Selectman Robinson also requested that Ms. Bittner meet with the Fire Chief to see what they need to do to satisfy his requirements for emergency access while blocking the street. (Donovan-Amoruso) All in favor Passes Dan Donovan, 97 Court Street and a Selectmarr spoke about George Wojtkiewicz's pledge proposal of the previous week. He noted his own pledge to help everyone when he was elected and stated he will not sign this pledge. Mr. Donovan reported he had asked people about the Proposition 2 t override and they spoke at Town Meeting and on the ballot. He also asked that the rest of the Board join him in not signing it. He addressed comments he'd heard about the way the question was put on the ballot and noted the Town could have ended up with a trash fee of $150. plus increased taxes due to the override for the schools if the ballot question had been drafted in a different manner. As a Selectman, he said he will be cautious when the new fiscal year starts and will be questioning everything. Bill Gerber 362 Central Street - stated the Fire Chief's problem with the budget was disturbing. If it was just discovered a week or two ago, that's an even bigger problem. Uniformed services in this town have to be managed in a fashion where they can stretch the taxpayers' dollars. They can't keep coming in looking for more Minutes of June 28, 2000 2 and more resources. He said he hopes the Board of Selectmen keeps an eye on this problem and we get back into something more reasonable. Also, he noted, speaking as a member of the Cable Access Board of Directors, that people think we run MediaOne. He had with him signatures given to his wife at the Council on Aging of thirteen people who signed regarding their displeasure with MediaOne. He stated the service is a disgrace and the quality is abominable. He advised the Selectmen that he has submitted an application to serve on the ad-hoc committee to look at the license. Discussion with Dan Donovan followed regarding the number of calls received Mr. D'Agostino responded to the comments regarding the Fire Department, noting he has a difficult time using Reserve Funds due to the increased sick time. He stated we have had two firefighters out on sick leave, and that contributes to the increase in sick time. He pointed out the Board would have to look at the problem with closing a station when firefighters work 42 hours per week on an 8 week rotation. An increase of sick time of 46 % indicates more people are getting sick on the 2 days they work rather than the 5 days they don't work. He pointed out it's not an issue of how many hours they work, it's how many days they're not there, noting sick time is a benefit and not an entitlement. Mr. D'Agostino noted there are collective bargaining agreements we would like to change to make it more inappropriate for people to use sick time unless it is absolutely necessary. On a positive note, he stated we have received an e-ma/Ï from the Chief advising us there was a dramatic decrease in sick time following the last meeting and he will be able to meet the budget. Nancielee Boyden, President of Cable Access, speaking as a subscriber - reminded the Selectmen they received a letter from her written on June 12th regarding the removal of the safety channel. It's now been moved to channel 98, and she's not sure if basic subscribers can receive it. Any person who takes over the license is supposed to allow us five channels. If 98 is not in Basic, we're down to three channels because they already took one from us. She noted we have been Cable 8 for 18 years--Now we're Cable 9, while Foxboro and others were allowed keep Cable 8. She stated MediaOne could just have easily put news onto channel 6. She presented a letter to the Board of Selectmen for their assistance in asking questions when meeting with Mr. Foss. Ms. Boyden also noted the financial damage Cable Access will sustain in changing everything to Cable 9. She said the Board of Selectmen has the authority to make MediaOne hold to the tenets of their license. If they do not adhere to the license, they sho~ld be fined. She pointed out MediaOne did give 30 days notice as required in the license, but they stalled. Cable Access has never received a response from them as required within 10 days of the letter they sent to MediaOne detailing the problems they were experiencing with them. She said she believes Mr. Foss bought himself time in not coming here, noting he had time to do the stickers and packages that went out. She asked the Board of Selectmen as holders of the license to go after him. Minutes of June 28, 2000 3 Brother Alexis Bugnolo, a Franciscan Brother living with relatives in East Mansfield - Stated the Catholic Channel has been moved from Basic to Basic plus 3 for an additional $20.90. He said it's the only religious channel in the station lineup and should be offered in Basic. He also noted MediaOne is now listing Channel 82 as the Playboy Channel, which is pornography. He stated this can be ordered by children any time of