Community Links newsletter r r, (""' Public Comment Sandra Levine, 20 South Walnut Street, asked about the lighting on the stairs. Mr. Carragher explained the walkways and stairs would have directional down lighting. Board Comment Mr. French asked if the platforms would be at the same level; Mr. Carragher said they would be, including the mini-high platforms. Mr. Carragher said they would like the board's support on several land-related issues. The first of these is shown on the plan as easements "A" and "B", which run from the sidewalk on Route I 06 to the slope at the top of the parking lot. The MBT A would like an easement on these parcels in order to facilitate handicapped ramp construction. Easement "C" is shown on the plan as a triangular piece of land surrounded by Mansfield Avenue, Crocker Street, and MBT A property. The town currently owns this parcel, and the MBT A would like it conveyed to them. Easement "D" runs along the westerly side of Mansfield Avenue. Much of Mansfield Avenue is MBTA property, and the town was granted an easement for road construction. The MBT A would like that easement conveyed back in order to create a wider pedestrian platform adjacent to the track area. r Motion: To grant Easements "A" and "B" to the MBTA, to relinquish ownership of the parcel described as Easement "C" to the MBT A, to relinquish Easement "D" to the MBTA as presented in the plans. (Frank-Torman) Mr. McShane asked how many reserved parking spaces would be lost. Mr. Carragher said with Easements C and D, 39 would be lost, and that with an eminent domain taking, the Cleveland Twist site would lose four spaces. Mr. McShane was concerned about the town having to do the eminent domain taking; Mr. Gay said GA TRA is working on reimbursing the town for that expense. Mr. Cook was concerned about the existing water problems, which may be worsened by the work on Easements A and B. Mr. Carragher said they had looked at that during the site plan design and understand the issues. Mr. Cook told him there are large drainage problems in that area and he didn't want to have GA TRA do its work, then find the water problems are worsened, leaving the town responsible for future repairs. All in favor. PASSES Dr. Torman and Mr. Cook left the meeting at this point. r' 6. Site Plan Review continued - Shaw's Supermarket - West StreetIRoute 140 Greg Mikolaities, Appledore Engineering, presented the changes made to the plans since the last meeting, including a noise study, and roadway plans and profiles. In the revised plan, the stores have been separated by a parking area with the smaller store adjacent to Shaw's and the larger retail store on the other side of the new parking area. r for a truck to make the turn behind Retail B into the loading area. He also requested the new parking area between the stores be looked at in terms of pedestrian safety. Mr. Mikolaities said a noise study had been submitted with noise mitigation items which Shaw's is willing to incorporate, and which will not create noise problems. He added the issues raised by Attorney O'Connell are for the building inspector to decide, and they will get together with Mr. Cook on those things. Public Comment Richard Gordon, 407 West Street, asked about the entrance. Mr. Mikolaities eXplained the entrance would remain in its current location, but would be widened; West Street would also be widened to accommodate the left turn lane. Mrs. Levine asked if all tenants would be held to the same standards as Shaw's regarding noise, hours, etc. Mr. Frank said he thought whatever recommendation the board made on Shaw's would pertain to any others. Mr. Mikolaities said Shaw's would be the biggest use on site, but the others would follow the same regulations. r- Mrs. Levine asked if, when Phase II is done, would the open space from Phase I be used. Mr. French said it would not, and the open space for Phase II would have to stand on its own. Mrs. Levine asked about the cleaning of the oil/water separators; Mr. Mikolaities explained the catch basins have sumps and hoods, and the Town Engineer has required a maintenance plan be submitted prior to construction. Mrs. Levine asked where the property would come from for the construction of the sidewalk along West Street to Walnut Street. Mr. French said the sidewalk is proposed within the existing right-of-way; Mr. Mikolaities said they may need to get temporary construction easements for the installation. Board Comments Mr. Frank asked how the landscaping behind the buildings meets the buffering requirements for the residential zone. Mr. Mikolaities said he thought the landscaping was adequate, but would add more if it is not. Mr. McShane said there would have to be plantings at the fence, landscaped buffer strips along the property lines, and along the public ways. He asked about the possibility of installing a sidewalk on both sides of West Street. Mr. Mikolaities said they had considered it, but thought it best to keep pedestrian traffic on one side. Mr. McShane asked what could be