PERMANENT SOLUTION I INDINGS AND CONCLUSIONS
At approximately 09:15 AM on February 21, 2017, a Waste Management of Massachusetts, Inc. garbage
truck experienced a failure of a hydraulic line on the vehicle's compactor unit. The hydraulic line
failure resulted in a release of an estimated 20 gallons of hydraulic oil. No other petroleum products
were released the vehicle.
The Mansfield Fire Department responded, using absorbent materials to remediate the spill. Mansfield
Fire Department Lieutenant Robbins notified MassDEP of the release at 9:45 AM. At approximately
I t:00 AM, David Foss, LSP, of Wilcox & Barton, Inc., communicated with Robert Murphy of
MassDEP on behalf of Waste Management of Massachusetts, Inc. Mr. Murphy provided verbal
approval for IRA activities including assessment of the nature and extent of the release, application of
absorbent material to the paved surfaces, recovery of petroleum product and absorbents from the
pavement. Following discovery of the impacted catch basin, during a second phone call between Mr.
Murphy and Mr. Foss, the approved IRA activities were amended to include vacuum and recovery of all
liquids from the impacted catch basin.
During the afternoon of February 21, 2017, Immediate Response Action (IRA) remediation was
implemented by the emergency response contractor, Enpro / NRC Environmental Services, Inc. (NRC)
under the direction of Wilcox & Barton, Inc, on behalf of Waste Management of Massachusetts, Inc.
The release of hydraulic fluid impacted the paved roadway and paved sidewalk. Embanked snow was
present along the road shoulder. The weather was sunny and dry with the temperature was in the mid -to
upper-30's. Melting of snow on the road shoulder facilitated flow of meltwater and a hydraulic oil
sheen along the western curb of Elm Street into a catch basin (CB-1) located approximately 115 feet
south of the intersection with Partridge Street. Catch Basin CB-1 was beneath a snow bank and was not
visible during the initial site inspection. CB-1 was observed when snow impacted by the release was
remediated and placed in drums for off -site disposal.
Granular absorbents were applied to the release area and were recovered. Oily -water was recovered
from the impacted catch basin using a Drum -vac. The catch basin was confirmed to have hard bottom
and, based on observed fluid and piping levels, fluids associated with the release did not discharge from
the basin. As a result, the release was determined to have been confined to pavement and did not impact
environmental media. Visual inspection confirmed that the response actions remediated the paved
surfaces within the disposal site to conditions consistent with Anthropogenic Background and no further
response actions are required. All remediation waste was managed and transported for off -site disposal
between February 21 and 28, 2017.
The property affected by the release is a portion of the Elm Street right-of-way, one catch basin, and a
portion of the paved sidewalk located in front of the residential property at 679 Elm Street in Mansfield,
Massachusetts.
Pursuant to MCP Section 40.1000, the conditions for a Permanent Solution with No Conditions have
been met.