day or night if the access code is known. With the AT&T takeover, even more pornographic material will be coming to Mansfield according to a news release he referred to (Morality in Media) and presented to Board. He pointed out the Selectmen have the right as licensee to eliminate these channels entirely. He cited the problems associated with pornography and laws that make the distribution of pornography over television an illegal activity. He further noted that the cable system requires the use of municipal property to access our homes. In allowing this, the Town would be actively promoting pornography. He asked that all adult programming to be eliminated. Clerk Wills said he personally objects to the offering of pornography and finds it offensive. BI'lI Gerber - told everyone that Saturday morning at 9 o'clock, if we can get a signal, a new show called Swap and Shop will be aired and people can call in and promote yard sales and items they are selling for non-commercial purposes. Water Operations Manager Kurt Gaffney, and Bob Chappel and Dan Garson of Woodard and Curran were present to meet with the Selectmen. Number 8 is an amendment for $80,000 to the original contract for costs resulting from the requirements to address the concerns of Foxboro in the Interbasin Transfer Application process. A breakdown of the additional costs was reviewed, as outlined in the Budget Backup dated June 26, 2000 submitted by Woodard & Curran. The additional costs were necessitated by issues raised by the Town of Foxboro the last two months of the permitting process. Woodard & Curran had two plus people working full time to address those issues and the issues needed to be satisfied to get the permit approved. Mr. Gaffney noted we have enough money to pay for this portion of the project, but at the next Town Meeting we will need additional money to finish the project. The construction of the well is a capital project and will be covered by the new rates; however, the funds must be authorized at Town Meeting. Mr. Gaffney reviewed the conditions set by the Water Resources Commission which included leak detection (which has been done), the metering of 35 non-metered houses (which has been done), and downsizing of meters for commercial customers (out to bid now). The other request tonight covers the additional items requested--water audit, conservation plan, baseline and Minutes of June 28, 2000 4 monitoring plan, and equipment. They will be preparing plans and documents for submission, with approval hinged on demonstrating there would be no adverse impact, documented and confirmed with monitoring. This will be the baseline year for that monitoring and will be the most expensive year. Monitoring will continue at a lower cost in subsequent years. DEP has to renew the water withdrawal permit every five years and will use the annual plans in their decision to renew. It was noted that we did the right thing in cooperating with Foxboro. Their consultants are they're now following a model similar to what we used. The processes are independent, however, and they have the right under the procedure to raise objections. We were successful in keeping the agency focused on Mansfield's project. Clerk Wills inquired as to whether Foxboro was asking legitimate questions or just trying to prevent us from getting our well. Mr. Garson replied that the questions were legitimate in the sense that they had the right to ask them. They were reasonable questions, but we felt we had already answered them. The agency felt the process needed to be extended and the issues revisited. Monitoring would have been required anyway, and as a result of the additional effort, we were forced to go back and do additional modeling. The questions raised brought greater focus and scrutiny on the modeling techniques and additional field work had to be done. Extra meetings and time contributed to extended time and cost. Mr. Gaffney noted monitoring would be included in the budget after this year. Mr. D'Agostino explained the Town made a calculated decision to go ahead because we were so close to getting the well permitted. When Foxboro raised questions, it pushed us back a bit, but we made the decision to continue. The last time the Water Resources Commission issued a permit was back in 1995. Our effort, although costly, was in the best interest of the townspeople overall. If we're allowed to use additional water from the basin, the Morrison well will be a valuable asset to the Town. We have demonstrated now and the agency has accepted that a greater amount can be withdrawn without detrimental effects. That had not been the expectation five years ago, but the higher volume has proven to be a benefit. It is anticipated the well will be completed in the spring or early summer. Motion: To authorize the Town Manager to sign the Engineering Services Agreement for Morrison Well No. 10 Permitting Services dated June 23, 2000. (Wills-Donovan) All in favor Passes Leroy Hendricks, Dave Young and Ken Hackett were present to present