christian is limited due to his injuries. There is a fear that additional trauma could be caused if he participates in gym, recess or his usual activities of karate and hockey. Sun lotion is also applied daily, due to the wound being sensitive to sun. Mr. Miller noted the family also has one rescue dog and two additional dogs. Christian loved the dogs and had no problem with animals at all. He is now afraid of dogs. There is trauma and comments by Christian about his scarring and he complains of pain when touching the scar. Mr. Miller stated the family is working to assist Christian with his fear and are supportive of the scarring. Board Of Selectmen's Meeting February 27,2013 Page 4 of 12 Christian's classmates made a banner and cards and his teacher visited. Upon return they had Christian tell his story with the thought that it would lessen any questions or possible teasing. Mr. Dentino asked about any interactions between Milo and the children. Mr. Miller stated that there has been none other than on the street while leashed. Chairman Kozlowski asked if he knew the whereabouts of Mr. Bailey when he called Mr. Miller to report the 911 call. Mr. Miller responded he did not know where Mr. Bailey was calling from. Mr. Aptowitz asked Mr. Miller if he was informed by anyone at the scene as to how many times Christian was bit. Mr. Miller cannot remember the times only the severity. Mr. Birmingham expressed deep gratitude from the Millers towards the Town's EMTs, police and animal control who were incredibly responsive and heroic. Chairman Kozlowski reviewed that the respondents to the complaint will appear, followed by their witness/witnesses and then a brief conclusion by both parties. Mr. Michael Bailey and Ms. Virginia Bailey, owners of the dog, Milo, take the stand. Mr. Bailey stated that this is a new procedure for him and that he contacted Mr. Ross and was told he would be able to make a statement. Mr. Bailey read his statement, which was entered into the record. Mr. Aptowitz addressed a typo in that statement concerning the date of ownership of Milo. Mr. Bailey confirmed that it should read September, 2011 and not 2012. Mr. Moran asked if the Bailey Family were given any information about Milo's background during the process of adoption. Mr. Bailey was told that the original owner had mental health issues which caused Milo to be separated from her. Mr. Bailey stated that during their several visits to Buddy Dog the family was only told that Milo had a food aggression around dogs. Chairman Kozlowski asked who was present in the home at the time of the incident to which Mr. Bailey replied that only Heather and Christian were in the home. Mr. Bailey entered for the Board's review a letter from Dr. Jennifer Hyde, MD from Westwood-Mansfield Pediatric Associates and read the letter to the Board which was then made part of this record. Mr. Dentino stated that he has tremendous compassion for both Christian and Heather. He referred to Officer Souza's statement in his report that Christian observed Milo sitting on the couch and went over to pet Milo. Mr. Dentino noted that on Mr. Simonds' report the statement was made that Christian ran over to Milo to pet him. Mr. Dentino is trying to find out which statement is correct. Mr. Bailey responded that he too does not know. He added that he has made a number of statements which he didn't feel were correctly reported. Mr. Bailey is solely going on what his daughter told him since she was the only credible witness. Mr. Souza and Mr. Simonds entered after the attack and he is unsure as to which statement is accurate. Heather told Mr. Bailey she did not see initial interaction. Mr. Dentino stated that both officers received information from the daughter that Heather did see the initial interaction. Board Of Selectmen's Meeting February 27,2013 Page 5 of 12 Heather approached to make a statement, which was made part of the public record. The Chairman Kozlowski asked Heather to factually take the Board through the day. Heather saw Mr. Miller's car in the driveway and believe that since he was home she did not need the key to enter the premises after getting Christian off the bus. Heather realized that Mr. Miller had since left but did not want to return to retrieve the key and risk missing the bus. Heather and Christian returned to Heather Bailey's home to retrieve the key and a video game. Christian was excited to see Milo and ran over and plopped down on couch. Heather stated that Milo woke up. Heather retrieved the key and then passed Milo and Christian to retrieve the video game and Christian was patting Milo. Heather then turned to get the video game and heard a commotion and turned to find the attack. Mr. Dentino clarified the amendment to the ACO's report from Mr. Bailey to correct a misunderstanding that the bite to Mr. Bailey by Milo was due to a food aggression. There were no further questions and the Chairman asked for further witnesses. Mr. Bailey stated that he had no further witnesses to call but there were people attending that were prepared to speak on their behalf. Mr. Bailey wanted to draw the Board's attention to a behavior report from Amy