There is a bill from the contractor that Mr. Gaffney is relying on. Town Manager D'Agostino noted that if the meter was installed after the first of the new fiscal year, as the homeowner stated, we could not pay it in this fiscal year. The water, however, was measured as going through the meter. Exhibit 5 (440 School St., 162 Copeland Drive, and 440 School Street) were installed consecutively and are numbered as such. Motion: To have Mr. Bunavicz pay the bill, as it appears to be in order. The $65 meter test fee, interest and penalties are to be waived and he will be responsible for the discounted amount. (Wills-Donovan) Discussion followed regarding comparable water consumption figures during that time. Town Manager D'Agostino noted the policy is clear. If the meter is not measuring improperly, the individual is responsible for paying for what is used. Chairman McCarter said he is willing to give him some benefit of the doubt, but is not certain as to what he should be given as a credit. The Town Manager noted the Board would be setting a dangerous precedent in doing so. Selectman Amoruso said the question is we don't have a reading on the second meter to suggest a similar use of water, noting however, that the new period would be at a time when there is reduced water usage. Selectman Donovan noted the homeowner was adamant that the meter was not installed until July 28th and the bill says it was installed June 1st. It was also noted the meter was tested and found to be 99.5'Yo accurate. Concern was expressed regarding the poor documentation provided for when the meter was installed. It was agreed the water went through the meter and that is how the bill is set. Clerk Wills noted the individual had received only estimated bills for a long time and may have been surprised when he received an actual bill and found out how much water he actually used. (' r Board of Selectmen Minutes of November 8, 2000 4 . . (' Vot~: 3-2 with Amoruso and McCarter opposed Pass~s Boards and Committees: · Letter from Bill Ottaviani resigning from the Conservation Commission due to his current work schedule Motion: Accept resignation with regret and send letter of thanks (Amoruso-Robinson) 5-0 Pass~s Residents: (' · Letter from Steven and Elizabeth Thomas of 946 West Street with petition of neighbors attached requesting sidewalks from the Industrial Park to Tremont Street; children's crosswalk and "walk" light at the bus stop on the corner of Donovan and West Streets; and a 4-way stop sign at the intersection of West and Tremont Streets A study would have to be done through MassHighway for such a signal and money must be appropriated at Town Meeting to do this. Clerk Wil/s suggested the need to reinforce the speed limit in the area and need to budget next year for sidewalks. The Town Manager noted there is a sidewalk betterment policy. A program needs to be established similar to the small sewer extension program. A workshop could be held with DPWand Lee Azinheira to work on this. Selectman Donovan suggested we could put in a crosswalk. The matter wil/ be referred to the Police Department's safety officer for review. Motion: To install a crosswalk with signage if it receives a favorable recommendation from the Police Department and to notify the resident of the Board's action (Donovan-Wills) 5-0 Passes Selectman Amoruso suggested the matter be referred to the Police Department for enforcement purposes in addition to the request for a recommendation Other: (' · Letter from Bruce Montgomery of Tweeter Center requesting a change in their entertainment license to begin the season May 12th in 2001 to allow for the "Tweeter Slam Fest" The Town Manager noted there is a by-law problem with the Zoning Enforcement Officer regarding the sale of merchandise outside the venue that should be addressed. Selectman Amoruso questioned the South Shore Antique Auto Show and what type of license they get that allows the sale of Board of Selectmen Minutes of November 8, 2000 5 , . (' merchandise in the parking lot. The question is whether this should be covered under the entertainment license. Motion: To get an opinion from the Building Inspector and table action on the matter for another week. Approve the date subject to conformity with zoning under the entertainment license (Amoruso-Wills) 5-0 Pass~s (' Gary Forget, 34 Webb Place - presented a concern with one of his water bills. He noted this bill did not have a sewer charge and he asked for it to be recalibrated. When he got the bill back, he was advised they had been reading it wrong for two years and the bill came to $2600-$2700. He paid the bill in order not to forfeit the discount. He stated a precedent was set earlier in this meeting, and he is asking for relief because the Town has not presented an accurate bill with the omission of a zero. He asked for the interest and late payment to be dropped and left the bill with the Town Manager for the Board's review and discussion. All bills had been actual readings and the readings inside and outside correspond. The bills had also been consistent for a number of years. The Town Manager noted this is a different situation and has discussed