a proposal to completely replace the control pumps. They explained that the control system is over 15 years old. The people who built it are no longer around and it can no longer be supported. The new pump control improvements will dovetail nicely with the SCADA system we already have in place. This will provide an upgrade to the Minutes of June 28, 2000 5 SCADA system, put in a year or so ago, and is computer monitored with more graphic displays. The improvements will place all our utilities, including electric, on the same standard. It is not proprietary software, which is a benefit in that it can be purchased right off the shelf. The pump control improvements will take care of the brown water pumps and will control the infrastructure of the plant. Clerk Wills agreed it's much needed and said he is glad they came forward with it. Selectman Amoruso asked where the money is coming from. Mr. Hackett replied that the engineering and architectural costs are within the existing budget for FY2000 and will be encumbered as soon as the proposal is approved. Motion: To support proposal No. 202909 dated June 26, 2000 totaling $31,494. (Amoruso-Wills) All in favor Passes Dave Young of Camp Dresser & McKee Inc. (CDM) then reviewed Amendment No.1 to the Agreement for the Study and Report and Professional Design, Bidding and Construction Services for the Wastewater Facility. It was noted they will be meeting on the reclaimed water study and coming before the Board on that next week. Mr. Young reviewed the two items of discussion: the next round of State revolving fund loan applications due August 15th, and discussion with the DEP on the reclaimed water project that will be required in order to start and finish the wastewater plan. Part of proposal is for us to meet with DEP to come to an agreement on what needs to be done to complete the study and put a budget together for the State Revolving Fund (SRF) program. The second part of proposal is related to the reuse project and the Town's future plan on the upgrade. Discussion continued regarding improvements to the disinfection system, with the suggestion that we should be looking at liquid chloride and upgrading to a gas system. A cost benefit analysis needs to be done and Mr. Hackett wants to look at other facilities. This project will be dovetailed in with the reclaimed water project. $25,000 is the total cost and Foxboro and Norton will share in it. Motion: To approve Amendment No.1 in an amount not to exceed $25,000 and to authorize the Town Manager to sign the Agreement. (Amoruso-Wills) All in favor Passes The public hearing was opened at 8:30 p.m. A letter was read from Mr. Clemmey requesting a continuation of the public hearing. Motion: To continue the public hearing to July 19th at 8:00 p.m. (Donovan-Amoruso) All in favor Passes Minutes of June 28, 2000 6 Selectman Robinson excused himself due to a conflict of interest, having worked for Time Warner within the last two years. Selectman Amoruso agreed to act as Chairman in his absence. Town Manager D'Agostino opened the discussion, noting Mr. Foss called the office and he and Mr. Foss had a discussion about the concerns of the Board. The realignment of the channels has occurred subsequent to that discussion. Selectman Amoruso advised Mr. Foss that the Town would like to get back their additional channel and would like to keep channel 8 as our cable access programming channel. The Board originally requested to speak with Mr. Foss because of our interest in getting back our fifth channel that had been loaned to Time Warner for their use. It had been offered to them until there was an expansion of the channels, at which time it was to be returned. At the time it was expanded, there was not sufficient need to get it back immediately. We have since been asked by Cable Access to get the fifth channel back, and now we're not sure what is still on Basic. Mr. Foss distributed envelopes containing letters recently sent to subscribers. The letter explained what was occurring on June 27th. There would be 82 channels, with a change in the mode of transport from HFC channel delivery to scanner delivery. Also explained were the box change out procedures, if necessary. New remote control stickers were included, along with a marketing piece on RoadRunner, digital television, digital telephones, and some of the new packaging available for premium channels. He reviewed the rate notice sent out, noting prices did not go up, but tiers were reformulated with packages in which their programs are included. New prices will be effective July 15th. He stated the most important piece in the packet is the new Channel Line-Up that occurred June 27th. They still have the tiers we're familiar with. The Basic tier has eliminated all satellite programming, making it more affordable. He reviewed the applications of Basic programming, with Channels 9, 15, 17 & 98 being the four local channels they've mapped out. Mr. Foss cited two reasons why the change was done in this way. They now have the system