Mr. Haworth provided a brief sununary of his work and personal experience. Ms. Friedman also noted that there is one other new member, Ryan Maxwell, and that Ms. Allam was moved to full member status, both will be the next meeting. There is still an associate member vacancy. Ms. Friedman asked for a motion to appoint an acting clerk for the meeting. Motion by Mr. McClanahan and seconded by Mr. Penney to nominate Mr. Cerretani as acting Clerk. Four (4) in favor, Zero (0) opposed, Zero (0) abstained PASSES Mr. Penney asked why zoning amendments were being submitted for fall town meeting when typically, they would be at the annual town meeting. Ms. Raposa replied that it had been a request of the Town Manager to not submit amendments at the annual town meeting since there are ongoing financial issues, and to target the fall meeting for zoning amendments. Discussions continued for the following proposed zoning bylaw amendments. V30-4.7 - Special Permit to the sign bow Ms. Raposa said that this would create a new special permit process to enable the ZBA to grant certain deviations from the strict compliance with the sign code. This is similar to past discussions where it creates a more justifiable deviation from the requirements when a variance is the only avenue. However, relief for signage does not typically qualify for a variance under Planning Board Meeting Minutes 06-25-25 Page 1 of 5 the strict criteria found in MGL Chapter 40A Section 10. The special permit creates a more viable legal avenue for the ZBA to grant a deviation for signage. The draft language was in the packet presented to the Board. This would be on a case -by -case basis per the proposal presented. Ms. Raposa read the draft language. The Board agreed to move forward with this bylaw. V30-xx - Firearms Businesses Special Permit Ms. Friedman said that more research is required and recommended that the Board not move forward at this time. The Board agreed not to move forward with this bylaw. §230-4.4 - Off -Street Parking and Loading Ms. Raposa noted that this was flagged by the Town Engineer as something that needed to be updated. In previous discussions, the Board felt that a 25-year storm was adequate for the sizing of drainage where the zoning bylaw is fairly specific for commercial parking lot materials. The Town Engineer recommended that the 100-year storm be in the bylaw. Ms. Raposa said that she does not have supplemental information from the Town Engineer at this time. A discussion ensued relating to pavement thickness and current regulations, which needs to be updated. Ms. Raposa will reach out to the Town Engineer for his opinion relating to road binder and paving thickness. The Board agreed to move forward with this bylaw. V30-5.5 - Special Permits Submission Requirements Ms. Raposa recommended this be deleted from the bylaw in its entirety. It is a checklist of what to submit to the Board which is now written into the adopted Rules and Regulations document, so it is no longer needed in the bylaw. The Board agreed to move forward with this bylaw change. §230-5.5H - Moratorium on the construction and siting of resource recovery system (housekeeping) Ms. Raposa said the moratorium was passed in 1989, expired in 1991, and has been living in zoning bylaw needlessly. The Board agreed to strike it from the zoning bylaw. §230-4.2C - Scheduled rate of development (housekeeping) This is another moratorium that was adopted in 1997 and expired in 2007. It is no longer in effect. The Board agreed to strike it from the zoning bylaw. V30-3.30) - Residential facilities for residents 55 years of age or older Ms. Raposa said was related to the parking requirements. The previous zoning subcommittee working group had flagged this item for future consideration to reduce parking space requirements. Mr. Haworth asked if the Board or Town would have an appetite for a more aggressive approach. He referenced other states that have banned parking restrictions. A discussion ensued. The Board agreed that the current recommended reduction from 2 to 1.5 spaces would be best at this time. The Board agreed to move forward with this item. Planning Board Meeting Minutes 06-25-25 Page 2 of 5 § 230-5.4 - Floodplain District (housekeeping) This bylaw is based on requirements to enable the Town to continue to participate in flood insurance requirements. The bylaw would be amended based on a review of the current bylaw by the Department of Conservation and Recreation (DCR), which would then provide a spreadsheet of required changes to align with state requirements. The Board agreed to move forward with this item. 230-2.2G - MSROD Map Reference This is to update the Phase Two map reference to fix technical error. The map was originally adopted June 15, 2023 and revised April 16, 2024. The Board agreed to move forward with this item. §230-3.4. - School Bus Parking Ms. Raposa referenced a previous discussion about school bus parking. The current requirement for conunercial parking is primarily in the business district. Therefore, some of the underutilized industrial parking lots would not qualify. There are also a few residential areas to consider, but they do not currently qualify. She asked for Board feedback to create a new classification for school bus parking, as opposed to commercial, and make it allowable by special permit issued by the Planning Board with conditions. This could also be complicated because school bus parking could be considered a Dover Amendment exempt use, but the laws are not clear. The parking would be for about 20-30 buses and for a driver training area. The bus company for Mansfield currently leases space in Foxboro, which is inconvenient. Mr. Cerretani noted that by not allowing the buses to be housed in Mansfield, the Town is losing out on excise tax. Ms. Friedman noted that, as previously discussed, paving of the lot could be relevant for housing buses, training, and maintenance. Consideration for vehicle washing and drainage may also need to be considered. Ms. Friedman recommended removing residential districts from the bylaw. Ms. Raposa asked if there could be consideration for some residential land that is currently vacant and would not have an impact on house buses. Ms. Friedman was still opposed to residential areas being used. Ms. Raposa said that by special permit, each application would be considered on a case -by -case basis. Discussion ensued on existing vacant residential land considerations. There are potential residential zoned areas that could be suitable for this use. The Board agreed to further discussion before deciding to move forward with the bylaw change. Mr. Haworth said this would not be a by -right use and expressed that he did not feel the Town should be restrictive to some viable residential options. § 230-3.4N(9) - Host Conununity Agreements - Impact Fees? The Board agreed to strike the section regarding impact fees, as they are no longer collected due to changes in the laws. Ms. Raposa explained that impact fees associated with Host Conununity Agreements (HCAs) had been deemed unlawful due to changes in state law and litigation outcomes. Therefore, Mansfield no longer collects those fees. A Board member asked whether there are other types of fees still being collected by the Town under HCAs. Planning Board Meeting Minutes 06-25-25 Page 3 of 5 Ms. Raposa responded that she would follow up to confirm what fees, if any, the Town still collects related to cannabis businesses. 230-5.12H(1)- MSROD Site Plan ADoroval Reference This item coffects a citation to the 2022 site plan approval language. The Board agreed it is a housekeeping item. & 230-xx - New B5 District (School Street) The Board discussed revisiting the failed citizen petition to rezone parcels at School Street and Route 140 to a new B5 District. Discussion included traffic, neighborhood context, and business needs. Ms. Raposa will review previous correspondence. The Board agreed to continue the discussion and explore sponsorship of the zoning change. 230-5.13 - 40Y Multi -generational overlay district Ms. Raposa introduced a placelnolder for a new 40Y Overlay District. Two Gilbert Street parcels were discussed as potential sites. The Board agreed to track the progress of discussions with the Select Board (SB meeting 7/30) and continue refining language with housing consultants and state guidance. North Main Street Business Overlay District Ms. Raposa asked if the Board wanted to add "live/work" units to this district. The MSROD allows such use. Mr. Penney and Mr. Cerretani were not in favor. Ms. Friedman requested more information. Concern of Residential Property Owner: Issues with Safe Sight Distances The Board discussed the idea of creating a general bylaw (not zoning) to address existing visibility issues at driveways and intersections. Ms. Raposa will consult with Officer Kinahan and report back.