the issue with Mr. Gaffney. He suggested the Board has it within its power to waive the accumulating late charge and get a written response from Mr. Gaffney. An agreement was reached to pay $250 a month, but it was made clear that interest is accruing. Motion: Hold the interest and late charge until the matter is reviewed (Wills-Donovan) 5-0 Pass~s (' Mr. Hager noted a two-fold purpose for their presence. The first is to ask the Board to vote to allow them to spend an additional $47,576 which was given to Southeastern. This requires a two-thirds vote to allow them to spend it. This does not have any effect on next year's appropriation as it was appropriated by the Commonwealth for additional aid. He reported that half of the amount will go into instructional supplies and the remainder will go into the audit and legal expense line items. There is a second audit dated July 25, 2000. There was some question as to whether we had received this. Three copies were provided by Mr. Hager and additional copies will be made. This was done to look at twenty-three accounts that the district believed they had difficulty with. Motion: To allow them to spend the additional $47,576 (Wills-Donovan) Board of Selectmen Minutes of November 8, 2000 6 r Selectman Amoruso noted his disappointment that the Board has not yet heard from them regarding what is going on. He noted the Town was hit with significant and unanticipated increases and asked what we can expect next year. Mr. Flannery noted the second audit showed where the problems were. They are now going forward to take the necessary actions to correct the problems. Mr. Hager noted the first audit, done by KPMG, reviewed their accounts and identified problems; the new one looks specifically at requested topics. There are discrepancies which need to be addressed and steps have already been taken to improve the situation. It will be a lengthy process they would be glad to discuss after the Board has had the opportunity to review their report. Selectman Amoruso noted we're not notified until after the budget is approved for presentation at Town Meeting and it creates a considerable problem for the Town. Mr. Hager noted he has marked his calendar now to review the budget on November 1st and attempt to predict spikes or reductions in the anticipated budget and related assessment. Mr. Hager noted a proposal has been forwarded to the Town Manager addressing the formula proposed to be used for the assessment. It will not be ready for use this year however. Selectman Donovan noted speaking to parents of children attending the school and (' was assured the students are receiving a good education at Southeastern Regional. Mr. Flannery noted Cable 9 filmed a presentation during their Open House to be shown on cable television. Mr. Flannery referred to policy they are working on and said he would provide the Board with a copy of it. Mr. Hager and Mr. Flannery noted the auditors were on the last year of a three-year contract and they were not entirely happy with them. They are encouraged with the approach of the new audit firm. Selectman Robinson questioned where the money came from to pay for all these audits. r Mr. Hager stated KPMG was a firm that was unable to answer the simplest of questions for him as a new superintendent. He asked "Is Southeastern's financial house in order?" He was assured they were a model. He began to notice business practices that he didn't think were proper and took the initiative to explain issues he had. He began asking questions and finally had to ask specifically whether they had asked if his business manager handles cash. The response was vague. He was advised by a partner of the firm that his firm does not want to go on this search, nor does the school committee want to pay for what they termed a witch hunt. He found it strange that the audit was able to be done without the firm ever coming into the building. He was later advised the firm planned to resign and he contacted Melanson Heath for assistance in a fraud investigation. The School Committee subsequently voted not to accept the resignation of KPMG and they then came in Board of Selectmen Minutes of November 8, 2000 7 {' and did the audit. He noted his questions were never answered and he was told he should trust his employees. KPMG had three recommendations that pointed out issues, after twelve years of "walking on water." He then recommended they needed another firm to come in and audit everything. He has not received comment on if they have proper controls and if things have been accounted for properly. He stated the financial condition of Southeastern is a "fish that stinks from the head down." Roadblocks have been put in front of him continuously and the new report is both scathing and an embarrassment to the School District. He began waging this battle after three months on the job. (' Mr. Hager read from the report in support of his position on the need for internal controls. He noted the majority of the School Committee has been part of the problem and not part of the solution. He will get six copies of the report to the Board tomorrow and will be glad to meet with the Board further