done to minimize the traffic on West Street. Mr. Woodland said they are looking at the off-site impacts, and would work on that further during Phase II, but they want to have maximum access from Route 140. Mr. McShane asked about a Right Turn Only sign out of the site; Mr. Woodland said people leaving the site would want to go left to the residential neighborhoods or the industrial park. ( ,r- Mr. McShane ~sked how children would be kept out of the detention pond; Mr. Mikolaities said they intend the pond to be dry with 3-1 slopes, and to contain water for only 24 hours after a storm. Mr. McShane asked about the signs planned and the trash areas.. Mr. Mikolaities said there would be a free-standing sign at West StreetIRoute 140, and they intend all signs to conform to zoning requirements. He said the trash behind Retail B would be screened, while Shaw's will have a self-contained unit. Mr. Dolan asked about the number oflarge delivery trucks per day. Mr. Woodland said there would be five to 10 tractor trailer trucks, plus 3-5 smaller vendors. Mr. Dolan said with that few trucks, they should be able to go out Norfolk Street without being inconvenienced. Mr. Woodland said that could result in trucks coming down West Street from the other end, which would impact more residential areas. Mr. Achille thanked the applicant's representative for addressing the board's and resident's concerns. r- Mr. Burke said the landscaping and buffering issue as it applies to public ways has to be addressed, but the board could make a recommendation with the condition that the landscaping plans be reviewed to address that issue. Mr. McShane said he thought the board had to approve the landscaping plan, not make it part of the recommendation, and because the plan is not ready, it should be left out. Mr. Mikolaities said he would speak with a landscape architect to develop a plan that will comply. r Motion: To send the Building Inspector a positive recommendation on the site plan as presented with the following conditions: 1. All department head comments be fully and satisfactorily addressed 2. A "Commercial Vehicles - Right Turn Only" sign be installed at the West Street driveway entrance. 3. The applicant confer with Officer Lance Lawson of the Mansfield Police Department to discuss the installation of sidewalks on both sides of West Street and/or other temporary traffic calming methods to mitigate traffic problems during Phase I construction. 4. The following noise mitigation methods, outlined on page 2 of the August 2000 "Noise Study for Erin's Centre Project" by Tech Environmental, Inc. be binding on any and all future tenants: a. Low-noise mechanical equipment and silencers be used for refrigeration fan condensers, compressor and emergency generator room ventilation, and emergency generators. b. Acoustical fencing and panels be installed on three sides around the rooftop refrigeration condenser units. c. Barriers and enclosures shall be installed around the supermarket receiving area, adjacent to the loading docks, and adjacent to Retail A and Retail B compactors. r d. Operational restrictions be placed on the use of trash and cardboard compactors, to operate between the hours of 7 a.m. and 6 p.m only.; vendor trucks be instructed to shut down their engines during unloading. 5. Delivery hours be restricted to occur between the hours of 6 a.m. and 11 p.m. only. 6. A complete landscaping plan, stamped by a Registered Landscape Architect, be submitted to the Planning Board for approval prior to the issuance of any building permit. Mr. Cook returned to the meeting. 6. Site Plan Review - St. Mary's Expansion Phase IT David Oberlander presented the plan for Phase II of the church's expansion, which includes a new school building and parking. Mr. Burke said the plan conforms to open space requirements and all the department head comments had been addressed. He added that as a church use, this is exempt from local regulations. Mr. Frank asked about a landscaping plan. Mr. Oberlander explained there is one with the building plan submission. r Motion: To send the building inspector a positive recommendation with the following conditions: 1. All department head comments be satisfactorily addressed. 2. A landscaping plan is submitted to the board for approval. (Frank-McShane) All in favor. PASSES 7. Special Permit Public Hearing continued - 36 Pratt Street Apartment Conversion Ralph Maloon, RIM Engineering, said he had spoken to Mr. Sullivan, who is satisfied with the changes, but requested the infiltrators be rotated and a catch basin with a four-inch sump be added. Mr. Maloon explained he had added shielded lights to the plan, along with the building height. Mr. Frank noted the section reference on the application and the plan is wrong; it should be 3.3.5, multi-family residence, and the FAR should be 50% in the B2 zone. r- Motion: To grant the special permit use in accordance with the plans as submitted with all department comments satisfactorily addressed (Dolan-Frank) Mr. McShane: In favor.
