Regarding the application of Amy and Michael Feck (applicant/owners) seeking approval from the Zoning Board of Appeals (ZBA) for a repetitive petition for a variance at 668 Elm Street based on specific and material changes made from the conditions upon which the previous unfavorable action was made. The statute requires that the Planning Board consent to the re -application prior to the ZBA's public hearing (scheduled for the 215t of November). The project site is shown on Assessor's Map 15, Lot 3 within the Residential R-1 zone. Ms. Raposa noted that only five Board members were present. The statute requires that the Planning Board, for the consent of a Repetitive Petition, have present six out of seven members for a vote. She recommended that the Board continue the hearing to the next meeting date. After a brief discussion, it was determined that it would be best to hold a special meeting on November 29"' rather than wait until December. Ms. Friedman left the meeting. Ms. Raposa noted that the previous discussion ended with the site plan component and potential impact statements for certain land disturbances. She asked that the Board members review both sections for comment, but she did not need answers at this meeting. The meetings and discussions are leading up to a formal public hearing for the Rules and Regulations. Ms. Raposa said that there are still 20 items remaining for review. She reviewed the following items with comments noted. 30. Findings 31. Decision — Ms. Raposa said that the Standard Conditions are listed in this section. She specifically noted two new items based on recently rendered decisions; Transportation Demand Management and Transportation Coordinator. She said that these items may not be incorporated in all decisions. Planning Board Meeting Minutes 11/8/23 Page 2 of 4 Mr. Cerretani expressed his opinion that the requirement for a Transportation Coordinator is important, most especially in the office park. 32. Filing Decisions 33. Reconsideration — Ms. Raposa noted that this is not statutorily authorized and therefore there is no reconsideration of a decision by the Board. 34. Reapplication — Ms. Raposa said that she will confirm time -frames for specific items (i.e. Special Permit or Variance) and the length of time for which an extension could be granted. 35. Two -Year Limitation on Grants — Ms. Raposa clarified that the current Special Permit Bylaw states that "All special permits granted in accordance with the provisions of this bylaw shall lapse within two years of recording of the special permit with the Town Clerk if substantial use of the permit has not commenced sooner, except with good cause. " She noted that per MGL Ch. 40A Section 9 paragraph 16, the period is "not more than 3 years" and asked if the Board would like to consider a zoning amendment to match. Mr. Corsillo suggested keeping the bylaw as it currently is rather than seeking a bylaw amendment for the change. Mr. Cerretani asked what the extended period is. Ms. Raposa said she would research details for extension periods and revisit them at the next discussion. 36. Monitoring — Ms. Raposa said that this came about from the updated Site Plan Regulations. Mr. Corsillo noted that given the Transportation Demand Management and Transportation Coordinator points, should a Traffic Officer also be added. Ms. Raposa said that the Traffic Officer was already identified in that condition. 37. As -Built Plan Requirements 38. The Mullin Rule 39. De Minimis Changes 40. Timing 41. Fees — Mr. Cerretani asked if the current fees are up to date with neighboring towns. Ms. Raposa said that she would check into it. She also noted that fees should cover the cost associated with processing an application. 42. Quorum and Voting — Ms. Raposa clarified the differences between an abstention and a recusal. 43. Scenic Roads 44. Consultant Review Fees — Fees are deposited into an interest -bearing account and any balance is returned to the applicant. Ms. Raposa said that the primary purpose of obtaining a peer review consultant is to allow the Town engineer to concentrate on Town engineering work, not overseeing the applicant engineer's work. 45. Annual Report 46. Comprehensive Annual Financial Report 47. Validity 48. Staff Contacts 49. Administration — Ms. Raposa said that there will be a public hearing in January for Rules and Regulations with adoption at the Annual Town Meeting. Planning Board Meeting Minutes 11/8/23 Page 3 of 4 Ms. Raposa relayed the information relating to a conversation that Ms. Friedman had with Chief Sellon. Chief Sellon was conceptionally supportive of the notion of a zoning amendment to define locations for the retail sales of firearms. There will be more information on this at future discussions. Ms. Raposa said that she did not have updates relating to the other previously discussed amendments. She did note progress on the continued work with JM Goldson for the MBTA compliance for the MSROD. Jen Goldson expects to have the modeling completed by the end of November. The Town was awarded a $90,000 grant for MBTA zoning compliance. Ms. Raposa explained that the consultants will be interviewed at the December 13°i meeting. Mr. Cerretani said that workshops will need to be added to the new year calendar to work on compliance. It would not be as extensive as phase one. Ms. Raposa said that she and Mr. Cerretani have been invited to a December Select Board meeting for a presentation of the Master Plan update status. Mr. Cerretani said that the Select Board subcormuittee has interviewed applicants for the Planning Board vacancies. The decision should be rendered at the next Select Board meeting.
