No certified attendance figures were submitted with the check, as required by the license. Motion: To send the check back because it's not the right amount. If the concert were sold out, there would be 19,900 patrons and there were no certified attendance records submitted. Mr. D'Agostino suggested the seating capacity may not still be 19,900 with the addition of corporate boxes (Wills-Donovan) Mr. Amoruso suggested checking the seating capacity of the Tweeter Center. The maximum number in the license states 19,900. The amount appears to be correct, but there may be a typographical error in their letter. Certified attendance records are still required however. Motion and second withdrawn.. Motion: To hold the check, obtain verification that the fine is based on 19,900 attendance, and request a letter certifying the audited attendance number, to include complimentary tickets, ticket sales, etc., as provided for in the license. (Donovan-Amoruso) All in favor Passes Questions and Comments Ed Bezarro, 44 Smiley Avenue - brought to the Board's attention that the State has entered into an agreement to purchase 5 Aspen Street for the purpose of opening some type of halfway house on the property. They would abut the Woodland Park development with many children under the age of 10, and the residents are concerned for the welfare and safety of their children. They have received a limited response from the Department of Health and request that the Board obtain additional information regarding the type of clientele intended and Board of Selectmen Minutes of September 27, 2000 3 the plans for the property. A petition with the signatures of 44 residents of the neighborhood was presented. Town Manager D'Agostino reported information received from Rep. Barbara Hyland's office. He explained that group homes are prevalent throughout communities in Massachusetts and their ability to purchase such property supercedes any zoning the community might have. Rep. Hyland's office has advised us the proposed use may be a Judge Rotenberg Center Home. This has not been verified. Information is available regarding the types of children who would be participating in the program, along with the features and operation of the program. Selectmen Amoruso noted they have no statutory requirement to notify Town officials of their intent to locate in the Town. Mr. Bezarro asked if there is anything we can do as a community to prevent this home from locating there. It was noted we have no definite information as to what it is going to be. Mr. D'Agostino advised them the best way to find out what is going on is to stay in contact with our State Representatives and Senator. Chairman McCarter asked that we send a letter asking them what it is intended for the property, without taking a position. Mr. D'Agostino emphasized that the Town has little ability to stop this. He read a brief summary of what we received from Rep. Hyland's office regarding the Judge Rotenberg Center. Anthony Odoardi 100 Highland Avenue - spoke of the $294,000 in free cash. He asked about how the article at Town Meeting would be worded, noting he heard it would be for a synthetic field. Chairman McCarter and Town Manager D'Agostino noted it's new revenue and Town Meeting decides how it will be spent. The money is not earmarked for sports or athletic facilities. Mr. D'Agostino further explained the Board's intent and the Town Meeting process. Mr. Odoardi also asked about comments made by Jim Higgins in advocating for additional gym space and disagreed with Selectman Amoruso's comment of the prior week regarding his opinion of sending a letter to the School Committee. Selectman Amoruso noted the Board went along with the suggestion and the approach suggested would have meant the Selectmen would have been meddling in the School Department's business in a way that would have exceeded their authority. Discussion followed as to the intent and opinions of the Board. Town Manager D'Agostino noted he has spoken with School Superintendent Moretti and they have agreed as administrators that this needs to be decided through the School Building Assistance Bureau (SBAB) process to set the tone and direction of the way the community will go. Board of Selectmen Minutes of September 27, 2000 4 Superintendent Moretti spoke of the work of the community fields coalition, noting Mr. Higgins is a member of that coalition. He outlined the process and progress of the coalition to date, with particular reference to the funding process of the SBAB. The fields would be construed as within the scope of the project and would be eligible for 67O¡o reimbursement. The gymnasium would not be. He went on to explain the needs assessment and the fact that reimbursement now starts at 49'Yo with additional points being awarded based on other factors. The regulations will be changing this summer, so unless the money is appropriated, we would not be eligible for 67% reimbursement. Town Manager D'Agostino noted fields could be justified in the needs assessment because we took away fields for parking. It was further explained there first has to be an educational