Marder, VMD, which was made part of the record. Mr. Jeff Collins, ACO and Mr. Steve Simonds, who doubles as assisting ACO, presented. Mr. Simonds, who was covering for Mr. Collins at the time of the incident, read his report, which was made part of the record. Mr. Simonds stated his main purpose was to eliminate the threat, which he felt Heather Bailey did by locking the dog into a separate room, and to ensure the dog was updated on his shots, which a call to the Town Clerk confirmed. Mr. Moran asked when the dog was secured what was its demeanor to which Mr. Simonds reported he was in a separate room and he did not enter that room and left the dog there since he was secured. Mr. Dentino asked Mr. Simonds where he received the information of how Christian approached Milo. Mr. Simonds could not recall who said it since there was a lot of commotion but present in the room was Officer Souza and Heather. Mr. Dentino followed if Mr. Simonds was aware that Officer Souza had the same statement to which Mr. Simonds replied no. Mr.Annino asked what happened to the dog after the ambulance had left. The dog was not a threat and Mr. Simonds contacted Mr. Bailey as to requirements of quarantine. The intention was to keep the dog alive for 10 days to ensure there is no rabies. Mr. Annino asked if the dog was barking and the answer was no. There was a lot of chaos but the dog did not bark. Mr. Aptowitz asked if Mr. Simonds ever saw the animal and Mr. Simonds stated no and that the Baileys chose to quarantine the dog themselves. Board Of Selectmen's Meeting February 27,2013 Page 6 of 12 • Mr. Collins began his testimony. Mr. Collins reported that State Law requires any bite to have a rabies protocol of 10 days quarantine, contained within own home or a shelter. Mr. Collins has felt the Baileys have been very forthcoming with any information. Mr. Collins also spoke with Ms. Hebert-Miller and she asked that the notice be dropped off at her husband's work. Mr. Collins had requested information from Mr. Birmingham, representing Ms. Hebert-Miller. Mr. Moran asked if Mr. Collins has observed the dog. Mr. Collins said yes he had visited the home after the 10 day quarantine and found no aggression. The dog was alert but not in aggressive stance, posture was relaxed and eyes not dilated. Mr. Collins reported the animal sniffed and there were no problems. Mr. Collins acknowledged he did make an error in misinterpreting Mr. Baileys' statement of the dog bite incident. That it was in fact a food aggression bite. Mr. Moran asked about the dog being startled, which was what the initial thought was but now through testimony it seems he was alert and inquired if it made a difference. Mr. Collins is going off the bite assessment by Dr. Ian Dunbar, which assesses a dog's aggression by the severity of bites in levels. In reviewing all the evidence, Mr. Collins classified the bite a four out of six. The first is an obnoxious behavior but no contact by teeth and level six is the victim dies. Level four is one to four punctures from a single bite or at least one puncture depth that is more than half the length of the canine teeth. Mr. Moran asked about the wound to the back of the leg and if that behavior is similar to the previous case in the Town. Mr. Collins cannot say if the dog went into a prey aggressive drive but due to the wounds and the number of them it appears the animal continued to bite, which makes the dog dangerous in his opinion. Chairman Kozlowski inquired about dogs and food aggression. Mr. Collins stated possessive aggression/food aggression in an animal makes them protective when food is in the area. The dog becomes territorial and will do everything from growl or bite at you to protect it,usually food. Mr. Collins doesn't believe that food aggression has anything to do with this incident since none of the reports stated that Christian had or was near any food. Mr. Collins felt that the level and depth of bites shows that the dog had an intent to get the child away and Dunbar recommends euthanizing. Chairman Kozlowski asked what Mr. Collins recommends from the information he has is euthanizing the dog. Mr. Dentino reviewed with Mr. Collins the paragraph in his report concerning Mr. Collins interaction with Milo, Mr. Dentino read from the report, which is a part of the record. Mr. Dentino noted that nothing in that paragraph showed lines of aggression and the dog was well mannered. A discussion ensued between Mr. Dentino and Mr. Collins concerning measuring a level 3 to a level 4 puncture. Mr. Dunbar has never seen or interacted with the dog and Mr. Collins acknowledged the scale is well used in the field and Mr. Dunbar is an expert in this field. Mr. Dentino felt there is not much of a difference between level 3 and level 4. Mr. Dentino also wanted clarified that Mr. Collins did not receive the medical file for Christian was using information provided by Mr. Birmingham, the picture and the amount of stitches used. Board Of Selectmen's Meeting February 27,2013 Page 7 of 12 Chairman Kozlowski then asked, in keeping with the facts of the case, was anyone present, who has direct knowledge of the case to speak? No one made an