Select Board Questions and Comments on Town Manager's Report
Mr. Dumas began his Town Manager Report stating that the COVID active cases is at twenty-five and as of
now the Commonwealth is reporting the data once a week on Thursdays. Mr. Dumas then announced the
promotions at Mansfield Fire that will happen once Deputy Chief Merritt retires and he added that a
promotion ceremony will be scheduled. Mr. Dumas then stated that there was a cooling center at the COA
facility today and if additional days are scheduled that information will be shared on social media. Mr. Dumas
then provided an update on items including the PARC grant application for Harry Chase Place, Cate Springs
and the Walsh Well projects. Mr. Dumas then explained information about the Xfinity Traffic plan stating that
MassDOT approves it. He added that the plan is in the process of being refreshed so that for smaller shows
the contra lane wouldn't be used and allow for traffic to turn onto Reservoir Street. Mr. Dumas then provided
an economic development update stating that the Paine School has begun its demolition and Walgreens has
begun hiring. Mr. Dumas then gave an update on the Municipal Building Committee. The Committee has
voted to hire BH+A Architects to lead the Preliminary COA Facility Design project. Mr. Dumas then stated that
for the Diversity, Equity and Inclusion Committee he will be reaching out to the Town's consultant and
sending a press release. Mr. Dumas noted that things are moving forward for a fall tax title auction.
Mr. DelVecchio had no questions. Mr. Aptowitz stated that he is glad that Mr. Dumas brought up the Xfinity
Traffic Plan and wanted people to know that is a state road and that it is not the Town that makes all the
decisions. He then asked about the tax title auction and noted that it didn't go well last time and asked if
those properties would be included again along with new properties. Mr. LaCasse responded that it will
include those and some new ones, also a different auctioneer company will be hired. Mr. Aptowitz then
asked for confirmation that he heard there is money in the budget for the COA project and Mr. Dumas stated
that there is enough money in the budget for the study not the actual construction. Mr. Aptowitz stated that
he believed a new COA was needed, but concerned on how it will be paid for. Ms. Bren thanked Mr. Dumas
for the information on the Xfinity and wondered if they have done a traffic study on what effect that has on
the local traffic. Mr. Dumas stated that the State did not think there would be negative impact and the Police
Department also agreed that the extra lane is not needed for smaller shows. Mr. Trowbridge asked if the
message board signs have helped with notifying residents of concerts and Mr, Dumas responded that no one
has complained and the only trouble for staff is that sometimes the technology does not work and the boards
have to be reset and it cannot be done remotely.

4. Discussion and Consideration to Add Additional Members to the Municipal Building Committee (MBC)
for the COA Facility Design at 50 West Street
Mr. Dumas explained to the Board that this request is to add additional members to the Municipal Building
Committee for the COA Facility Design project at 50 West Street, which is similar to what was done for the
public safety project. Mr. Aptowitz asked if the COA member at large would be appointed by the COA or
would it be done by the Select Board. Mr. Dumas stated that it would be easiest if all of them were approved
by the Select Board. Mr. DelVecchio commented that traditionally each Board does pick their representatives
and the Select Board would appoint the at large members. Ms. Bren believed there should be more than one
at large member. Mr. Trowbridge believed it could become too large with any more members. Mr. Dumas
noted that in total the MBC has the majority of votes with five. Mr. DelVecchio also noted that there are
many committees that have vacancies and it may be hard to get additional members.

Select Board Meeting Minutes
July 20, 2022
Mr. Trowbridge then asked Officer Jeff Collins to come forward and explain what had happened. Officer
Collins explained the incident where the dog Arthur owned by Ms. Kim Ingolia at 14 Concetta Drive bit a child.