needs hearing, followed by a Town Meeting appropriation for architectural plans, prior to going to the SBAB for consideration. Mr. Odoardi suggested we by-pass SBAB and fund the project ourselves. Superintendent Moretti suggested that discussion of this nature could compromise our position in moving forward with the project. Selectman Donovan asked if there is a problem moving forward with this. Superintendent Moretti said we will have to submit for a project number following a hearing on an educational needs study and an appropriation of funds. All agreed that we need the space, but noted it's a matter of timing and process as to when we're ready to submit to SBAB. Selectmen asked that a meeting be scheduled with the School Committee to discuss this further. Motion: To open the Public Hearing at 8:10 p.m. (Amoruso-Wills) All in favor Passes Clerk Wills reading the notice of public hearing. Assessor Paul Folkman and Assistant Assessor Ed O'Neil requested the hearing be continued to Wednesday, October 18,2000. Motion: To continue to October 18, 2000 at 8:00 p.m. (Amoruso-Wills) All in favor Passes Board of Selectmen Minutes of September 27, 2000 5 Walter Darby and Peter DeTrolio,Jr. were present to be interviewed for the unexpired term as an Associate Member of the Zoning Board of Appeals (ZBA) ending 2003. Cable Access Board of Directors The application of Richard Devine was reviewed for the term ending April 2002 on the Cable Access Board of Directors. Mr. Devine was not present. Selectman Amoruso noted Mr. Devine already serves as Chairman of the Zoning Board of Appeals. He suggested there may be conflicts with being on the two boards. Town Manager D'Agostino noted Mr. Devine is also a producer of programs for the same Board he is applying for. Selectman Amoruso suggested we call Mr. Devine and ask him to come in next week. Motion: To appoint Richard Devine to the Cable Access Board of Directors to fill an unexpired term ending in April of 2002 (Donovan-Wills) Selectman Donovan and Clerk Wills noted Mr. Devine is aware of the work involved and he would not have applied if he felt he could not handle it. 3-2 with Robinson and Amoruso opposed Passes Zoning Board of AlJpeals Associate Member Peter DeTrolio, Jr., of 496 Elm Street noted he has been an associate member and full-time member of the Zoning Board of Appeals (ZBA) in the past. He did not seek reappointment at the expiration of his last term because he had decided to run for and was ultimately elected to the Charter Review Commission. He stated he has also served on the Master Plan Committee and Superintendent Search Committee. He owns a business in Mansfield and has the time to go out and look at all the projects before the ZBA. Mr. Darby of 580 Elm Street noted he's been a resident since 1998 and has never served on a Board. He stated he feels a civic duty to do so. He said he's fair- minded, lives next to a business, and has done work on his house that exposed him to the permitting process. He is a LAN developer for Fidelity Investments, developing server and web applications. Clerk Wills asked Mr. DeTrolio about the statement on his application that we need to acquire more industrial 'and for a tax base. Mr. DeTrolio noted its importance to our tax base. Mr. Darby stated he's been to the recent IDC/Planning Board meetings and said we need more industrial development. He noted he wants to draw more office-type businesses and fewer storage-type facilities. Clerk Wills asked the candidates about building heights. Mr. DeTrolio stated that should stay as they are. Mr. Darby noted the general move is toward more open space and desirable Board of Selectmen Minutes of September 27, 2000 6 firms want to be located on a few floors. His concern with any new development is parking. Chairman McCarter asked Mr. Darby if his preference is the IDC over the Zoning Board of Appeals. He stated at the time of his application he felt the IDC was the place he could contribute the most, but indicated his willingness to serve on either the IDC or ZBA. Mr. DeTrolio's first preference was also listed as the IDC, but he also noted his willingness to be appointed the ZBA. Selectman Amoruso asked the Town Manager what his intent is with the IDC appointment. Mr. D'Agostino noted he has four applicants for the IDC position. Selectman Amoruso brought forth comments heard about the ZBA treating people they know "differently" than those they don't know. Mr. DeTrolio disagreed, noting his belief the ZBA has treated every applicant as fairly as possible. He noted there are some things that come before the Board that affect the Town in a negative manner and the Board may address them aggressively. He does not feel people are treated differently. Mr. Darby said where he is new in Mansfield, that would not be an issue for him. He also pointed out that with a Board rather than an individual, that would not be an issue. Selectman Amoruso spoke of the continuity needed on a Board and asked the candidates if they would, if appointed as an Associate Member, continue serving on the Board. Both candidates indicated their intent