fed off the Rehoboth headend. Access channels feed back to Foxboro. Rehoboth and Mansfield are both in Bristol County. This is the mapping for the Providence viewing area. They prefer to put broadcast channels on corresponding channel numbers, so they mapped out channels 2-7, with the exception of MediaOne on 3, with the broadcasters they had to carry. He further explained the mapping of the independents they must carry, with their basic tier being 95-23. Selectman Amoruso reiterated that we are looking for a place our 5th channel is going to go and also have a problem with our Public Access Channel being 9 instead of 8. He noted it took an amendment by this board to allow the previous change in channels Minutes of June 28, 2000 7 and believe it would take another action by the board to make further changes, stating it has been done without our approval or acceptance. Mr. Foss delivered more bad news. Since this is the Providence DNA and we have to put access channels on the basic frequency, we would have to take out one of the Boston broadcast channels. There would also be more dramatic things that would have to happen in order to meet the Town's request. He said he is unaware of the amendment by the board to the franchise and it might have occurred during CVI's time. Selectman Amoruso also restated that Cable 8 will be incurring considerable expense as our Cable Access channel to make the change. He would like to see that change not have to be made and stated he believes we have the right to stop MediaOne from making the change. He further stated that other towns, perhaps not in Bristol County, are retaining Channel 8 for their access channel. Clerk Wills asked Mr. Foss about the Playboy channel, questioning if a child can turn it on without parental supervision. Mr. Foss explained that if someone subscribes, yes, a child can turn it on. He noted, however, that there are parental lockout codes that parents can program into the box to prevent this. Clerk Wills restated his opposition to having cable in town with any pornography on it, noting if people want it, let them buy a satellite dish or go rent an XXX movie someplace. He questioned why the company can turn a TV off for nonpayment of a bill, but can't turn off a channel. Mr. Foss said he is not prepared to talk about this matter and suggested the Selectmen should discuss it with counsel. He does not believe a revocation of a cable license fits into the statute or Federal law. It is a pay-per- view channel and an adult has to affirmatively request it. Adult channels are scrambled by video and audio and cannot inadvertently be turned on. Mr. Foss went on to explain that the conversion process lasted six to eight hours, during which all the premium and pay-per-view channels were shut off so nobody could inadvertently get an undesirable channel. He said they can also do "unique" channels. Channel 56 - Inspirational - can be turned off and on. It is on now. It was formerly Channel 3. Selectman Amoruso noted it was also formerly included in Basic-and now it's Basic 3 and you have to pay to get it. Mr. Foss explained that all of the access channels are what they call "unique" channels and he doesn't know what we'd have for our fifth channel if they can even provide it. Mr. Amoruso asked if there's a reason we have to be on Rehoboth's headend instead of Foxboro's. Mr. Foss said it's because Mansfield is in Bristol County. Foxboro's headend is in a different county which is in the Boston DMA. They will be losing the Providence channels. Mr. Foss noted that on January ¡st the Federal Government changed the rules. Broadcast channels were previously put by their area of dominant influence (ADI). Now they have been changed to reflect the Neilsen ratings. Mr. D'Agostino asked if that is why Foxboro and others have been Minutes of June 28, 2000 8 allowed to keep their local access programming channel on 8. Mr. Foss replied in the affirmataive, noting that NECN is mapped out for 8 in Bristol County headends. When asked if any other communities in Bristol County that formerly had channel 8 now have 9, Mr. Foss said he doesn't know. He said the 1992 Cable Act changed the free access to town channels. Now it's required that you must have the Basic tier in order to receive it. They had to make one lowest tier that's unscrambled. When asked why Mansfield lost MS-NBC, Mr. Foss said it's one of the "uniques". Some towns cannot get it and it's supplemented with something else. Town Manager D'Agostino noted MediaOne only has an agreement for Cable TV as part of the original agreement. He suggested that if they are proposing high speed internet access and other services, we'll be very anxious to sit down and craft an agreement with them, or somebody else, to give us a revenue stream because you're on our lines. Mr. Foss responded by stating we will be receiving a certified letter tomorrow to renew the license and he will be the representative. The franchise for a cable system is for a cable system. Telephone is regulated by