5. Partial Request for Certificate of Compliance (PCOC), John Campbell, Trustee of the Campbell
Family Trust, 631 East St, Heron Crest Condominium, DEP SE 211-697 (Map 33 Parcel 20-22)
request a partial Certificate of Compliance for Unit B-102 in Heron Crest Condominiums. The
Order was issue in 2004. The work has been completed and the Order has expired. This request
only pertains to one unit.
Ms. Gonyer explained that this was a common administrative filing that has been addressed in
the past. The Order of Condition (DEP SE 211- 697) was for the construction of the entire Heron
Crest Condominium site in 2004. Only a portion of the work was within conservation
jurisdiction; however, the Order was recorded against the whole lot. Now, the individual unit
owners are having complications with this expired outstanding Order as it is recorded as an
encumbrance on all unit deeds on the property. This expired outstanding Order will remain until
the owner/manager of the entire property files a full certificate and each unit owner will need
to apply for a Partial Certification of Compliance. Unit B-102 is not within wetland jurisdiction
and she recommended issuing a Partial Certificate of Compliance.
Motion: To issue a Partial Certificate of Compliance to John Campbell, Trustee of the Campbell
Family Trust, 631 East St, Heron Crest Condominium, DEP SE 211-697 (Map 33 Parcel 20-22)
request a partial Certificate of Compliance for Unit B-102 in Heron Crest Condominiums.
Passes: 5/0 (MacDonald/O'Hara)
6. Request for Certificate of Compliance (RCOC) SE 211-1019, David Oberlander, 33 Azalea Rd
(Map 36 Parcels 109,110, 113, 21) for the construction new single-family dwelling, surface
disposal system, driveway and grading. The Order was issued on 4/28/25 and the work has been
completed.
Ms. Gonyer told the Commission that we had issued an Order of Conditions for the construction
of a single-family dwelling, septic system and re -grading in April 2025. She noted that this was a
tight lot but it was constructed very well given the size constraints and the proximity to the
resource area. Ms. Gonyer visited the site and the final construction matched the As -Built and
Plan of Record that the Engineer, Mr. Oberland had submitted. She also confirmed that all areas
were stabilized and that the site was constructed per the Order and Plan of Record.
Motion: To issue a full Certificate of Compliance to David Oberlander, 33 Azalea Rd (Map 36
Parcels 109,110, 113, 21) for the construction new single-family dwelling, surface disposal
system, driveway and grading with 100 feet of a Bordering Vegetated Wetland.
Passes: 5/0 (Roth/MacDonald)
7. Request for Certificate of Compliance (RCOC) SE 211-0779, 778 Ware St (Map 35 Parcel 40)
Order for the construction of an addition, deck, garage and expansion of existing driveway
within the 200-Riverfront Area was issued in 2006. This Order has since expired.
Ms. Gonyer told the Commission a Certificate of Compliance was never requested by the
previous owners back in 2006 based off of the original SE 211-0779 Order of Conditions. The
addition and the deck proposed on the west side was never completed for SE 211-0779 .
However, the garage and driveway were within compliance with the original plan. The original
representative sent an As -Built and provided a letter from the original surveyor confirming that
the project was completed in compliance with the Plan of Record. All disturbed areas have since

in January at the Public Safety building.
Mr. Healey informed the Commission that these presentations are
wonderful but these projects can also put a strain on the department
resources. This and the amount of all the research for all the hearings has
increased as well putting more of a strain on our resources and staffing
concerns.
Fee Schedule
Ms. Gonyer will update after May 2026 Town Meeting and share with
the Commission for their review after June 2026.
