This Notice informs you of the results of the MassDEP's audit. In particular, the audit focused on the Immediate Response Action Completion Report and Class A-1 Response Action Outcome Statement (RAO). A three-story Senior Citizen apartment complex occupies the Site. A hydraulic oil leak from a damaged underground feed pipe to the elevator was discovered after the elevator stopped working properly. Approximately thirty (30) to fifty (50) gallons reportedly leaked over an extended period of time from the corroded pipe under the slab foundation. Contaminated soil was treated with an in -situ biological system that relied on groundwater circulation and nutrient enhancement. Mass))EP received the RAO document on July 18, 2005. On April 11, 2007, Lynne Doty of the MassDEP Southeast Regional Office conducted an audit inspection, and discussed preliminary comprehensive findings at the Site with you and Ralph Penney, LSP, Thi, informadnn i, avaliable In alternate format Caa Donald Id. The groundwater immediately underlying the point of application of remedial additives at this Site was monitored on a regular basis until contaminants were below background levels. However, the requirement to monitor at hydraulically upgradient and downgradient locations was not met and supported in the RAO either by technical justification or schematic drawings. As a result of not presenting monitoring data for these locations, it was not possible to definitively determine if the Groundwater Quality Standards were exceeded beyond fifty (50) feet from the application point. In addition, since the location of the "domestic auxillary" wells were not depicted on the Site Plan it could not be determined if any of these wells also required sampling. v ARu dO n19ro1a¢4 Technical Tnetificatinn When forgoing any particular activity in accordance with 310 CMR 40,0193(1), the LSP shall identify such activity, and shall set forth the basis for such technical justification in the pertinent submittal. The LSP failed to provide the technical justification to limit the assessment of the property with respect to monitoring of groundwater.and soil as required for the application of Remedial Additives. Although the treatment protocol employed likely resulted in the containment of groundwater, during recirculation and soil treatment, there was no technical justification provided for forgoing the required groundwater monitoring. The heavy application of nitrogen containing lawn fertilizer, building configuration, extensive experience with similar system design results, extent of contamination and contaminant fate and transport arguments presented by the LSP during the audit field inspection were not provided in the RAO, Virnafiinn nr +n. 'tR 4n 1nn4 (ClaQe Performance Ctandardc for RPcnnnse Action Outromes Aug. 10. 2007 11:00AM MASS DEP No.9889 P. 7/7 Pace 8 Notice of Audit Findings and Notice of Noncompliance Mansfield RTN 4-17894 The Response Action Outcome Statement shall be supported by assessments and evaluations conducted pursuant to 310 CMR 40,0000 which are of sufficient scope, detail, and level of effort to characterize the risk of harm to health, safety, public welfare and the environment posed by the disposal Site, and demonstrate that all requirements of the applicable class of RAO have been met. The text of the RAO describes assessment activities but the plan scale chosen to depict the Site was not sufficient to allow for verification of the vertical and horizontal extent of hydraulic oil contamination, and its proximity to the treatment system. Additionally, the plan did not show the location of the pipe that leaked and the sixteen (16) soil sampling points. Furthermore, without a detailed design drawing of the treatment system, that shows it's proximity to the contamination and soil samples collected at the Site, it is difficult to definitively verify the technical adequacy of the bioremediation protocol. Furthermore, the Site plan depicted an extraction well that was never installed and failed to show the location of the four irrigation wells that caused the Site groundwater to be classified as GW-1. ACTIONS TO BE TARN AND THE DEADLINE FOR TAKING SUCH ACTIONS: Within sixty (60) days following receipt of this Notice you must submit a Post -Audit Completion Statement (13WSC-111) prepared in accordance with 310 CMR 40,1170, accompanied by either Option A or Option B below: Option A Submit to MassDEP a revised RAO for the Site, if conditions that support an RAO have been met, and include the missing information needed to verify that the full extent of contamination has been addressed. This revised RAO shall be prepared in full accordance with the provisions of the MCP and include all necessary technical justifications, revised plan drawings and other pertinent information identified in the violations listed above.
