Ms. Donovan Palmer explained that all 4 tobacco suspensions last month have been completed and all the fines have been paid. There were no issues and all establishments were very accommodating. Ms. Frenette asked if there was anyone who would like to make a motion to open the public hearing for the Requirements for the Subsurface Disposal of Sanitary Sewage. Mr. Wilson made a motion to open the meeting, seconded by Mr. Maxwell, passed unanimously 3-0. 1 Ms. Donovan Palmer started by explaining the biggest part of these regulations that need to be changed is the Health Department will be working with the Barnstable County Health Department as they will be managing the IA (Innovative/Alternative) septic systems. With those systems, they need to have an Operation and Maintenance (O&M) contract in place, and do testing 2-4 times a year. All of the contracts will be sent to Barnstable County. The O&M contractors pay a small fee to Barnstable County which can be passed on to the homeowner. Barnstable County will keep track of Operations and Maintenance Contract and any of the testing. Barnstable County does not have the authority to do enforcement, so anything that comes up they will reach out to the Mansfield Health Department. Ms. Donovan -Palmer stated we have about 16-17 systems in town and at least 2-3 are delinquent in their Operation and Maintenance contracts. With Barnstable County's assistance, this process will be much more manageable for the Health Department. Ms. Donovan -Palmer stated that she legally has to mention that the Mansfield Board of Health does not accept cesspools as conforming sewage disposal systems. All cesspools will be considered automatic frailer at the time of a Title 5 Inspection. Ms. Donovan -Palmer then states that she would like to remove the minimal set back distances of the leaching field to wetlands. The state regulations say that it can be 50 feet, so when we have 75 feet it just adds another level of review. Both Ms. Donovan -Palmer and the Conservation Planner is recommending Ms. Frenette asked if there was anyone who would like to make a motion to open the public hearing for Bodyworks Regulations. Mr. Wilson made a motion to open the meeting, seconded by Mr. Maxwell, passed unanimously, 3-0. Ms. Donovan -Palmer stated that she was approached by the Mansfield Police to start the Bodyworks Regulation a few months ago. Bodyworks does not include massage or acupuncture but other similar fields currently not regulated by the state. With no regulations there is concern for sanitation and potential human trafficking. In Mansfield, there are only have 3 possible Body Work Regulations. All have been notified through certified letters with the hearing information and the possible regulations. Town Council approved of the language within the template Bodyworks Regulations. Ms. Frenette opened the visitor comments. At that time there were no visitors, nor anyone who attended virtually. Ms. Frenette made a motion to close the Public Hearing. Mr. Maxwell approved the motion, seconded by Mr. Wilson. The motion passed unanimously, 3-0 to close the Public Hearing. Mr. Ted Monahan, the financial controller and representative for Trattoria Romana took to the podium. He explained that their work with MoJin has been going great. They have made some great strides and some successes. Mr. Monahan has been in contact with Ms. Donovan -Palmer about some concerns they had in terms of reporting. Mr. Monahan spoke to Maureen Lee about the previous days inspection and they are looking at continuing the relationship with her on a monthly basis moving forward to an indefinite period of time. Mr. Monahan thinks Maureen Lee, Trattoria's consultant is a valuable resource for the restaurant, especially with the turnover for the summer season. There is a program they are looking to institute for the front of the house employees to make sure they are all aware of the rules and regulations when it comes to handling food safely. Mr. Monahan then went on to ask that since the restaurants results have been pretty good, and they are going to continue to use the same processes they are using today, he is asking the Board of Health to change the inspections from once a week with MoJin to a monthly basis. Mr. Monahan stated that Ms. Donovan -Palmer required a letter from Maureen Lee signing off that the restaurant is addressing all of the previous issues, and has taken corrective actions. Maureen Lee would not hesitate to recommend to reduce the audit frequency to monthly. Ms. Donovan -Palmer feels that everyone has put in a ton of work over the past couple months. Ms. Frenette asked Ms. Donovan -Palmer if she felt comfortable moving the inspections to monthly, and Mr. Donovan -Palmer replied yes. Mr. Wilson made a motion to reduce the frequency for Mohn inspections for Trattoria Romana to a monthly frequency, seconded by Mr. Maxwell. The motion passed unanimously, 3-0. New York Pizza —Basel Alnammari, the owner from New York Pizza took the podium. Ms. Donovan - Palmer started by talking about the inspection report from back in April which showed that the sanitizer concentration was out of compliance, which was the same violation that happened in the last inspection. Therefor the risk level gets bumped up to a different risk category. Basel informed the Board they have been working non - stop to get the restaurant in the right direction. He has hired a young new staff, getting them trained correctly. Basel would like the inspector to have a better explanation log that informs the employees what they are missing. Basel explained he fixed the issue, and he is in communication with his staff that this will not happen again and hired an outside company to keep the restaurant clean. Ms. Donovan -Palmer asked if he is looking into hiring an outside consultant to come in, and Basel said they are looking into it. Buffalo Wild Wings —Tyler Benson, General Manager of Buffalo Wild Wings took the podium. Tyler explained the restaurants violation which included a chemical violation. Tyler explained that the chemical was out at the dishwasher bar, and not only was it empty. but they also found out it was draining at a faster rate then it should have been. Tyler is having Hobart come out to take a look to see if there might be mechanical issues involved, to cover all their basis. Ms. Frenette stated that they are moving up a risk level and Ms. Amy Donovan -Palmer confirmed they will be moving to a risk level 4. Ms. Donovan -Palmer explained that this is a new policy which outlines that when there is a suspension, all the products need to be removed from the location. When there is a suspension that occurs, the current regulations do not outline what we need to do, this policy will specifically outline what we need to do. Mr. Maxwell made a motion to make this an official policy, Mr. Wilson seconded the motion. The motion passed unanimously, 3-0. 3 Ms. Amy Donovan -Palmer explained that there is a movement to require paint manufacturers to accept used paint. Mansfield is accepting used paint this year at Household Hazardous Waste Day, but it is a cost to the town. A paint stewardship law would establish a convenient collection network for unwanted paint, alleviating municipalities of disposal costs for this messy material. Ms. Donovan -Palmer stated that the Board can decide if you want to have it as a resolution in support of Paint Stewardship legislation or there is also the possibility of sending a letter to the House Committee of Ways and Means in support of this. Mr. Maxwell made a motion to support the resolution and to send in a letter of Paint Stewardship, Mr. Wilson seconded the motion. The motion passed unanimously, 3-0. Ms. Frenette explained that there was a case of Powassan Virus confirmed in a Sharon resident which is a tick born illness it's the same tick that carries Lyme. Ms. Frenette reminded everyone to keep up with tick checks which include tick repellent spray. Ms. Donovan -Palmer mentioned that the Health Department will be using some of the grant funding to get a lifelike mannequin, which will be dressed in tick friendly clothes, and the APHC will be making some posters and information to help with tick education. Ms. Frenette then mentioned that we also ordered tick trail signs in English and Spanish. No updates for the Nursing Reports. Ms. Donovan -Palmer mentioned that there is a community health inclusion index mini grant with that money, we have been working with Planning and Conservation to develop a plan for accessibility in Open Space. The Health Department has contracted with Serpant to asses all of the recreation in open spaces for accessibility. So that is what will be brought to the Open House on Monday May 13, 2024.