to remain in town. Nominations: To nominate Mr. DeTrolio to the ZBA (Clerk Wills) To nominate Mr. Darby (Selectman Amoruso) Vote: In favor of Mr. Darby - Robinson, Amoruso In favor of Mr. Detrolio - Wills, Donovan, McCarter Mr. DeTrolio is appointed as an Associate Member of the Zoning Board of Appeals to fill an unexpired term ending 2003. A check was received for the violation of September 2, 2000. The Board was also advised that a check for the violation of September 11, 2000 would be sent next week. Article 1 - petitioned by Louis Andrews for an independent counsel to aggressively defend the decision of the Mansfield Zoning Board of Appeals against the appeal by Great Waves. Chairman McCarter asked if there should be a dollar amount attached to the article. The Town Manager said we have approximately $20,000 to Board of Selectmen Minutes of September 27, 2000 7 help the ZBA if necessary, but is concerned about the precedent this would set for other developers and the ramifications this might have with the legal agreement we have with Great Waves. Great Waves has filed an appeal in Land Court. We do not know how much it will cost. Mr. D'Agostino noted the Town does not characteristically and never has committed public funds to defend a matter between two private entities. Selectman Amoruso stated it is a petitioned article and he supports it being in the Warrant. He does not, however, think it should be Article 1 and the money should first be put into the Stabilization Fund before considering action on this article. He also noted he is not sure how the Town would determine who gets the money in an appeal and which side we would be supporting. He said it's important to protect Town Boards, but private parties should support and defend their own positions. Chairman McCarter noted it would be a dangerous precedent when the challenge is brought by two private entities and not by the Town. Selectman Robinson said the first item should be the money owed for prior bills, stating that is the purpose of the Special Town Meeting. Town Manager D'Agostino said we have always ordered the articles in such a way to put stabilization first because it abridges the ability for the residents to weigh in on their decisions as to how we spend our money. Putting this article first would affect townspeople's ability to set financial priorities. Clerk Wills noted it's the Town Manager's budget and he cannot support Article 1. He also stated his opinion that putting the article first on the warrant would set a bad tone for the meeting. Chairman McCarter suggested Article 2 to take care of unpaid bills and stabilization should be the first articles. All agreed Article 2 to pay unpaid bills should become Article 1. Selectman Amoruso suggested the Great Waves article follow the financial articles. FinCom Chairman Andres Gazzolo said he would like to have the financial articles first so we can close our budget. The Town Manager suggested prior year's bills first, financial articles next, followed by petitioned articles. Article 2 becomes Article 1 and everything else stays in the same order up to Article 39. The Town Manager gave rough figures for the composition of various portions of the financial articles. Motion: To support Article 2 becoming Article 1, and to keep up to Article 31 in the same order. Article 1 move to Article 30, Article 31 would remain the same. Finance Committee will have recommendations next week. (Robinson-Wills) All in favor Passes School Superintendent John Moretti and School Committee Chairman Jeffrey Sankey were present to discuss the School Department's Town Meeting Warrant Articles. Board of Selectmen Minutes of September 27, 2000 8 Article 15 - $53,500 to fund two school busses. They reduced the number of busses by nine last year. Routes are established by July 15th. Since that time until school began there were over 300 unanticipated pay & ride students. The problem arises at the secondary level because only two students will fit per seat. The secondary limit is 50 per bus. The School Committee supported the addition of one bus in trying to manage the budget in good faith. It became obvious that a second bus is needed because there were still problems on four routes. There still is a net savings of over $200,000 in the operating budget as the result of the cut. Town Manager recommends it be "raised and appropriated" rather than taken from free cash. The Finance Committee will determine where the money will come from if the Board supports the article. Selectman Amoruso asked if the money raised from the pay and ride busses will be supporting these two busses. Mr. Moretti will get the calculations from Linc Lynch. The additional funds for crossing guards are being taken from the Transportation Revolving Account. There were objections to funds being taken from Free Cash for an item that will become a permanent expense. Article 16 - Unanticipated Special Education tuition and transportation expenses These figures represent a worst case scenario if the independent education plans are not approved by parents. The $225,000 increase is to be placed