Main St. Mansfield, MA (Map 16 Parcel 13) forthe relocation of fill from adjacent property to be partially spread within 100 feet of the inland bank of Norton Reservoir. This application is to be withdrawn by the applicant. Ms. Gonyer explained the background of the project which started with a construction site in Norton(on Townline) with an excess of excavated soil that they wanted to redistribute the abutting Mansfield property, 900 S Main St. When they originally filed for the RDA, the consultants did not realize that the area they wished to regrade was within the 100-year FEMA flood zone was there so the proposed plan was not feasible. Per Ms. Gonyer's direction, the fill was pulled out of the flood zone and regraded around the bulding and towards the street. Any excess fill was then to be removed from the site .The work completed outside of the Area Subject to Flooding. She stated that shepermitted the work through an Administrative Review then recommended to have this RDA application withdrawn as the work was exempt under the state and local regulations. Motion: To make a motion to withdraw the pending Request for Determination for Applicability for International Brotherhood of Electrical Workers (IBEW) Local 104, 900 S. Main St. Mansfield, MA. Ms. Gonyer explained that Mr. Kelley received a Determination of Applicability from the Commission back in 2023 f for tree removal within his existing lawn area . He was back today to permit rock removal and to regrade the same area cleared of trees in 2023 to match the existing level of the lawn. Mr. Roth asked where the rocks were going to go and Mr. Kelley explained they were going to dig a hole and put the majority of the rocks in the hole. Mr. Healey mentioned that you never know what you are going to find when you dig a hole per the previous builders and to make sure that any debris including construction materials, stump dumps, etc be removed . Ms. Gonyer asked Mr. Kelley to reach out to her if he needed to discuss any debris with her. Motion: To issue a Negative Determination of Applicability, # 3 (work will not adversely impact a resource area) to Brian Kelley, 27 Smith Rd Mansfield, Massachusetts (Map 9 Parcel 90) for the proposed removal of rocks and regrading of a portion of the rear lawn located within 100 feet of a Bordering Vegetated Wetland with the following Special Conditions: (2-6,8-13, 17, 24, 25). 2.PLAN OF RECORD 11.WETLAND FLAGGING 3.LIMIT OF WORK 12.000 WITH AS -BUILT. 4.ADDITIONAL MITIGATION 13.13EVISIONS TO BE REVIEWED Conservation Commission Meeting Minutes 9.29.2025 Page 2 of 4 S.STABILIZATION 17.NO SYNTHETIC CHEMICALS 6.ROOF RUNOFF 24.13UMPING OF LAWN CLIPPINGS IS &.START WORK NOTIFICATION PROHIBITED 9.PRE-CONSTRUCTION MEETING 25.KNOTWEED POST -CONSTRUCTION 10.PERMIT ON -SITE MANAGEMENT PLAN Additional Special Conditions: Once loam is spread, Agent must inspect final grade before seeding Passes: 5/0 (Hedlund/MacDonald) 5.
