As Ms. Pruitt was absent, lie then asked the Board to make motions to appoint an Acting Chair and an Acting Clerk. Motion by Mr. O'Malley and seconded by Mr. Correira to appoint Mr. List as Acting Chair and Mr. Correira as Acting Clerk. Vote: 4-0-0 [Aye 4, Nay 0, Abstain 0] PASSED Mr. List appointed Mr. McGarry as a voting member for the hearings. Regarding the application of Peter Souza for a Finding from Section 230-4.2(A) that the lot width at 100 feet back from the street will increase from 89.0 feet to 94.5 feet which does not make the existing single-family dwelling more non -conforming at 272 Pratt St. The Property is owned by Peter J. Souza and Beth Acme Souza, and located on Assessor's Map/Parcel 030/419 in the Residential 2 (R2) Zone. Peter Souza and Craig Cygawnoski, RIM Engineering, were present. Mr. Cygawnoski, representing the applicant, explained that the house at 272 Pratt Street was constructed in 1920 and originally owned by Mr. Sousa's family. The adjacent property at 266 Pratt Street was built in 1962 after the family subdivided the land. At the time, the lot lines were drawn irregularly to acconmiodate animal pens that existed on the property. The applicant now seeks to adjust the lot line between the two parcels to align with existing landscaping and simplify the division between the homes. ZBA Meeting Minutes 10/21/25 Page 1 of 3 The proposed change would not alter the existing frontage, which remains 130.5 feet for Lot 1 and 100 feet for Lot 2. The modification would increase the lot width at 100 feet back from the street on Lot 2 (272 Pratt Street) from 89 feet to 94.5 feet, slightly reducing an existing nonconformity. Both lots exceed the 30,000 square foot minimum lot area requirement, each containing over 39,000 square feet, and the proposed side yard setback of 18.6 feet meets the minimum requirement for the R-2 zone. The adjustment primarily serves to preserve existing landscaping features while ensuring that fi ture property conveyance will not include encroachments. Motion by Mr. Corfeira and seconded by Mr. O'Malley to close the public hearing. Vote: 5-0-0 [Aye 5, Nay 0, Abstain 0] PASSED Motion by Mr. Correira and seconded by Mr. O'Malley that the ZBA approve the requested Finding under MGL c.40A §6 for 272 Pratt Street, allowing the proposed lot line modification as shown on the submitted plan, because it (a) creates no new nonconformities, (b) does not increase the degree of existing nonconformities, and (c) slightly reduces one nonconformity (lot width) with the following condition: • Prior to recording this ZBA Decision, obtain Form A (ANR) endorsement from the Planning Board for the noted boundary line adjustment, and record the endorsed plan and ZBA decision at the Registry of Deeds. The Board determined that the change creates no new nonconformities, does not increase the degree of existing nonconformities, and slightly reduces one. Vote: 5-0-0 [Aye 5, Nay 0, Abstain 0] PASSED Regarding the appeal of Attorney Kevin S. Freytag on behalf of James N. White, Kirsten Murawski, Nicole Mullen, Nirav Desai, and David S. Haring, of the Building Inspector's grant of a building permit in connection with the construction of a 16,800 square foot facility with thirty-two (32) parking spaces at 19 Knight Way. The property is owned by FOD, LLC and located on Assessor's Map/Parcel 003/051 in the Residential 1 (RI) Zone. Mr. Valanzola recused himself. Ms. Raposa informed the Board that the applicant requested through Town Counsel to continue the hearing. This is the third continuance for the matter, each made at the request of the applicant. Members expressed concern that repeated continuances delay resolution and create uncertainty for both the property owner and the public. It was noted that while the property owner has continued construction at their own risk, the ongoing continuances extend the period of appeal beyond what is typically intended under Chapter 40A. The Board agreed that no further continuances should be granted without the requesting party appearing in person to explain the reason for the request. ZBA Meeting Minutes /O/5 Page 2 of 3 Motion by Correira to continue the hearing provided that the applicant appears at the next hearing and that no further continuances be granted. Mr. McGarry agreed that the applicant should appear in person for any future continuance requests but added that the Board should allow flexibility if legitimate legal circumstances justify another continuance. Mr. Correira withdrew the motion. Motion by Mr. Correira and seconded by Mr. McGarry to continue the hearing, provided that going forward, there will be no further continuances granted without first having the parties appear in person. Vote: 4-0-0 [Aye 4, Nay 0, Abstain 0] PASSED Minutes — September 16, 2025 Motion by Mr. McGarry and seconded by Mr. O'Malley to approve the minutes as submitted.