He stated currently the dog is a nuisance animal declared by the Select Board in 2017 and is to be muzzled
when outside the home. He stated that he received a call on June 13, 2022 from Mr. Eric Seltzer that the dog
got loose and his son was bitten by the dog. Mr. Steltzer had reported that his son was in Ms. Ingolia's yard
and he was in his back yard and heard yelling and went to find his child sitting on the curb bleeding from a
bite on his shoulder and Ms. Ingolia was putting the dogs back in the fenced yard. Officer Collins then visited
Ms. Ingolia who stated that the dog was moved out of State and provided no additional information. Officer
Collins told Ms. Ingolia that he would be requesting a dog hearing from the Select Board. Ms. Ingolia called a
couple days later and further explained that her granddaughter had left gate open and that it was not a bite,
but a puncture from the dog having long nails. Officer Collins stated that after further talking to Mr. Steltzer
there have been other situations throughout the last few years that the dog Arthur has gotten loose. Lastly,
Officer Collins stated that if the dog Arthur can't be contained, he is a threat to the neighborhood. The Select
Board then asked Officer Collins questions. Mr. DelVecchio asked for clarification on the injury being a
puncture wound from a dog nail verses it being a bite from teeth. Officer Collins responded that Ms. Ingolia
believed to be from nails of the dog's paw and the Steltzer's believe it is a bite. Mr. Aptowitz asked what type
of dog Arthur is. Officer Collins responded that on the dog license it is listed as American Staffordshire Terrier
and he weighs about 78-80 pounds. Mr. Aptowitz then asked if the dog was in Mansfield now or still out of
State. Officer Collins stated that he believed the dog was back in Mansfield based on talking with the
neighborhood. Mr. Aptowitz then asked if the 2017 incident involved two dogs and Officer Collins responded
that in the prior incident the dog broke its collar and went out to the street and attacked a dog being walked
and then attacked the dog's owner. Ms. Bren asked Officer Collins if he had any other complaints or has he
seen the dog with a muzzle on. Officer Collins stated that last summer he had a call for that neighborhood for
a dog running around and did not find a dog and it was believed to have been Arthur. He spoke with Ms.
Ingolia at that time and told her she needed to fix the latch on the gate to prevent Arthur from getting out
and that he needed to be muzzled.
Mr. Paul DeRensis, Town Counsel came forward. He asked Officer Collins to identify a document. Officer
Collins responded that the document was a police report that he completed on June 14, 2022. Mr. DeRensis
asked for this report and the photographs to be included in the record as Exhibit 1 and the Chair agreed. Mr.
DeRensis then asked Officer to Collins to identify another photo and Officer Collins identified the photo as a
bite wound on Ms. Tatiana Belmonte from 2017 and then Mr. DeRensis asked for that to be included into the
record as Exhibit 2 to which the Chair agreed. Mr. DeRensis asked how old the boy was that was bitten and
Officer Collins responded he was five.
Mr. Trowbridge invited Mr. Steltzer to speak. Mr. Steltzer stated that he sent an email this afternoon and
would read it for the record if needed and asked the Board to take it into consideration when making their
decision. Mr. DeRensis asked Mr. Steltzer if the letter was true to the best of his knowledge and Mr. Steltzer
responded that it was true to the best of his belief. Mr. DeRensis asked Mr. Steltzer to read the letter as it
would be for the benefit of the dog owner and the public. Mr. Trowbridge asked Mr. Steltzer to read the
letter or offered that a member of the Board could read it. Mr. Steltzer agreed to read the letter and
proceeded to read it. Mr. Trowbridge opened the floor for Select Board to ask questions of Mr. Steltzer. Mr.
DelVecchio asked Mr. Steltzer about each of the times that the dog was loose was the owner around and Mr.
Steltzer stated she was in her yard yelling for the dog to come back. Ms. Bren asked if the dog was in a muzzle
at any of those times that the dog was charging at him or his family. Mr. Steltzer responded that he was not.
Mr. DeRensis then asked for Mr. Steltzer's letter to be accepted into the record as an exhibit and Mr.
Trowbridge agreed.
Mr. Trowbridge asked Ms. Kim Ingolia to share her side of the story. Ms. Ingolia began by stating that
Benjamin ran across the street and told her that he tested positive for COVID. She then asked him where his

mother was and proceeded to explain that the children are never supervised. Mr. Trowbridge asked Ms.
Ingolia to share about the incident. Ms. Ingolia stated that it was a Saturday night, she was outside with her
granddaughters in the front yard. She stated she has two dogs Arthur and Luigi who were both in the fenced
back yard. She stated that she is having trouble finding someone to fix the latch on the gate that is broken.