to discuss the issues and what he is doing to get their house in order. The books have not been closed this year because there are materially deficient financial statements done by KPMG and the business manager, who has been identified as a problem, and who has been "out sick" since March. The Bristol County District Attorney is investigating the situation. He noted it's been followed closely by the press. The Brockton Enterprise stated editorially that in the end the kids will benefit because the old system is not longer in place. They are doing everything they can to correct their problems. He cannot at this point say that the money given to the district each year has been going to the kids. Selectman Robinson again asked how the audit was paid for if Chapter 7 money was not available. Mr. Hager said it has been paid for. During legal hearings he has both his lawyer and the auditor present. They will be working with them for a couple of years to resolve this. Everything now is on a "pay-as-you-go" basis to correct the bad situation. Mr. Flannery noted the School Committee did not support Mr. Hager's recommendation to get rid of KPMG because they had a three-year contract. He admitted the School Committee made a mistake in this decision. Mr. Hager noted the School Committee was not setting the tone. Credit cards were used to purchase things in New Hampshire. There was $30,000 in petty cash expenditures allowed without receipts. He not only found out things were a mess, but he was not given the support of the School Committee who hired him to do the job. Mr. Hager noted the KPMG audit complied with the legal need for an audit, but did not comply with the requests of the Superintendent or the District. Town Manager (' D'Agostino pointed out airline tickets to Dallas/Forth Worth and Key West, Board of Selectmen Minutes of November 8, 2000 8 (' $521.55 for chicken lobsters, and a number of other irregular activities contained in the credit card activity of the audit report. Selectman Amoruso noted being in situations when auditors have not done their jobs properly and noted it's a value to us to know the matter has been identified and is being addressed. He expressed his concern, however, that they money requested be used to benefit the children. The Board agreed they are heading in the right direction. Vot~: 5-0 Pass~s Ralph Armstead, representing the Town of Easton on the School Committee, addressed the Board and left them information that has been in the paper that bothers him. He noted that as far as the majority of the Board is concerned "Hager is out" according to the news story. The story was chased down and it was found to be accurately stated. Another story indicated "the audit was going to show up as sloppy bookkeeping." He noted he has been chasing this for four years and is embarrassed by this. He further noted Mr. Hager got on top of this as soon as he was hired. He also noted that in his 28 years on the School Committee, this is the first time things have been above board. He also presented pictures of the Florida trip that he termed "sickening". He asked for the Mansfield Selectmen's (' support of Mr. Hager in getting the help and support he needs to get the job done. He pointed out the recommendation on page 19 is that the proper authorities be notified of the misappropriations. Chairman McCarter noted Mr. Hager should be supported in his endeavor and the Southeastern Regional School Committee would be making a mistake in trying to remove him. Mr. Armstead noted there are six of the ten members who want to get rid of Mr. Hager Motion: To send a letter to the School Committee in support of Mr. Hager (Wills-Donovan) 5-0 Pass~s Mr. Azinheira noted the project list was updated as of today and he reviewed the status of the projects as presented in their report, a copy of which is attached to these minutes. Chairman McCarter asked about the durability of the concrete used for the basketball courts. Mr. Azinheira noted they were tension-pressed with cables and posts during the curing process, much like the reinforcement process employed in (' the construction of the concrete slabs used in parking garages. Board of Selectmen Minutes of November 8, 2000 9 r The Hutchason property only has some work left to be done on the walkway, which will go to the new parking lot. We will be able to use the softball field in the spring. It cannot be used until the parking and fencing are complete. Plymouth Street Construction needs some minor hydroseeding that will be done in the next couple of weeks. East Street Fields are at 15'Yo completion. Only the permitting and brush cutting have been done. Chairman McCarter noted the substantial investment made in fields recently and stated he hopes the fields will meet the needs of the community for many years to come. The Town Manager spoke of the responsibility to also maintain what we have. He noted at the Memorial Park game field, that is also used for soccer and practice, we will establish a foundation on the upper field, re-sod it and put in an underground sprinkler system in next year's budget. All the fields are on on-site wells to be used for irrigation