Revised Schedule of Principal Use Regulations
Business Uses - Bank
Dr. Torman asked whether a bank branch should be allowed in the park. Mr. Burke said
a bank is a use allowed by right in the I-I zone, and he did not see a bank as a retail use.
Mr. Barrows said the traffic at a bank could be similar to a retail use. Mr. Burke said a
bank sells a service rather than a product, and does not have the same hours of operation
as a retail use. He suggested keeping it a use by right.
Motion: To keep Bank a use by right in the PBD (Cook-Achille) All in favor. PASSES
r' Business Uses - Restaurant
Mr. Burke explained this had been changed to a special permit use in the I-I zone
because restaurants would be more or less compatible in the industrial park. He said
there should be flexibility to allow restaurants to service the needs of the park without
allowing all-night clubs or similar uses. Mr. Barrows asked how uses like that could be
prohibited; Mr. Burke explained the special permit test allowed the Planning Board to
decide whether the application meets the requirements of the by-law and whether it meets
certain subjective criteria, including its effect on neighborhood character.
Mr. Barrows was concerned about special permit uses having to be "sold" to the Planning
Board, making it hard for potential developers. Mr. Dolan said if the use is by right, the
board cannot stop or regulate any restaurant use, whether it is appropriate or not.
Mr. McShane arrived at the meeting.
Motion: To leave restaurants as special permit uses (Torman-Frank)
Mr. Achille reminded the group that Sherry Clancy of National Development had said
restaurants should be allowed in industrial parks; Mr. Dolan agreed, but said they should
not be allowed by right. Mr. George suggested allowing small restaurants in existing
buildings by right, and leaving free-standing restaurants special permits.
Mr. Prestwich said the next owner of the industrial park could change the way the park is
,'-' I run, so leaving some uses special permit may be a good idea. Mr. McShane asked if the
existing tenants would want restaurant uses nearby.

Business Uses - Personal Service Shops
Mr. Burke suggested adding specific uses to the revised definition, rather than using a
phrase like "and similar uses." Mr. Barrows suggested a private postal service, like
Mailboxes Etc., would fit well in the park.
8 in favor. 2 opposed. PASSES
Mr. McShane suggested adding Personal Service Shops as ancillary uses to existing
office uses, while leaving stand-alone Personal Service Shops as special permit uses.
Motion: To add new footnotes as follows: Personal Service Shops by right as ancillary
uses to a maximum of 5% of the gross floor area or 2,500 square feet, whichever
is less; and Restaurant by right as ancillary uses to a maximum of 5% of the gross
floor area or 1,000 square feet, whichever is less. (Frank-Torman)
Mr. Cook asked if the footnotes could be combined and considered cumulative; Mr.
Burke said they could be. Mr. McShane suggested adding "provided the combined
ancillary uses in anyone building shall not exceed 5% of the gross floor area. "
(
Revised Motion: The following uses are allowed as ancillary uses by right up to a total
of 5% of the total gross floor area as follows: Retail: 5% or 2,500 square feet,
whichever is less; Restaurant: 5% or 1,000 square feet, whichever is less;
Personal Service Shop: 5% or 2,500 square feet, whichever is less. Make
Personal Service Shop "N' in PBD with above footnote.
(Frank-Torman) Nine in favor. One opposed. PASSES
Business Uses - Adult Uses
Mr. Burke explained these uses had to be allowed someplace, and suggested the PBD
would be the more difficult zone to locate in because the park is mostly full.
Motion: To make Adult Uses special permit in the PBD and "N' in Industrial 1.

Mr. Burke explained Regulated Refuse Incinerators had to be allowed someplace and

PBD rather than in II because the II zones are closer to residential areas.
Motion: To make Regulated Refuse Incinerators special permit uses in the PBD and "N"

because of their proximity to residential uses.
Amended Motion: To remove Biotechnology from the 12 and 13 zones.
(McShane-Prestwich) 4 in favor. 6 opposed. FAILS
Original Motion: 7 in favor. 2 opposed. PASSES
Revised Density and Dimensional Regulations
Mr. Burke explained the Floor Area Ratio would change from.40 to .60 and the building
height from 60 to 75 feet. Mr. Barrows asked why that height was chosen. Mr. Burke
explained the original proposal was for 90 feet, but said Town Meeting was unlikely to
approve that height, and the character ofthe park should be considered.
Mr. Burke said with the increase in FAR, building height should be increased; otherwise
buildings would have to go out rather than up, resulting in a loss of parking.
Motion: To accept the above Density and Dimensional changes