She stated her granddaughter who is one, knocked over the 2x4 that was holding the gate shut. She stated
she did not invite Benjamin to her yard, never invited them in my yard because they had COVID. Ms. Ingolia
continued that when the piece of wood got knocked over both Arthur and Luigi got out of the back yard and
10 feet from the gate. She stated that if Arthur did bite Benjamin then Benjamin would not have an arm. If
Arthur jumped on Benjamin, Benjamin would have been on the ground. Ms. Ingolia stated that it could have
been Luigi that jumped on Benjamin. She stated that she spoke to Mr. Steltzer the next morning to find out
how Benjamin was doing and wanted to pay for the co -pay from taking him to the doctor. She stated on
Monday Mr. Steltzer and Emily came to her home and advised me that they were going to go report the
incident to Animal Control. Ms. Ingolia stated that at that point she brought Arthur to another person and she
does not know why the Steltzer's never called the police and didn't bring the child to a doctor. She stated
that she called the dogs, got them back in the fence area and she saw Benjamin run back home with no blood
on him. Lastly, she stated that the injury was called a puncture wound by Officer Collins and not a bite and
she believes it was Luigi that jumped on Benjamin because Arthur is 108 pounds. Mr. DelVecchio asked
Officer Collins to confirm that a puncture would means that the skin is broken through and Officer Collins
stated it could be from a K9 tooth or a nail on a paw. Ms. Ingolia asked if Arthur bit Benjamin could it have
been a puncture and he responded that it could. Mr. DelVecchio then asked how long after the 2017 situation
was the dog removed from the property. Ms. Ingolia responded that Arthur was never removed from the
property. Mr. DelVecchio then asked her if she removed the dog this time and she responded that she took
the dog to a friends house out of state. Mr. DelVecchio asked if the dog was back now and Ms. Ingolia
responded that the dog was somewhere. He then asked if it was in Mansfield and she said no. Mr. Aptowitz
asked if the dog was removed in June and has not been back and Ms. Ingolia responded that he had been
back, but is no longer there. Ms. Ingolia stated that her dog did nothing wrong and the child should not have
been on her domicile and the dog never left her dwelling. Mr. Aptowitz asked Ms. Ingolia if she intends to
bring the dog back and she responded that she certainly is and she spoke with an attorney. Ms. Bren asked
Officer Collins that based on the 2017 incident was Arthur supposed to have a muzzle on when on property
and off property and Officer Collins responded that he was. Ms. Ingolia interrupted and said that was wrong
and the letter stated that it was when the dog is outside of her property. Ms. Bren asked if the dog had a
muzzle on the day he bit the child in June of this year when he left the gate of your property and Ms. Ingolia
responded that he did not have a muzzle on, and he never left the property. Ms. Bren asked if she muzzled
the dog when it is outside in the back yard and she said no it is not supposed to bes. Ms. Bren asked if there
was documentation of what is required from 2017. Mr. Dumas answered that it is on page thirty-two of the
Select Board's packet. Mr. DeRensis then asked Officer Collins to identify that document that was dated
October 5, 2017 and if she had received it and what it was. Officer Collins responded that he received it on or
about October 5, 2017 and it was a letter from the Select Board after the hearing to Ms. Ingolia to keep
Arthur muzzled and restrained by an adult when outside the domicile and that the property must be fenced
and provide security for Arthur. Mr. Dumas asked Officer Collins to read one more line and Officer Collins
read that it was also required that Arthur attend obedience training classes within four months and
completion of the training provided to Officer Collins. Ms. Bren asked if the documentation was provided of
the training. Officer Collins responded that it was not. Mr. DeRensis asked for this to be made Exhibit 4 and
the Chair agreed. Mr. DeRensis then asked Ms. Ingolia if she attended the dog hearing on October 4, 2017.
Ms. Ingolia stated that she did. Mr. DeRensis asked if she received the letter from October 5, 2017 with the
order from the Select Board. Ms. Ingolia stated that she had and started to read the letter stating that the
dog must be on leash and muzzled when outside the domicile. She further explained that the domicile is her
property. She stated that it is her house and her land and when he left it was only ten feet off her property
and it was only for a minute. Mr. DeRensis asked Officer Collins to identify another document. Officer Collins
Select Board Meeting Minutes
July 20, 2022
responded that it was a police report from 2017 and it was part of the records for the Town of Mansfield. Mr.
DeRensis asked for that to be Exhibit 5. Mr. DeRensis then asked Officer Collins to look at the photo that was
part of the police report from June 14, 2022 and asked if he thought the two red marks and the puncture
wound were caused by a scratch or a bite. Officer Collins responded that he believed it was teeth.