purposes. The Highway Garage remediation engineering study was discussed, having reached 40'0 completion. They are working with the Municipal Building Committee on the (' project. The Compost Building is 99'Yo complete and an Open House is scheduled for the public on November 18th. Hamburgers and hot dogs will be served. An invitation will be extended to Norton and Foxboro at tomorrow night's Regional Water and Sewer Committee meeting if the Board so desires. The Open House, however, is being hosted by the Town of Mansfield. The 2-Way Radio System is 95'Yo complete, with only some punch list items left to be completed. It is a radio system shared by all departments within town and is housed in the small building obtained from the Cable company. The Gas cut-off wall at the Landfill is also 95'Yo complete, with 350 feet complete and about 60 feet left to go. A trench is dug down to the water table, which is about 22 feet deep. 20 mil plastic is dropped into the trench to create an impermeable barrier, then filled with stone and capped with soil. There are traps and ventilation to handle the methane. It is required by DEP and was inspected yesterday. The original estimate was $150,000 to $200,000. Because the work is being done internally, we budgeted $100,000 and it is expected we will stay well within budget. {' Board of Selectmen Minutes of November 8, 2000 10 r The Route 106 sewer pump station is 100'Yo complete. They will begin testing the integrity of the pump station the beginning of December and it is anticipated that it will be operational shortly after that. This has been a high priority because the line cannot be activated until the pump station is operational. This project has also been done in-house and will be completed well within budget. The Walsh Well bridge replacement is complete and allows for a machine to be driven over it. This will allow us to complete the work needed on the other side of the bridge. The old bridge has been retained to be used if needed in another project of similar size. It is suitable as a pedestrian bridge, but is not of sufficient weight-bearing capacity to support motor vehicles. The Highway Garage remediation and new tanks will continue after we are sure the leaks have been stopped. The Hope Street parking lot is 65'Yo complete. Funds were appropriated at the recent Special Town Meeting and the intent is to get it into sufficient shape to allow people to park there for the Thanksgiving Day game. Clerk Wills noted walking the lot and speaking to neighbors who complimented Mike Ahern on the work he's doing. He also asked about the electrical work and how it is being (' accomplished. Substantial savings were realized with our Highway Department doing much of the work. The men were trained during the installation of the sod at Memorial Park and were able to do the work themselves in installing the sod at Plymouth Street. Chairman McCarter noted seeing many new signs around town. The Town Manager spoke of a new policy instituted regarding the replacement of signs. He also discussed the amount of savings realized by the reorganization of the department in time, materials and funds by doing the work through our Special Projects division. Mr. Azinheira noted such information is being kept and will be presented in final form at a later date. Comparisons will also be presented on what the various projects would have cost had they been put out to bid. The Town Manager reported on the following: {' . The Time Capsule Committee is approaching their November 15th deadline for the submission of items for the time capsule. It will provide residents in 2100 with a picture of life in Mansfield today. They are also looking for nominations with a biographical sketches and pictures of the 100 most notable characters in the Town. He noted Eagle Scout candidate John Cuneo Board of Selectmen Minutes of November 8, 2000 11 r is working hard on the project and is doing an excellent job. He also noted the generosity of businesses in town providing time and materials. · A status report on the Route 106 project was provided by Town Engineer John Sullivan and has been included in the Selectmen's folders for their review. · Route 106 has been repaved and we're well on our way to getting it repaired satisfactorily. Funding is expected for Route 106 within the next 2-3 years and with the completion of the 25'Yo design phase, which has now been authorized, it will make it to the Transportation Improvement Projects (TIP) list. Sidewalks and the installation of a traffic light at the Flint Farm intersection are being discussed, as is the Route 106 underpass at the Train Station. It will be phased in so we can become eligible sooner for more funds in the TIP. Clerk Wills spoke anecdotally about going through the river beneath Route 106 with his friends as a child. (' · Part 3 of a Cable Show was taped today dealing with the tax rate and future values. Ed O'Neil and Gale Farrugia were on the show to discuss the new circuit breaker law that allows for additional tax breaks to seniors. The new law captures most seniors in Mansfield, with homes being up to the $400,000 range and income levels