acknowledgement. Mr. Birmingham gave closing remarks on behalf of Ms. Dawn Hebert-Miller. He asked to simply go off of the facts, Milo is three years old and there is more aggression with each incident. He asked to follow the recommendation of the ACO. Mr. Birmingham stated to the Board and Townspeople that this is a public safety issue and that this is not a punishment of the young lady who spoke earlier. Enforce the laws of Mass Chapter 140 Sec 157 and label the dog a dangerous dog who attacked without justification and based on the history this dog it could cause more harm to another child, teenager or adult. Heather stated that the reason the bite is so severe was the location of Christian to Milo. She reported that the family is taking necessary steps to ensure this will not happen again. Mr. Bailey stated it is heart wrenching to hear the events and he would never argue the facts. The family felt this happened in a special set of circumstances. The only time Milo is out of the house is with Mr. Bailey, kept on the premises and leashed. If we are looking at risk the Baileys are willing to do anything the Board can come up with and they will continue to have Milo assessed. The Chairman stated there are several options to the Board. The Board can dismiss the charge, deem the dog a nuisance dog or deem the dog a dangerous dog, where various courses can be taken. The options have changed since the Town's last hearings on this issue. The Chairman asked if Mr. Collins still holds true to his recommendation? Mr. Collins stated any situation can be managed, that is why the law has changed. But Mr. Collins will stand by what he has been told, the pictures and his experience and stay with the original recommendation. The Chairman noted that whatever the outcome either party can move on to the District Court level. There are no further questions of the officers. Mr. Aptowitz sits as a parent and there are no winners here. He is concerned for both families. At the end of the day it was an accident and there was no malicious intent on the girl's part. He explained that this is the toughest thing to do as a Board. Mr. Aptowitz's concern is if something happens again, you can do all the restraining but there are no guarantees. Mr. Aptowitz sided with ACO's recommendation. Mr. Aptowtiz addressed Heather Bailey that there is no blame on her at all. Mr. Annino commended both parties on acting so professional and cordial in the proceedings and on such an emotional journey. He noted this is a community problem. Mr. Annino also commended the police and EMTs and he is extremely sorry for the hurt of both families and that the Board does not take this likely. Mr. Dentino stated nothing that the Board will say can take away any of the grief of each of the families. His questioning was to find out where everything fell. He stated the Board's responsibility is with public safety. He cannot see putting the Hebert-Miller family in an a situation to continue seeing Milo but felt there was some type of interchange between Milo and Christian that could not be explained. He felt Milo could be sent to a good trainer and leave the area where the trauma still exists. Mr. Dentino felt the dog deserved a second chance. Board Of Selectmen's Meeting February 27,2013 Page 8 of 12 Motion: To close the public hearing of a dangerous dog complaint by Dawn Hebert-Miller (Moran/Aptowitz) PASSES 5:0 Mr. Dentino continued that there are ways to assist both families cope with this tragedy. Motion: Move Milo the dog outside of a 10 mile area to a professional trainer(Dentino) Motion was then removed. Chairman Kozlowski noted that an option to move the dog to a training facility outside of the area was presented to the Baileys prior to the public hearing and was rejected. Motion: Milo, the dog, be found a dangerous dog. (Moran/Aptowitz) Discussion: Mr. Moran felt that due to the level and number of bites, it goes beyond a nuisance dog and the dog is a dangerous dog. Mr. Dentino felt the Board is not giving an opportunity to try to solve this without putting the dog down. The Chairman stated the law now prohibits the Town from just shipping the dog to another community. Mr. Annino asked if the Board's hands are tied with options? The Chairman read the options. Mr. Annino asked if the dog has been altered? The Chairman report yes. Motion: The dog be deemed a dangerous dog. PASSES (3:2) Dentino/Annino NAY. Options are now on the table. Motion: The Board to order the dog to be humanely restrained, confined to the premises of the keeper of the dog, when removed from the premises of the owner the dog be securely muzzled and restrained, owner provide proof of insurance in an amount of not less of$100,000 and be tracked throughout its lifetime to the Town and Animal Control and enrolled in a behavior modification program. (Annino/Dentino) Discussion Mr. Ross noted in the statute that the later part of Mr. Annino's motion of behavior modification program is a suggestion only and not an obligation because it is not listed as an option in the statute. (Annino/Dentino) (2:3) Does not pass. Aptowitz/Moran/Kozlowski NAY The Chairman asked for any further motions.