in the Special Education line item and tracked very carefully. If not used, the money would be returned to the Town at the end of the fiscal year. Mr. Gazzolo questioned if we should always budget "worst-case". Mr. Moretti pointed out they are giving actual figures based on projections. Article 17 - Will not cost the Town any money and will bring money into the community. Mr. Moretti noted the need for individual team rooms was not calculated for female athletes. The MBC was approached regarding a change order to address this. In order to do the project, he guaranteed the MBC they would provide the first $75,000 in corporate sponsorship. A corporation donation ofa$120,000 was solicited, with $75,000 going to the MBC project. They also will receive a 40'Yo profit on vending machines. The exclusive contract will be with Pepsi. No carbonated beverages can be dispensed during lunch in accordance with the terms of the contract. The Town Manager mentioned a similar contract for phone service that will be going before Town Meeting. The money is committed to the locker room renovations. The job will be bid separately and not be part of the Callahan project, but will be reimbursed at 67'10. The Town Manager stated he did not feel comfortable signing a change order. He also felt they could get a more competitive price in bidding the job separately. This is a Title 9 gender equity issue. Mr. Gazzolo asked if the extra 40'Yo profit can be used to defray the expenses of the busses. Mr. Moretti said the money has to go back into the food services budget and will offset the cost of lunches over the next three to four Board of Selectmen Minutes of September 27, 2000 9 years. Proceeds go back to various clubs and organizations within the school. Selectman Amoruso asked what happens if this gets voted down. The renovations to the locker rooms will not be done. The question is then if we are in violation of Title 9. Mr. Moretti noted there is still the question as to whether facilities are included in Title 9. They would not make the change order if the question is not passed at Special Town Meeting. Selectman Amoruso stated FinCom should have been involved in those discussions, given the long-range financial impact of the contract. He noted if the project increases by $150,000 FinCom should be aware of it because it increases the Town's exposure over a 20 year period. Mr. D'Agostino said we are looking for credits from Callahan and did not increase the cost of the project. A philosophical discussion ensued as to whether this action skirts the commitment to the five-year budget plan. Mr. Moretti noted it's his responsibility to resolve a situation of inequity. MBC change orders are not subject to the review of the Finance Committee. The Town Manager would not approve a change order unless a guarantee was received to fund it outside of the budget. This gives them flexibility. Mr. Amoruso noted it's money they will be spending and has to be accounted for as part of the total budget. Clerk Wills asked what would be done if they received other corporate finances. Mr. Moretti noted other programs in the schools being funded through corporate sponsorship. Article 18 - Fields Projects Was delayed from the Fall and is reimbursable at 67'Yo. Actual cost to the community will be about $300,000 and the intent is to do it within the budget with a 5-10 year bond. The synthetic field is necessary to preserve the other fields just constructed. This will provide three fields with the field lined for both football and soccer. The new synthetic material does not have the problems of the old material. The land is already there; nobody will be displaced; there will be no interference to anyone. It will be where the track currently is located. The East Street fields are being included in the project and have received SBAB approval because fields were taken for parking in the school expansion. Chairman McCarter asked if Memorial Park is still intended to be used as the game field. Mr. Moretti and Mr. D'Agostino noted the primary fields will be Memorial Park. In the event of inclement weather that will cause damage to the fields, this would give us the flexibility to move the games to another location. The ultimate payback would be $50-$55,000 per year based on a 15 year bond. The new revenue is anticipated to cover this increase. 67'Yo of the $50-55,000 will be offset by the SBAB funding. Mr. Gazzolo said he believes we have more than we can afford in this article. He believes the project is important, but we need to prioritize our projects. Although we are getting more revenue, we are adding to our expenses with other school requests. He suggested supporting this article because of the reimbursement and need, but looking at other school requests and prioritizing them. Board of Selectmen Minutes of September 27, 2000 10 He noted we cannot afford all of them. Mr. D'Agostino noted the upper field is being overused. It used to be the game field and is now used as the game field, practice field, and Midget Football field. The synthetic field will allow us to play 6- 8 games per day without