to $40,000. He noted his intent to enable seniors to stay in their homes and not sell them to younger families with children, producing an increased burden to the school system. · The Train Station update occurred on Friday with a discussion with Rep. Barney Frank. The third track situation was presented for the first time at this meeting. We do not know if the third track will become a reality, but we need to know if the plans we have for the Train Station incorporate the third track so we're not spending money to do the project twice. The drawings indicate the proposed third track will be on the other side of the Train Station, so it may be possible that Phase 1 of the project may be able to proceed. Clerk Wills questioned the proposed raising of the platform and the need to have that information before the construction of the station. Selectman Robinson spoke of the use of the third track in other areas to get the slow train out of the way of the fast train and suggested that is probably what is being proposed. The Town Manager noted the charge given Rep. Frank is to get that information. Selectman Amoruso said we wil/ be getting all the fencing we were promised and a letter w/Ï/ be forthcoming detailing that. It is the high security fencing that is not being provided (' Board of Selectmen Minutes of November 8, 2000 12 (' · An update was given on the Hercules Dump Site. A meeting was held last week with the Center of Disease Control (CDC) and the cost of properly capping the site to today's standards was estimated. There is a concern about signing the plan without a written commitment from Hercules regarding their ability to pay. At this point they have only agreed to be a partner in the capping. Hercules is a $3.2 billion company, with half of their earnings as profit. He believes they have the ability to clean it up. They have a history of getting unknowing parties involved in the ownership of their properties when they have no further use for their sites. In the 1960's we were not aware of the risk associated with owning such properties. · Clerk Wills: Motion: That all liquor violations come to this Board first and to direct the Town Manager to prepare a policy to cover the Board's intent (Wills-Donovan) (' Town Manager D'Agostino noted he will be speaking with Town Counsel on the issue tomorrow. It was noted this policy would cover locally initiated investigations and not investigations initiated by the ABCC. Chairman McCarter discussed further the intent of Clerk Wills' motion to clarify the matter. It was noted the intention of the motion is to have the Town Manager bring forth a policy to cover the situation, which will then be reviewed and voted by the Board. The adoption of such a policy will be discussed with Attorney Mangiaratti. Vot~: 5-0 Pass~s · Clerk Wills thanked the Town Manager for providing him with all the fee information, noting the only information not received was that of the Police Department. The Town Manager advised him the Chief is at a conference in San Diego and will get the information to the Board when he returns. · Selectman Donovan asked what happened to the presentation by the Postmaster. It wi'll be rescheduled. {' · He noted concern about the leaves being left at the compost facility in black plastic bags. It was suggested a sign would be appropriate to notify residents that plastic bags are not allowed. Someone is assigned to opening the bags and dumping the leaves. Board of Selectmen Minutes of November 8, 2000 13 " . (' · Selectman Robinson asked if there has been any word from Russ Hall. Town Manager D'Agostino noted they are playing telephone tag and will be meeting soon. · Selectman Robinson asked if the appropriate individual in the Police Department could come up with some type of sign for East and Pratt Streets to assist in pedestrian crossings. He noted there is a crosswalk, but additional signage appears to be needed. (' · Chairman McCarter advised the Board of requests from candidates for reappointment to Boards and Committees to not have to come in for interviews. He asked for the Board's input. Selectman Amoruso said he liked having people come in so people can get to know the person being appointed. He also noted concern about the lack of applicants, stating appointing everyone who applies does not always get the Town the best boards. He suggested there are instances where the applicants are all nice people, but if they have no financial background it is difficult to appoint them to the Finance Committee. Clerk Wills noted all committees at some time are in the spotlight and should not object to being at televised meetings. The consensus of the Board was that it is their strong opinion applicants should come for interviews, although they will still be considered if they chose not to do so. It was also decided to spread the interviews over multiple meetings. Residents were encouraged to apply, noting many boards and committees have more than one opening. · Chairman McCarter asked for an update on the sign for Mansfield England Motion: To adjourn at 10:50 p.m. (Wills-Donovan) 5-0 Pass~s (' Board of Selectmen Minutes of November 8, 2000 14 " - ~.