state law. Cable does not regulate other services. Further discussion followed regarding the packaging of premium channels and signal quality. Mr. Foss explained that once the channels are all rebalanced, which will take about 30 days, the picture quality will be improved tremendously. He noted the total changeover disrupts the system for about nine months. They will be sending out another mailing regarding what will take place July 15th. Selectman Amoruso asked if there will be a charge when people are making the adjustments they want. Mr. Foss said there would be no charge for making the changes within 30 days. Nancielee Boyden, Cable Access Board, stated she wrote a letter to the Board of Selectmen on June 12th. She noted Mr. Foss indicated he let subscribers know about the change, yet her letter came on the 25th with the changes occurring on the 27th. Her box is still out. He's stated he cannot change channel 9 back to 8. If he found himself in violation of license, he should have contacted the Board of Selectmen and let you know he found himself in a compromising position. There are supposed to be 5 channels. The Town now has 4-and this will bring us down to 3. She stated it's not our problem where he can put it and he should be held to the terms of the license. Cable 8 has had their identity for 18 years and was not given sufficient notice to prepare and rebut. She asked what MediaOne will do to compensate them for these changes. She also reviewed other instances whereby they have contacted MediaOne regarding problems, stating there was either no response or inadequate response in each instance. Mr. Foss refuted the accusations, noting he can be reached any time there is a problem. He stated that if there were others they reported problems to, they were not brought to his attention. Minutes of June 28, 2000 9 Mike Healey said he wanted to review what's happened with the channels over the years. Three years ago Mansfield Cable was asked by TimeWarner to give up their channel for TLC and they gave up the channel for that purpose. Then they asked to keep it permanently and offered a list of gifts to replace it. We decided there was substantially more value to the channel than what was being offered and we turned it down. In the meantime, they replaced TLC with a Guide. Now we have lost that also. Reducing the number of channels is unconscionable. We shouldn't be giving them up and they're being almost forcibly taken from the town. Our contract is now less valuable. Now all we're getting is additional channels at additional cost if we want them. Bill Gerber said he is not clear. He's heard that some towns chose one channel versus another and asked for confirmation that every town in Bristol County off the Rehoboth headend has the same channel line up. Mr. Foss stated Towns do not choose where channels go, MediaOne does. North Attleboro and Taunton, also in Bristol County, do not currently have the same channel lineup. They will, however, when they are upgraded and remapped. Further discussion regarding the channel lineup and return of channels followed, with it being noted that further discussion will be necessary to resolve the issues. Amos Robinson returned to the meeting. The Selectmen elected to postpone the review until a time when all members are present and time permits. Town Manager D'Agostino reported on the following: · Live Wire will be featuring the entire Water Dept. with a report detailing the quality of our water, where our wells are located, water quality analysis outline and how to read the report, health and effect of the system based on contaminants, drinking water condition, substances found in tap water and who to contact in the Town of Mansfield. · Brought to the Board's attention a recent article in the paper about the Town of Norton entering into a $4.3 million agreement with Taunton. He noted it Minutes of June 28, 2000 10 indicates that the rate Foxboro was willing to charge us to buy back our capacity was the current going rate and makes it even more important to look at reclaimed water. · August 20-23 NEPA will be hosting their annual conference. Please let Jack Beliveau or Kim Stoyle know of your intentions to attend as soon as possible. Selectman Amoruso noted the Middleboro conference for SRPEDD is at the same time. The Board may need to split up to attend both. · Reported on the auction of the Coral Street property. Bids were opened by Shaun Burke on June 23rd at 10:00 a.m. Bid requirements required the successful bidder to tear down the structure within a specified period of time. Four bids were submitted; one was not opened at the request of the bidder. Christine and Mark Saba of Webb Place, Mansfield bid $102,990. Assessed value is $85,000 which included demolition of the structure. Sam David had two bids. He submitted personally at $82,700. Peter Clarke, 10 Jackson St. Attleboro bid $85,000. He said it is his intent to award the bid to the Sabas for $102,990. pending their ability to secure funding. He said he thinks it