Frank; and Thomas P. McShane. Mr. Dolan -- volunteered to serve as Acting Clerk. I Correspondence ~ ' ! z.! 1. Minutes of December 15, 1999 Motion: To approve (Dolan-Cook) 3-0-1 with Achille abstaining and McShane not present. PASSES 2. Zoning Board of Appeals Applications: Red Roof Inn for a Variance from Section 4.7.1.2 of the Zoning By-Law . for a 108 foot high, 216.5 sq. ft. sign oriented to Route 140 at 60 Forbes Blvd. in an 1-1 Zone (B-2 Zone stated on application). r Mr. Burke suggested the Planning Board send a negative recommendation to the Zoning Board of Appeals because the height of the sign is grossly out of character with other signs in the area. Motion: To make a negative recommendation because the explanation of the unique characteristics of the lot did not show that conformance with the Zoning By-Law would be a hardship. (Frank-Cook) 6-0 PASSES Mandeville Signs for a Variance from Sections 4.5 (sign within comer lot setback), 4.7.1.1 (wall signs exceeding area limitation), and 4.7.1.2 (freestanding sign exceeding area limitation) for signs at 261 Chauncy Street (CVS Pharmacy) in a B-3 Zone. Mr. Burke suggested a negative recommendation be made on the comer lot setback variance because the request derogates from the intent of the Zoning By-Law which is to keep required sight distance. Motion: To make a negative recommendation on the Variance from Section 4.5 (sign within comer lot setback) because there is no reasonable hardship, it is not consistent with the plan for the project at the time of approval, and because it derogates from the intent of the Zoning By-Law and creates a public safety danger. (McShane-Cook) 6-0 PASSES (- Motion: To make a negative recommendation on the Variance from Section 4.7.1.2 (freestanding sign exceeding area limitation) because the request - 1 - Meeting of January 5, 2000 g ) 'j'1 ( doesn't meet the intent of the Zoning By-Law and is almost double the size allowed. (Dolan-Cook) 6-0 PASSES Motion: To make a negative recommendation on the Variance from Section 4.7.1.1 (wall signs exceeding area limitation) because the applicant showed no reasonable hardship nor put forth any argument for the severe derogation from the intent of the Zoning By-Law~ granting the Variance would create an aesthetic problem in the neighborhood; the request is not consistent with the goal of the signage by-law which tries to reduce signage pollution. (McShane-Dolan) 6-0 PASSES 3. Memo from John D' Agostino regarding deadline for submitting articles for the Annual Town Meeting Warrant. 4.
