Dear Town Manager and Health Department:
The Massachusetts Contingency Plan (310 CMR 40.0000) requires people submitting a Permanent
Solution Statement (PSS) for a release of oil and/or hazardous materials (OHM) or, in this case
diesel fuel and motor oil, to notify the Chief Municipal Officer (CMO) and the Board of Health
(BOH) when a PSS is submitted to the Department of Environmental Protection (MassDEP).
In October of 2018, a release of approximately 150 gallons of diesel fuel and unknown volume of
motor oil occurred as a result of a collision with a bridge abutment that affected the surface of the
abutment, jersey barriers, concrete surface, bituminous pavement, and one catch basin at the above -
mentioned location. A PSS is required in accordance with 310 CMR 40.0000 to document the
release has been cleaned up to a condition of No Significant Risk and the case is closed with the
MassDEP. Clean Soils Environmental, Ltd., (CSE) recently completed a PSS with No Conditions
(PSSNC) for this release, which is on file at the MassDEP Southeast Regional Office (SERO) in
Lakeville, MA.