was a very good price for the house considering the appraisal on the house and the assessed value. · Saturday he and some members of the Board of Selectmen attended a dedication at the Fire Station and a ground breaking for Plymouth St. fields where the Town of Mansfield has entered a partnership with Mansfield Youth Soccer and North Easton Savings Bank for field space. North Easton Savings Bank has requested from the Town that they be allowed to place a sign indicating their participation in the funding. The sign would be temporary; however, it would be placed on Town property. Town Counsel has advised that as long as the sign is temporary in nature and the Town reserves right to remove it at any time, there is no problem having the sign during the construction phase, with the project due to be completed in 2001. Selectman Amoruso said he wants to give the bank credit for their support and acknowledge it. He is just concerned that there are a large number of people who have made significant donations and we're not acknowledging them. He stated he has some concerns and suggested the Board mull it over. He stated he would Itke to talk with Ed Tartufo who was instrumental in getting the field built and would Itke also to get the opinion of the Recreation Commission before making the decision. Mr. D'Agostino said the town would continue to proceed with a plan to recognize those individuals involved, with the capability of adding others as the project progresses. He added there was also the suggestion that we look at dedicating the Plymouth Street park to the late Dan Clifford, who had much to do with the start up of the park, and renaming it in his memory. He Minutes of June 28, 2000 11 advised the Selectmen their input on this would be important. Selectman Amoruso noted there is no question that Mr. Clifford was leading the charge. He suggested that either the fields themselves, the complex, or the tower could be named after him appropriately. It was noted that Mr. Clifford kept a low profile and the Town has never had the opportunity to acknowledge what he did. Selectman Donovan said he has had a lot of complaints about the price of the new MBT A passes and feels they're taking the brunt of the increase for Commuter Rail. He suggested it would be helpful to write a letter to MBT A. Discussion followed. Selectman Amoruso said he supports Mr. Donovan's suggestion and believes we should also send copies to our state senators and legislators, since they voted to let this increase occur. Motion: To send letter to MBTA regarding the increase in fares and other concerns to that effect. (Donovan-Amoruso) All in favor Passes Clerk Wills asked that we check with Counsel (Bill August on this matter) if we can reject the cable license due to the pornography issue. Town Manager D'Agostino also noted we need to get going with Bill August on the license renewal. Selectman Amoruso said he believes there was some wording about pornography if it does not meet community standards, noting there has been adult programming available on pay-per-view for some time. Mr. Wills suggested we should also send a letter saying we want the other channel back. Selectman Amoruso suggested we should be meeting with Mr. Foss first because he fears MediaOne could be punitive in their actions. Town Manager D'Agostino noted that if we get to the issue of the fifth channel, we need to know what channel they will take away. We don't need to be the bad guy in taking away a popular channel from the residents. Mr. Amoruso noted the contract Nancielee Boyden read from said we cannot change the access channels. A previous board did that by amendment. They simply exchanged one set of numbers for another. They have a great difficulty in that if we want to keep Channel 8, they have to accommodate us. It is worth more to them to make the switch. Mr. Amoruso said he believes they would reimburse Cable Access Corp. for all the changes they have to make. He suggested tonight's discussion was a "wake- up call" to Mr. Foss, noting he has had more than sufficient communication from Cable Access Corp. He suggested it's hard to believe he doesn't realize he's Minutes of June 28, 2000 12 violated the contract by changing channel 8. He knows it's a sore point. He's between a rock and a hard place on the 8/9 problem and it may be worth a considerable amount of money to them. Selectman Robinson noted that when the contract was done, it was done through CVI-and they said they would honor everything that was in contract. Town Manager D'Agostino suggested it might be helpful for us to decide what we should be asking for. Selectman Donovan asked if the Regional Water and Sewer Commissioners Meeting is still the 20th of July. He was advised that it is and will be held in Mansfield. He also noted that at the Dedication on Saturday, Smokey Parker did a great job answering questions and deserves congratulations. Motion: To adjourn at 10:37 p.m. (Donovan-Wills) All in favor Passes CI k's Signature Minutes of June 28, 2000 13
