responsible for the reliability of the entire grid in New England. He stated that if there were multiple days of
deep cold weather and the availability of natural gas to generate electricity were too low to supply all of
New England it would require that all electric departments reduce their usage. This would be something that
is planned and all electric customers would have the same burden. Customers would be notified in advance
to plan and everyone may have a window of time like ninety minutes where you would have no power, this
situation would be extremely rare but it is important for everyone to understand that this is something that
could happen.

Motion: To open the public hearing at 6:4213M. (Rhein/DelVecchio) Passes 4:0
Mr. Trowbridge asked those that wanted to speak tonight should be sworn in, Mr. Trowbridge then asked if
anyone was present as the defendant or owner of the dogs and there was no one present. Ms. Staples was
present and swore in those wishing to speak.
Mr. Trowbridge then asked Officer Jeff Collins to go through a summary of events. Officer Collins began by
providing a time line of events that began on July 15t when two large dogs were running free on Erin Drive.
Officer Collins was unable to locate the dogs but spoke with Mr. Jim Kinahan who called in the report. Mr.
Kinahan stated that it has happened on several occasions and he was getting tired of It, Officer Collins stated
he had to leave and respond to another call and when he returned to the area the dogs had made their way
home and he spoke with the owner of the dogs Melanie Quinn of 756 Ware Street. She showed Officer
Collins where a section of the pen where the dogs escaped from. Officer Collins spoke with her about a
stronger reinforcement to the pen and provided Mr. Kinahan with a complaint form should he want to file
one with the Select Board. On July 8th Officer Collins received a call about two large dogs loose on Wind
Chime Drive and when he arrived he was able to identify the dogs belonging to Melanie Quinn. Ms. Quinn
came to get her dogs and showed Officer Collins another section of fence was destroyed where the dogs got
out. Officer Collins stated on July 14th he received a call from Ms. Sharon Turk of 770 Ware Street who had
an incident of the dogs coming into her yard. Officer Collins spoke with Ms. Quinn and showed proof of
vaccinations, but the dogs had not yet been licensed. Officer Collins then stated that on August 10th he
received a call that the dogs were running free and was able to get them back to their home by leading them
with a trail of treats. He stated that the dogs when in the company of the owners are social but when they
are free by themselves they are wary and know what a lease is and keep their distance 5-10 feet away. On
September 9th Officer Collins got a call that the dogs were running free and causing problems with the
neighbors as well as photos showing the dogs were in the roadway causing traffic issues. September 26th
another call that the dogs were free and had made their way over to Mill Street and Officer Simmonds was
on duty and spoke with Mr. Ben Spera who called in the complaint and stated the dogs were on his property
and were growling and showing teeth, but made noises and they ran off. A short while after this incident the
dogs were located off of Mill Street and were breaking into a chicken coop. Ms. Quinn was able to get to the
area and get her dogs and bring them back home. Officer Collins stated that in October and November the
department received calls that Ms. Quinn was operating a doggie day care. Police Officers were able to see
various people picking up their dogs when there on another call. Officer Collins then noted that while a dog
was in her care it was killed. Ms. Quinn reported that it was killed by a coyote.
Mr. Paul DeRensis, asked Officer Collins if his reports are prepared in the ordinary course of business and if
they are maintained by the Mansfield Police Department. Officer Collins responded that they were. Mr.
DeRensis then asked if the reports are accurate and true to the best of your knowledge and Officer Collins
responded that they were. Mr. DeRensis asked for those reports to be part of the official record. Mr.
Trowbridge agreed that they are part of the official record.
Select Board Meeting Minutes
December 7, 2022
Detective Christopher Walsh then came forwarded and stated that he interviewed Ms. Quinn after the dog
was killed while in her care. Detective Walsh stated that Ms. Quinn admitted that she was caring for dogs
and running a dog sitting operation. The Select Board had no questions of Detective Walsh. Mr.
DeRensis asked the Detective if he prepared any reports for this case and if they were prepared in the
ordinary course of business and maintained by the Mansfield Police Department. Detective Walsh
responded that he had and they are. Mr. DeRensis then asked if statements made in the reports are true
and accurate to the best of his belief and Detective Walsh responded that they were. Mr. DeRensis asked if
Detective Walsh had issued any bylaw citations and he responded that he had not. Mr. DeRensis then asked
Officer Collins if he had issued any bylaw citations and he responded that he had. He noted there was a
bylaw citation for a leash law violation twice and for a running of a kennel without a license twice. Mr.
DeRensis asked for those citations to be entered into the record and Mr. Trowbridge agreed.
Ms. Linda Janssen of 740 Ware Street came forward. She stated that she is a direct abutter of 756 Ware
Street. Mr. DeRensis asked her if she prepared a statement in regards to this dog hearing and she confirmed
she had. He then asked her if the statement was the truth and nothing, but the truth and she responded
that it was. Mr. Trowbridge asked for those statements to be included as part of the record. Ms. Janssen
stated she wanted to make a correction that on July 11t the dogs were not registered and they were still not
registered when she called the Town Clerk's office on August 30th and the dogs were still not registered. She
also called the Zoning Department and there was not a registered kennel on file for 756 Ware Street.