damage to the field. Mr. Sankey noted they have to sponsor the article to get the reimbursement, but it is a community facility and is available to all the residents. School sponsorship enables 67'Yo reimbursement and provides fields for the use of community groups. The girls softball field behind the Middle School was created through corporate sponsorship and is magnificent- perhaps the best field in the Commonwealth. It was done without any cost to the operating budget. Mr. D'Agostino noted the savings that have been garnered through the work of Mike Ahern and the DPW staff. The savings have enabled us to provide recreational and play equipment that is used by the community. Mr. Moretti responded to Mr. Gazzolo's comments about the 5 year projection. All principals have been directed to come in with a O'Yo increase. Personnel makes up 80'Yo of the school budget. Two audits were done over the summer for the School Committee. From the Friday they received the audit and the Tuesday they discussed it, they had two additional long-term illnesses to deal with. They have less than î of 1 'Yo cushion in their budget and would not come to the Town asking for money unless they felt it were necessary. Motion: To sign the Warrant as required for Town Meeting (Amoruso-Robinson) All in favor Passes Motion: To remove what is now numbered Article 23 (Amoruso-Wills) All in favor Passes Selectmen Donovan reported potholes near Sarro's Market on County Street under the bridge. Mr. D'Agostino said he received notification at 4:00 p.m. today from Giles in Congressman McGovern's office that the funds we asked for will be part of an appropriation submitted by McGovern and Frank. The issue of high security fencing is still outstanding, but the additional fencing determined to be needed for Mansfield will be included in the coming fiscal year's budget. Selectman Donovan asked for an update on the recycling center. Mr. D'Agostino said it is part of the range. Selectman Donovan also asked about the compost facility down at the dog pound. It is nearing completion and will be coming in under budget. A number of concessions were received from the contractor, such as Board of Selectmen Minutes of September 27, 2000 11 putting in a new road if we did not hold him to the original completion date. We anticipated it will be completed by November 15th and will be a magnificent state- of-the-art facility. We will be able to sell compost to the market once the project is completed. Clerk Wills asked for an update on the lot next to the Fire Station. Mr. Cook is going to give an order to the owner to cut the grass and remove the car. Clerk Wills suggested the Chief have the men paint the front door at the North Main St. Station. Mr. D'Agostino reported the Pump Station is in place at the Highway Garage. The project will come in under budget by $100-$180,000 thanks to the work done by Mike Ahern and the DPW. There were some problems with ledge. Filters are in place to get the organics out of the water and we will meet the projected completion date. We will now aggressively pursue the bond and get the surety company to move forward with the resurfacing a portion of Route 106. D'Agostino, Town Manager Board of Selectmen Minutes of September 20, 2000 The meeting was called to order at 7:30 p.m., fol/owed by the Pledge of Allegiance to the Flag. Brother Alexis Bugnolo of 62 Pilgrim Road addressed the Board as a member of the Ad Hoc Committee to Review the Cable License. He spoke of the petition on which he obtained 335 signatures of residents opposed to pornography being broadcast and expressed his concern as a private citizen. He asked the Selectmen to sponsor an article at the Special Town Meeting to fund a feasibility study for a municipal cable fiber optic service network and outlined the benefits to the Town and its residents in doing so. He also noted it would be consumer operated and controlled, and therefore more capable of responding to the needs of the Town. Clerk Wills suggested the subject be discussed at the next Light Commissioners meeting rather than bringing it before Special Town Meeting as a warr'ant article. Chairman McCarter noted this topic has been discussed in the past, recalling it was an $8-9 million venture and at that time the Light Department Director wanted to stay in the business of providing electricity. He noted, however, that as Light Commissioners they could use Light Department funds without going for a Town Meeting vote. Brother Alexis Bugnolo said a warrant article would serve as a poll of the citizens, noting the Light Department already has the funds to provide the service. A question was suggested to ask the voters to authorize the Light Commissioners to investigate the feasibility of this. Selectman Amoruso suggested it go to Special Town Meeting as a resolution rather than article, since they already have the authority to do so. Motion: To put forth such a resolution (Donovan-Wills) 4-0-1 with Selectman Robinson abstaining due to his previous employment with the cable company Passes Weekly Business Board of Selectmen Minutes of September 20, 2000 1
