Darlene Pruitt, Chair, read the public notice into the record. This application was continued from
the May 21, 2024 meeting.
Regarding the application of Xfinity/Live Nation for a Variance from Zoning Bylaw Section
230-4.7. for a proposed marquee sign at 885 S. Main Street. The Property is owned by
Xfinity/Live Nation and located at 885 S. Main Street; Assessor's Map/Parcel 016/011 in the
Industrial 1 (I1) Zone.
Jason Sandoval, General Manager of the Xfinity Center presented the application. Mr. Sandoval
distributed renderings of the proposed new Marquee to the Board. Mr. Sandoval explained that
the main purpose of the new sign is to improve the ongoing traffic confusion that the concert
venue causes. He pointed out that there are other marquee signs along 140 (ie the gas station),
and people are confused about where to turn into the concert venue. There is currently a wooden
sign that is not prominent enough to guide visitors. Mr. Sandoval said that the new sign would
be placed to the left of the existing flagpole, and will conform to all current setback restrictions.
Mr. Sandoval also stated that the top portion of the proposed sign will be backlit, and the bottom
portion will be an LED marquee listing upcoming concerts, time, date, and lot opening times.
This will be a service to neighbors and anyone who travels the road so that they can avoid the
area on concert days. Mr. Sandoval also said they are willing to utilize the sign in the winter
months for town messaging (i.e. Hazardous Waste Day or Fall Festival).
Ms. Pruitt agreed that the current sign was difficult to see. Mr. Maxwell said he works next to
the concert venue and doesn't know when the concerts are happening — so he would appreciate
knowing when they are coming up.
Mr. List asked what relief Mr. Sandoval was seeking and Ms. Raposa said the relief would
primarily be for the illumination of the sign. Mr. List said that the Xfinity lot is also an odd
shape so that might be appropriate conditions for a variance. Mr. Cummings added that based on
the frontage; one wouldn't even know there was a 20,000-seat concert venue at that site:
There was discussion as to whether the sign would cycle through messaging, or if it would be
stagnant, and if there would be graphics. Mr. Sandoval responded that the sign messaging would
ideally cycle through and would have no graphics, but is open to what the town wants. There
was some discussion about the hours that the sign would be illuminated. Mi•. Sandoval is open to
setting times with the Town. He would need it to be lit for an hour to two hours after the concert
curfew of 11:00 for egress, which can take up to 2 hours.
Mr. Correira said that the sign would help with traffic. He travels the road often, and would
appreciate knowing when to avoid the area.
There was discussion about the dimensions, and what the square footage requirement was for the
sign. Ms. Raposa calculated that based on Mr. Sandoval's numbers, the square footage of the
sign would be 56.25 sf for both sides. The Board requested that Mr. Sandoval provide exact

measurements for the proposed sign and check with the surveyor to ensure that the sign is placed
within the appropriate setbacks. Mr. Sandoval agreed to request a continuance to put something
together and will appear again at the July 16, 2024 meeting.
Motion: Motion to continue this matter to July 16, 2024.

Darlene Pruitt, Chair, read the public notice into the record.
Regarding the application of Scott & Lisa Semple for a Finding pursuant to Zoning Bylaw
Section 230-4.2A to remove an existing deck and construct a new deck extending the pre-
existing, non -conforming side yard setback to 29' where 30' is required. The Property is owned
by Scott & Lisa Semple and located at 115 Brown Ave; Assessor's Map/Parcel 004/099 in the
Residential 1 (RI) Zone.
Mr. Scott and Ms. Lisa Semple were in attendance. Ms. Semple presented the application to the
board. The Scruples have a 40-year-old existing deck that needs to be replaced, and they would
like to enlarge it. The existing deck is 9 feet from the property line, and the new deck will be 10
feet, so it will not make it worse. Ms. Semple pointed out that there is a right of way in the area,
and no neighbors will be impacted.
Mr. List asked if they did an addition on this property last year. Ms. Semple confirmed that they
did.
There were no issues or questions from the board or from the public.
Motion: Motion that the ZBA find that the proposed alteration of a preexisting nonconforming
structure is not substantially more detrimental to the neighborhood than the existing
nonconforming residential structure because the new deck extension does not encroach further
into the setback and that such alteration as presented does not create a new noncompliance with
any other requirement of the Town of Mansfield Zoning Bylaw.
