McShane~ Kenneth H. Torman, Scott Frank. Shaun P. Burke, Director ofPlannin and Develo ment Mr. French said he was concerned a recent newspaper article may have sounded as though the board were trying to ambush business owners with its proposed zoning amendments. He said the proposals came after recommendations in the Master Plan, Great Woods Land Use Study and the Mullin Study. r Dr. Torman asked if the Duranco property on Gilbert Street was included in the original proposal~ Mr. Burke explained that it was, but suggested the zone line could be run down the middle of Gilbert Street to exclude that existing business from the change. Mr. McShane said that when the board met with the IDC, everyone had seemed to be in favor of that proposal. Mr. Frank arrived at the meeting. 1. Attorney Wagner presented the application to combine four lots into one, adding that Town Counsel has reviewed the issue. The lot has sufficient frontage and are all owned by Sebonic Partners. Motion: To sign the Form A (Dolan-Torman) All in favor. PASSES The clerk read the public hearing notice. Ralph Maloon, RIM Engineering, presented the plan for a six-lot residential compound with three additional Form A lots on Oak Street, saying the wetland areas may be donated to the Conservation Commission or a land trust. A portion of the existing Oak Street right-of-way, which is actually part of this parcel, will be deeded to the town. Soil testing has been done and groundwater determined~ there will be a private driveway to the homes with shared ownership. Drainage will be brought into basins through a drainage swale, which will be planted with wetland species. (' The common space will be owned jointly by the residents, and Mr. Maloon has added a note to the plan to include a 50-foot no clearing restriction in that area. In order to reduce impact to Oak Street, the Form A lots will have access through the private driveway. - 2 - Meeting of March 1,2000 ,..,. ( Department Head Comments Comments were received from Mr. Burke, Officer Lance Lawson, Richard Lewis, and John Sullivan. Mr. Maloon had received copies of these comments said he will work with Mr. Sullivan on the major engineering issues. Public Comment Cindy Lestan, 576 Elm Street, asked about the drainage. Mr. Maloon explained the system is designed for the 100-year storm, and the proposed swale meets DEP guidelines for containment. The wetland plants in the swale will help to clean the water before it is discharged, and there will be no surface flow to Hodges Brook. Carol Poliziani, 13 Oakleaf Drive, said her house is at a low point and is concerned about additional water problems. Mr. Maloon explained there are existing wetlands in that area, but this project would not shed additional water in that direction. Dan Poliziani was concerned that the site is higher and seems to drain in the direction of Oakleaf Drive now. Mr. French said the board would ask Mr. Maloon and Mr. Sullivan to review this issue carefully. r Pete Lestan, 576 Elm Street, asked about the lot sizes. Mr. French explained they are smaller than required in that zone because the development is a residential compound, which leaves large parcels of open space around the lots. Mr. Maloon said the lots go from 32,000 to 70,000 square feet, with the shortest frontage at 100 feet, and the common field approximately 300 by 280 feet. The zoning by- law requires 80,000 square feet per lot over the entire land area. Mr. Maloon explained some of the land would be deeded to the commission, but that the open space counts toward the lot size after it is deeded. Walt Darby, 580 Elm Street, asked whether the wetland area would remain as it is. Mr. Maloon said it would be. Robert Adams, 339 Oak Street, asked whether the open space would have public access. Mr. French explained that the open space would be jointly owned by the residents of the compound, but if the town took the open space, it would likely be public. If it remains private, the board would have approval of the use of the open space, to be sure it isn't developed or cleared. ("" Fred Brown, Gilbert Street and owner of the Collins property, asked if Lot 2 is buildable. Mr. Maloon said it was, and the existing garage would probably be removed. Mr. Maloon said there is a house on Lot 1, but he was unsure whether that would remain or be removed for a new house. Mr. Brown asked if the common area would be buildable. Mr. Maloon said it would not be, and there would be a restriction on the deed. - 3 - Meeting of March 1, 2000 r> I Board Comments Mr. McShane noted the drainage calculations show recharge requirements being met, but not the solids removal. Mr. Maloon said he had deep catch basins and swales for the total suspended solids removal, with no overflow to the wetlands. Mr. Frank asked that the lots and percentages on exclusive use areas be noted. Mr. Burke said the board can define the width of the road~ in other compounds, the roads have been set at 12 to 16 feet wide. Motion: To continue the public hearing to April 12, 2000 at 8:00 P.M. (Dolan-Cook) All in favor. PASSES Motion: To adjourn to the Board of Selectmen's meeting to discuss the Planning Board's proposed zoning amendments for Town Meeting, and to reconvene the Planning Board meeting following that discussion. (Dolan-Torman) All in favor. PASSES The board returned to its meeting at 10:35 P.M. r Mr. Burke told the board it may want to consider scheduling a default vote on Tara Estates and Alchemist Court, which have not yet been completed. Mr. McShane asked about the Norton Planning Board decision on CVS, and the reasons that board was able to ask for modifications to building design, size, parking, and other issues. Mr. Burke said the Norton Planning Board has site plan approval, but he did not think the board followed the proper site plan process. Mr. Dolan suggested changing the zoning amendment regarding retail uses in the industrial zones to set an allowable percentage or square foot threshold. Mr. McShane suggested the board do something to gets its story out regarding the zoning amendments. Mr. Burke suggested speaking with the large companies in the industrial park. Motion: To adjourn at 11:15 P.M. (Torman-Dolan) All in favor. PASSES Date of next meeting: March 15,2000 at 7:30 P.M. r ~~~~ 19nature of Clerk O'-/~-IV Date of Approval -4- Meeting of March 1,2000