Mr. Trowbridge asked if anyone else had any questions. Ms. Ingolia asked Officer Collins if he was a doctor.
Mr. Trowbridge responded that Officer Collins was asked his opinion by Town Counsel he never stated that
he was a doctor. Mr. DeRensis stated that each person is allowed to have closing comments. Mr. Trowbridge
asked Mr. Steltzer if he had any additional comments. Mr. Steltzer responded that he has no ill -will towards
Ms. Ingolia and noted that she has been very sweet to his children. He stated that as far as the parenting
comment that was insulting. He stated that he works as an energy consultant, a volunteer coach and his wife
is a local high school teacher and that they are active members within the community. He stated that the
whole situation is unfortunate and at the end of the day they are just looking for safety for their children. Mr.
Trowbridge then asked Ms. Ingolia for a closing statement. She stated that she has not seen one ounce of
proof that her dog bit Benjamin and her dog Arthur could not have jumped on or bit Benjamin. Her dog Luigi
might have jumped on him and made a puncture.
Motion: To close the public hearing at 6:57PM. (DelVecchio/Aptowitz) Passes 4:0
Mr. Trowbridge asked Mr. Paul DeRensis to come forward and asked him to confirm what the Select Board
needed to decideMr. DeRensis responded that when there is a complaint of a dangerous dog the Board has
to decide if the dog is a dangerous dog or they can dismiss the complaint, deem it a nuisance dog or deem it a
dangerous dog. If the Board dismisses the complaint that's the end. If the Board deems it a nuisance dog then
there are many options and flexibility to what the Board can order by law. If the Board decides it is a
dangerous dog then there is a list seven things that can be done to remediate the situation.
Mr. Aptowitz stated that as a Select Board has to keep the public safe. He added that the challenge is that
there is not an adult who saw the occurrence, just the child saying that he was bit. He stated that these dog
hearings are difficult and lots of thought needs to be put into the decision. Mr. DelVecchio asked what the
definition of domicile was and Mr. DeRensis responded he would have to research. Mr. DelVecchio
commented that in the decision tonight the Board should not use the word domicile and be specific. Officer
Collins stated that he believed the intent was for when the dog was outside the home and have a muzzle on
when it was in the back in fenced yard. The dog was deemed a nuisance dog so that they did not have to put
in an enclosed pen and the person who was bitten previously asked that the dog not be euthanized. Mr.
Trowbridge asked Mr. DeRensis for his opinion and Mr. DeRensis asked for that question to be posed to
Officer Collins, however either nuisance or dangerous dog he believed the courts should uphold either
decision. Officer Collins recommended that the dog be found dangerous and recommends euthanasia. He
does not believe the owner can keep the dog restrained. Ms. Bren asked if the latch for the fence was broken
in 2021 and if it was still broken in 2022. Officer Collins answered that she was correct.
Motion: That the Arthur be designated a dangerous dog. (DelVeechio/Bren) Passes 4:0
Mr. DelVecchio then made the following motion, but it failed as no one would second the motion.
Mr. Aptowitz asked Officer Collins if the Select Board has ordered that a dog be euthanized and Officer Collins
responded that they have.
Motion: To order that the dog Arthur be euthanized. (DelVecchio)
Mr. Aptowitz asked if time limits could be placed on the order. Mr. DeRensis stated that they could and if
they do not meet the deadlines then the Board would have another hearing and give everyone including the

dog owner an opportunity to explain why something may not have been done. Mr. Trowbridge gave the gavel
to Mr. DelVecchio so that he could make the following motion.
Motion: To order that the dog Arthur have obedience training and the results provided to the Animal Control
Officer, a fence as indicated under the statue, muzzle outside of the house, insurance policy of $100,000 as
stated in the statue. (Trowbridge/Aptowitz)
Mr. DeRensis offered an amendment to include time period for the items to be done. Officer Collins
requested that the enclosure be specified as having a top and bottom.
Motion Amended: To order that the dog Arthur have obedience training and the results provided to the
Animal Control Officer within in 30 days, a fence and proper enclosure as indicated under the statue which
has a top and bottom seal to be installed within 30 days, on a three foot lead as described in the statue and
muzzled when outside of the house effective immediately and proof of insurance policy of $100,000 as stated
in the statue provided within 30 days. (Trowbridge/Aptowitz) Passes 4:0
