Call the Meeting to Order: Mr. Michael Healey, Chair, called the meeting to order at 6:04pm. 2. Request for Determination of Applicability (RDA), Joshua Baker, 311 West Street, (Map 20,;Parcel 10) proposes an addition to an existing single-family dwelling within a 100 ft of an Inland Bank of an Intermittent Stream. Proposed addition is in an existing grassed lawn with roof drains. Site has been visited, numerous times over the past nine months with water not flowing. Previous work on file with Conservation has the stream deemed intermittent. Silt Sock was provided and six evergreens to be planted along top of bank. Roof drains to drywell. Mr. Trowbridge had been working with Mr. Baker and the architect to workup a plan to avoid having to get a variance under the Wetland Bylaw. Ms. Gonyer stated that the first variance was approved but had many stipulations. The original Intermittent Stream was relocated and this area is now an established grass area. Mr. Trowbridge is proposing gutters to roof drains and silt sock is proposed on the westerly area. He spoke with Ms. Gonyer about more of a barrier and suggested a split rail fence. Mr. Trowbridge noted that the area within the Town easement is overgrown and Ms. Gonyer stated she will work with DPW to have it cleaned out. She then mentioned that she met with the owner, Mr. Baker and Mr. 'Trowbridge ,on site to discuss revising the design of the new addition without needing a variance. She stated that she would like to move the mow line up by 5ft and use the fence to create the barrier but still allow enough room for the house addition. Mr. Trowbridge did also point out that the lot is relatively flat and will remain that way. Mr. Healey mentioned that he had worked on an enforcement issue on the house across the street (310 West St) and on one of his trips out there he could hear a sump pump and running water coming from this house (311 West SO and it was piped directly into the stream. Mr. Trowbridge has visited the site many times and assured everyone that there had only been little puddles and he dd not notice a sump pump outlet. Ms. Gonyer asked to make sure that if there is a sump pump that it not be directed to the stream and Mr. Trowbridge said they could connect it with the drywall. Mr. Roth asked about the thought process to have a fence installed and Mr. Trowbridge mentioned it would be more of a barrier to reduce the area that had been mowed there. Motion: To issue a Negative Determination for Reason#3 (no work with adversely impact the resource area) to Mr. Joshua Baker, 311 West Street, (Map 20, Parcel 10) for the construction of an addition to an existing single- family dwelling within a 100 ft of an Inland Bank of an Intermittent Stream with the following special conditions. • Erosion Control must be inspected prior to the start of work • An as -built is to be submitted to the Department after the work is complete • All disturbed areas are to be stabilized immediately once work is complete • Erosion control shall remain in place until all disturbed areas are to be stabilized • Agent to review plantings once installed over two growing seasons. • Install split rail fence (section along stream bed) • if sump pump is discharging to stream, it is to be re -directed to the drywells. o Potential Land Donation Review: Ms. Gonyer stated should would share more information as she receives it. o Conservation Updates • HMP Hazard Mitigation Plan Project • On November 7'h, 2024 an HMP Public Workshop will be held • HMP survey — Ms. Varricchione shared the information with the Commission for their review and if they would like to consider to fill it out. o September 30", 2024 minutes for review and approval Motion: To approve the September 301h, 2024 minutes Passes: 4:0:1(Roth/O'Hara/Gallagher abstain) o Next Meeting Date 11/25/24 at 6pm.