Ms. Sharon Turk of 770 Ware Street came forward and stated that she is an abutter. She stated that her
statements are accurate, but wanted to make a correction to the July 13th statement in the second
paragraph. She said the statement that reads that James came out of the shed should say that Frank came
out of the shed and the last sentence it should be Frank and not James. She also added that paragraph four
it should be Frank and not James. Mr. DeRensis asked for Ms. Turks statements to be entered into the
record as amended and Mr. Trowbridge agreed.
Mr. DeRensis then asked for Detective Walsh to come forward and asked him if he was involved with the
situation of Ms. Shawna Burke. Detective Walsh stated that Ms, Burke came to the Police Department
because she wanted to file a report because she left her dog in the care of Ms. Quinn for a week and the dog
had passed away while in her care, Officer Andrew Kelly was the officer who took the initial reporting from
Ms. Burke but he interviewed Ms. Burke as part of the investigation. Ms. Quinn stated that she took the two
Pomeranian dogs belonging to Ms. Burke and one of her dogs Nahla outside along with her young child. Ms.
Quinn stated that a coyote came out of the woods and took one of the dogs into the woods and several
hours later she found the dog 100 feet away in the swap of the woods. Ms. Burke was given back both dogs
but one was dead and wrapped in a blanket. Mr. DeRensis asked if the dead dog had bite marks and
Detective Walsh stated there were bite marks. Mr. DeRensis asked if coyotes eat their prey and Detective
Walsh responded that in his experience and knowledge a coyote would take the animal to eat and you
would never see it again. Mr. DeRensis asked if the dead dog was eaten and Detective Walsh responded that
it was not.
Mr. Rhein stated that there were so many instances and at what point would the Select Board have a
hearing. Officer Collins stated that the Select Board could have a hearing after just one incident however he
did not report it because at first the dog owners were showing intent to fix the pen but then the calls
became more frequent and the dogs began to show aggression. Mr. Rhein then asked what would the Town
or Police Department for the violation of operating a kennel without a kennel license. Officer Collins
responded that until the police have reports and proof of it then he would be able to fine them and give a
bylaw citation. Mr. Rhein then asked why the dog owner was not present and Officer Collins stated that she
may have moved out of Mansfield with one of the dogs. Mr. DeRensis stated that there is a complaint before
Select Board Meeting Minutes

the Board and even if the person may have left Town the Board must decide on what has happened in the
past and not the future. Furthermore, he added that the Board has to first decide to either dismiss the
complaint, declare the animal's dangerous animals or nuisance animals.
Mr. Trowbridge stated that this is upsetting and putting people at risk. He noted that it is also using up lots
of Town resources dealing with this and there appears to be a blatant disregard. Mr. DeRensis added that by
definition taking money for caring for a dog is a kennel and a person would need a kennel license. Mr. Rhein
asked how large the dogs were and Officer Collins believed they were about 110 pounds. Mr. DeRensis
asked how big the dog that died was and Officer Collins stated around fourteen pounds.
Mr. Aptowitz thanked those residents who came forward because he knows that can be very difficult. He
stated that people cannot be afraid of being outside in their own yards and hopes that the Board can take
stringent measures to deal with this because everything about this complaint is unacceptable.
Mr. Trowbridge asked Officer Collins if he would deem the dogs dangerous or nuisances. Officer Collins
responded that in his opinion he would highly recommend that the Board deem them dangerous dogs. Ms.
Turk came forward and asked if its possible to deem a dog both dangerous and a nuisance and Mr. DeRensis
answered that you have to pick one or the other.
Motion: To close the public hearing at 7:20PM. (Rhein/Aptowitz) Passes 4:0
Motion: To declare the two Canary Mastiffs dogs Cora and Nahla as dangerous dogs. (Rhein/Aptowitz)
Passes 4:0
Mr. DelVecchio asked Officer Collins to confirm that it should be a dangerous dog and not a nuisance dog
because the nuisance dog would give the Board more flexibility in the order. Officer Collins stated that based
on the evidence they are dangerous dogs and are willing to go after small animals like chickens. Mr.
DeRensis added that this recommendation does go along with the statute.
Motion: To order the following conditions per MGL Chapter 140 Section 157 that the dogs Nahla and Cora
must be confined to the premises of the keeper of the dogs; provided, however, that "confined shall mean
securely confined indoors or confined outdoors in a securely enclosed and locked pen or dog run area upon
the premises of the owner or keeper; provided further, that such pen or dog run shall have a secure roof
and, if such enclosure has no floor secured to the sides thereof, the sides shall be embedded into the ground
for not less than 2 feet; and provided further, that within the confines of such pen or dog run, a dog house
or proper shelter from the elements shall be provided to protect the dogs. The dogs Nahla and Cora when
removed from the premises of the owner or the premises of the person keeping the dogs, the dogs shall be
securely and humanely muzzled and restrained with a chain or other tethering device having a minimum
tensile strength of 300 pounds and not exceeding 3 feet in length. The owner or keeper of the dog provide
to the licensing authority or animal control officer or other entity identified in the order, information by
which the dogs may be identified, throughout their lifetimes including, but not limited to, photographs,
