MA (Map 33,',Parcel 53) forthe construction of a deck, an addition and a pool associated with a single-family home
within 100-foot buffer of a Bordering Vegetated Wetland (BVW).
Ms. Gonyer stated that wetlands comes close to the flat yard. She talked about the bushes close to the house
that need to be removed due to the house addition however she felt that the trees could stay. Mr Trowbridge
stated that the land was very flat and they would not need to regrade. He then mentioned the RDA also had a
pool in it as his client did not want to have to go through the whole process again. Therefore, they included a
pool within the design plans and when it comes time to build it, they would meet with Ms. Gonyer first for her
review and approval. Ms. Gonyer stated that she had no issues with the addition or the deck. Mr. Roth
questioned If they were; approving the project without the pool? Ms. Gonyer stated that when they want to do
the pool they need to submit new detailed plans which could be done with a change in plans on these current
plans or they can file a new RDA for the pool when the time comes',

4. Request to Amend Order of Conditions (AOOC), issued on 11/02/23 (DEP SE 211-1007) to Keith Signorelli, 889
Maple Street, for the removal of an existing home and the construction of a single, -family home with associated
grading and utilities within 100-feet of a Bordering Vegetated Wetland and the 200-foot Riverfront Area. The
Amendment includes the reclassification of the stream located on the property from a Perennial Stream to an
Intermittent Stream and to re -issue the Order accordingly.
Ms. Gonyer explained that they had reviewed this old lot that had been farmed many years ago. She explained
that the stream onsite is labelled as a Perennial Stream and was flowing throughout the summer and not drying
out, so the Commission determined the stream to be Perennial with a 200-foot Riverfront Area. The Commission
did issue an order of conditions as a perennial stream and DEP had superseded and appealed our decision
disagreeing with the area we had considered "Redevelopment". She then stated that she did review the site with
DEP and they reconsidered their determination. During this time, the stream became dry in July and August which
changed the classification of the resource area. Ms. Gonyer and The Bay Colony Group both submitted evidence
proof to the DEP and the State to prove that it was dry. The DEP reviewed the evidence and said they could honor
that in fact it was not a Perennial Stream and there is no Riverfront Area and that it was just an Inland Bank of an
Intermittent Stream with a 100-foot buffer. An, Amended Order of Conditions (AOOC) was issued to the
Commission verifying that it was an Intermittent Stream.
Mr. Gray from Bay Colony Group stated that Ms. Gonyer covered everything and said there was no changes to the
submitted plan. Mr. Roth inquired why DEP got involved. Ms. Gonyer stated in all her years, this has not happened
and was perplexed as well.
Motion: To issue an Amended Order of Conditions under DEP SE 211-1007 to Keith Signorelli, 889 Maple Street,
for the removal of an existing home and the construction of a single-family home with associated grading and
utilities within 100-feet of a; Bordering Vegetated Wetland and the 200- foot Riverfront Area. The Amendment
includes the reclassification of the stream located on the property from a Perennial Stream to an Intermittent
Stream and to re -issue the Order accordingly.
Passes: 5:0 (Roth/Gallagher)
S. Request for Order of Conditions (RCOC), Request for Certificate of Compliance (RCOC), David Oberlander, 18
Columbine Road, Mansfield, MA, (Map 036, Parcel 035 & 036) under DEP SE 211-1004 for the construction of a
dwelling, subsurface disposal system and the associate site work within 100 feet of inland bank.
Ms. Gonyer explained that this was a Town lot that was sold at an auction and that it was a very tight lot. The lot
only had room for a home, a small lawn area and a septic system. Mr. Oberlander did the construction and she
was happy to see such a tight construction site with minimal impact to the wetlands. It was constructed as
requested and discs have been installed according to the plan of record. She had no issues and recommended to
issue a Full Certificate of Compliance. The applicant Mr. Oberlander, was online virtually if there were questions.
Motion: To Issue A Full Certificate of Compliance to David Oberlander, 18 Columbine Road, Mansfield, MA, (Map
036, Parcel 035 & 036) under DEP SE 211-1004 for the construction of a dwelling, subsurface disposal system and
the associate site work within 100feet of inland bank/BVW.

6. (Continued from 9/30/24) Notice of Intent (NOI), SE 211-1015, Cathleen DeSimone, City of Attleboro, 250 Balcom
Street, Mansfield, MA, proposed construction of a municipal water treatment plant with access road, site work
and all associated utilities and site work. The work also includes partial demolition of structures of the existing
water treatment plant within 100-foot buffer of an Inland Bank and within the 200-foot RiverfrontArea.
Ms. Gonyer stated that Mr. Barry an Engineer from Tata & Howard had come before the Commission to review
the project and was here again to continue the hearing with the Commission. She stated the project was for a
brand-new water treatment facility located to the west of the Attleboro property at 250 Balcom Street. The design
plan was described as an upland forested area and that the work is going to be sandwiched In-between two
resource areas. The south has the intermittent stream and to the north of the project there is an isolated
vegetated wetland that has the physical characteristics of a potential vernal pool. She then stated that she was
able to meet with the Wetland Scientist, Art Allen, and they discussed the potential vernal pool and how to permit
something like this under the regulations. She reiterated that this area was not listed as a priority habitat meaning
there's no record of an endangered species on the property therefore there is no MESA or Natural Heritage
jurisdiction, but there is the Mansfield local "bylaw. NHESP did however state that they would like to keep the
infiltration the same around the vernal pools so that we are not starving any seasonal inundation that may happen.
The Stormwater stayed where was. She then stated that she was comfortable with the plan as proposed and
when the time is ready she will go to review the plantings as proposed.
Mr. Barry stated that the plans were updated with all the stormwater calculations for the Town Engineer, Rick
Alves, to review when he returns to work. Once Mr. Alves returns, Mr. Barry is hoping to receive the Order of
Conditions from the Commission.Mr. Roth asked about the species and Ms. Gonyer stated that NHESP has no
record of endangered or threatened species inhabiting this area . She also stated that she was comfortable with
the plan as is and Mr. Barry can follow up with Rick Alves to satisfy the outstanding items on the Stormwater
Management Plan checklist. She recommended to the Commission to move forward to issue the OOC and that it
would be held until Mr. Alves approved the Stormwater Management Plan. Mr. Healey asked about a buffer for
the potentialvernal pool and Ms. Gonyer stated that the new plan would have protection and would be amended
to include a conservation seed mix to maintain any invasive species that try to come back.
