To see if the Town will vote to raise and appropriate, borrow or transfer from available

EXPLANATION: The Highway Garage does not have a bathroom with showers and
locker room for personnel who often work on sewer lines. This would add a temporary
addition to square off the back eastern corner of the facility. It includes a bathroom,

ARTICLE 10
To see if the Town will vote to transfer the sum of $534,900, received from Fairfield
Development in accordance with the Court Settlement Agreement, dated 3/21/06 for
mitigation costs associated with the School Street Sewer Project, from Free Cash to the
School Street Sewer Account 30 -440K -5800, or take any action in relation thereto.
EXPLANATION: An amount of $534,900 was paid by Fairfield Development in
February 2007, in accordance with the Court Settlement Agreement with the Town of
Mansfield dated 3/21 /06. This was a portion of the $734,900 specifically stated in that
Agreement for Phase III School Street Sewer Interceptor. Also, upon sale of an existing
home on the property, the first $200,000 of that sale will also be paid to the Town. Even
though the Court Settlement states this money is for the School Street Sewer, due to
accounting procedures, it had to be placed in the General Fund and could not be voted out
until it became certified as Free Cash.
The design of a 24 -inch diameter School Street Sewer Interceptor into the Cabot Business
Park was completed in 2001, in accordance with the Town's 1976 Sewer Master Plan, to
eliminate the "temporary" Plymouth Street Pump Station built in the early 1980's, which
pumps up to an older "temporary" Hampden Road Pump Station built in the 1970's,
which in turn pumps up to West Street. Approval of this article will allow the project to
proceed, which will eliminate the "temporary" Plymouth Street pump station built in the
1970's, which is in need of major repair. It will also reduce sewer flows in the West
Street sewer system.

To see if the Town will vote to raise and appropriate, borrow or transfer from available
funds $2,100,000 for construction of the School Street Sewer Interceptor extension into
the Industrial Park to eliminate the "temporary" Plymouth Street Pump Station, or take
any action thereto.
EXPLANATION: Permitting and construction bidding of this project was authorized
by Article 20 of the 2006 Fall Town Meeting; and actual construction bids are available
for this Town Meeting. The above sum would be reduced to $1,240,000 if all other
companion articles regarding transfers and borrowing of funds are passed.
The design of a 24 -inch diameter School Street Sewer Interceptor was completed from
Spring Street into the Industrial Park in 2001, in accordance with the Town's 1976 sewer
master plan, to eliminate the "temporary" Plymouth Street sewer pump station built in the
early 1980's. Mansfield Crossing has constructed a portion of this interceptor from
Spring Street to Old School Street. Construction of the remainder of this gravity sewer
line would eliminate the Plymouth Street pump station and the major repairs required to
it.

To see if the Town will authorize a temporary borrowing of $200,000 for the School

Development has agreed to pay for the Phase III portion of the School Street Sewer
Interceptor in a Court Settlement Agreement, dated 3/21/06, and which is due upon sale
of an existing house on the property, or take any action in relation thereto.
EXPLANATION: The Town's Court Settlement Agreement with Fairfield
Development requires Fairfield to pay $734,900, specifically for the Phase III portion of
the School Street Sewer Interceptor. Payment of $534,900 has already been received,
with $200,000 more due upon the sale of the existing house on the property. Approval of

EXPLANATION: An amount of $75,000 was agreed to be paid by Fairfield
Development on 8/24/07 for use of an abandoned Town water line for their sewer force
main, which had previously been accepted by the Selectmen on 10/25/06. This payment

To see if the Town will vote to authorize the Selectmen to discontinue Old School Street
from the north side of Route 495 to the Right of Way (R.O.W.) of School Street, with an
area of approximately 32,000 S.F., and as shown on the MassHighway, Route 495
Mansfield Layout Plans, Layout No. 6310, Dated 3/22/1978, Sheet 3 of 23, provided that
the Selectmen enter into an agreement with interested parties regarding this
discontinuance that maintains a 3Oft wide sewer easement running within the present Old

approximately 19,500 S.F., and that the Town receives no less than the net appraised
value of the land, or take any action thereto.
EXPLANATION: The various property owners, across from the Mansfield Crossing
mall on School Street, are proposing additional development. Discontinuing this portion
of Old School Street could minimize traffic confusion in the area of the mall, facilitate
discussions among affected property owners for lessening the impact on School Street,
and provide additional funding toward completion of the School Street Sewer Interceptor

This is to certify that the following is a vote taken at the October 30, 2007 session of the
October 23, 2007 Special Town Meeting. Said meeting was held at the Mansfield High
School Auditorium, East Street, Mansfield, Massachusetts. There was a quorum present
and voting.
ARTICLE 18
To see if the Town will vote to transfer from Sewer Enterprise Retained Earnings the
unexpended FY2007 amount of $77,932.51 for sewer Inflow and Infiltration, to the
Engineering I &I Capital account for the repair of the Town sewer system, or take any
action in relation thereto.
EXPLANATION: The DPW Sewer Enterprise account had an unexpended FY2007
amount that was intended for the on -going repair of the Town's sewer system to
eliminate Inflow and Infiltration, which is now a part of free cash. As experienced in the
past during our major I &I repair program, the Town has been able to get more sewer
lines and sewer manholes repaired at a lower unit cost, when larger amounts of work are
bid, due to economies of scale. This transfer allows the money to accumulate in a capital
account beyond the fiscal year, so that these economies of scale can be realized.
SPONSOR: Board of Selectmen

Move the Town vote to transfer from Sewer Enterprise Retained Earnings the

To see if the Town will vote to raise and appropriate, borrow or transfer from available
funds the sum of One Hundred and Seventy -Two Thousand Dollars ($172,000) to
purchase four additional marked police cruisers, or take any action in relation thereto.
EXPLANATION: Growth of department necessitates adding to police patrol fleet.
These cars need to be equipped from the ground up — protective equipment (screens,
etc.), video recorders, computers as well as emergency lights and sirens. The addition of
these vehicles to the fleet will spread the use of the fleet over more vehicles thus
maintaining the useful life span of our patrol vehicles.
