PASSES 1. Memorandum dated August 9, 2000 from Lee Azinheira, DPW Director, requesting his department be exempted from the scenic road public hearing requirement in circumstances requiring the removal of trees or limbs on scenic roads when public safety is endangered. Motion: To exempt the DPW Director, in his role as Tree Warden, from the public hearing process when it is necessary to remove dead or damaged trees or tree limbs on scenic roads in cases where those trees cause potential danger to public safety. (Achille-McShane) Three in favor. Cook, Torman abstained. PASSES r- 2. Surplus material removal request - 875 South Main Street - Karl Clemmey. To remove approximately 3,200 cubic yards of surplus material. Mr. Clemmey told the board the work would not begin until after the Tweeter Center is closed for the season, and the material would be used on his West Street site. Motion: To send the Building Inspector a positive recommendation on the request to remove approximately 3,200 cubic yards of surplus material from 875 South Main Street with the standard conditions regarding load coverage, street cleaning, hours of operation, notification of the Police Department and affected abutters. (Cook-Torman) All in favor. PASSES Revised Zoning Map Mr. Barrows asked what the group would like to do about the Golden Triangle land~ Mr. Cook suggested focusing on the land n the industrial park, which they already agreed would not include School Street. Mr. Barrows suggested looking at the height restrictions in the proposed PBD and the Il zones, perhaps increasing the limits in order to attract businesses to an area like South Main Street, which has few residential abutters. Mr. Jenkins arrived at this point. r- Mr. Cook said the existing businesses on School Street are already special permit uses, following the May 2000 Town Meeting changes to the Zoning By-Law, and if they wanted to expand, would have to come to the Planning Board for a special permit. Mr. Prestwich said the Golden Triangle land is the most attractive area for future development in town. r- Mr. Dolan said the group had decided to make the PBD more restrictive than the It zone, in order to help protect the integrity of the industrial park. Mr. Barrows agreed, saying one of the reasons for the change was to keep "big box" stores out of the park. Mr. Cook said the group had talked about allowing some retail uses in the area, if restrictions could be placed on that development~ but he said that issue should be handled separately from the PBD. Mr. Jenkins agreed, saying the group should take small steps with the changes and try to agree on the PBD issues at this meeting. Mr. Dolan asked if everyone agreed on the area outlined for the PBD. Mr. Jenkins asked if the land on School Street should be included in the PBD~ Mr. Prestwich said it should be, since that area is a prime piece of property. Motion: To move the PBD district zone line to the center line of School Street from the bridge at the train track up Route 140 to Norfolk Street. (Cook-Torman) Mr. Cook said he thought a commercial subdivision would work in that area of School Street, with its own roads and multiple businesses. 8 in favor. 1 opposed. PASSES Revised Schedule of Principal Use Regulations The group discussed the proposed uses to be allowed in the PBD. Mr. Dolan said he r- thought Restaurants should be allowed in the industrial park; Dr. Torman said the group had decided against that to encourage people to patronize the downtown restaurants. Mr. McShane suggested a cafeteria in an office building or a restaurant in a hotel would be allowed as an accessory use. He said there should be a way to restrict that use to be available only when the primary business is open. Mr. Dolan said Personal Service Shops should be kept special permit uses, since with the proposed new definition, retail-type service shops have been removed. Mr. McShane said such a use would be allowed under the 5% ancillary use clause, but if it were an independent use, a special permit would be required. The group discussed the feasibility of having Vehicle Salvage in this district. Motion: To not allow Vehicle Salvage in the PBD district. (Dolan-McShane) All in favor. PASSES Mr. Barrows said he was concerned about the downtown merchants not being able to serve all of the people working in the industrial park and suggested enhancing the park by allowing businesses there to provide services. Mr. Cook asked about Banks, saying they have traffic patterns similar to fast food restaurants, and perhaps should not be allowed as stand-alone uses. Dr. Torman suggested Banks be classified under Personal Service Shops. r ., ,. - The group decided to ask Mr. Burke to revisit options to allow Restaurants, Banks and Personal Service Shops in the PBD district as ancillary uses, but not as stand-alone buildings. Motion: To accept the draft Schedule of Principal Use Regulations with the exception of Restaurants, Banks and Personal Service Shops, which will be revisited, and the above change regarding Vehicle Salvage. (Torman-Cook) All in favor. PASSES The group decided to discuss the Density and Dimensional Regulations and the revised Definitions with Mr. Burke. Meeting Schedule The group discussed first holding a public meeting, especially to get input from landowners in the industrial park, since they will be most affected by these changes. The public meeting will be scheduled for early September, and the Board of Selectmen will be invited. The public hearing will be tentatively scheduled for September 20. Motion: To continue this discussion to August 16,2000 at 7:30 p.m. (Cook-Torman) All in favor. PASSES Motion: To adjourn at 9:15 p.m. (Barrows-Torman) All in favor.
