HomeMy WebLinkAboutSELECTMENminutes02252009 Present: Town of Mansfield Board of Selectmen Minutes of February 25, 2009 f ! C E Vice Chairman Kevin Moran, Clerk Jess Aptowitz, Select~an 'G~;o~~~ D~nfl~~,O John D'Agostino, Town Manager Lee Azinheira, DPW Director and David Young, CDM Consultant were present for this discussion. Reps. Poirier and Barrows joined the discussion as well. Mr. Young gave a power point presentation on recent projection of wastewater flows for Mansfield. He asked for input on flow projections from the board in addition to providing a brief overview of the Comprehensive Wastewater Management Plan (CWMP). The town's last approved wastewater facilities plan is dated 1976. The new treatment facility went on-line in 1985 however; the current CWMP process did not begin until 2002 for all intense of purposes. Phase 1 of the CWMP was completed in October 2004 and the majority of the Phase 2 CWMP tasks were completed in the spring of 2006. Currently, Mansfield is essentially at capacity and may need an interim moratorium until the new plant is built. The reason is because commercial and industrial flow components have the largest projected growth over the next 20 years with a recommended flow need of 450,000 gpd for Mansfield. After the presentation Representative Barrows gave a brief overview of what they have been discussing in their monthly meetings with the joint sewer committee. A copy of the wastewater master plan is on file with the library for public use. Rep. Poirier followed up with comments on how hard and lengthy the process has been getting to this point and how much work Rep. Barrows has put into this project. The towns of Foxboro and Norton are working together with Mansfield to make this a regional project but work still needs to be done in order to move forward with financial/construction plans. Mr. Azinheira would like the board to vote to support a commitment of 450,000 gpd. Without this is will be difficult to plan out any further. Selectman Dentino thanked all the people involved in this project for their hard work and stated that Mansfield is a leader in the regional sewer industry. The Town of Easton is Board of Selectmen Minutes of February 25, 2009 ,..... .~.,._w..,~._..__.. ,. , T' interested in possibly being a sewer customer of Mansfield with another 100,000 gpd but has yet to commit. Mr. Young and Mr. Azinheira have asked Easton to state their intentions by the early part of 2009 in order to go forward with the proper numbers. Selectman Aptowitz and Mr. D'Agostino expressed concern that more gallons per day (gpd) might be needed and in ten - twenty years we may come up short. Mr. Young will review the numbers with Mr. Azinheira. Vice Chairman Moran declined to have the board vote until the whole board was present. Shannan Deluca is the new manager of Bertucci's at Mansfield Crossings and is here to be named the "manager of record". Ms. Deluca previously worked in the Canton Bertucci's and now in the Mansfield store since last year. She is tips certified and her staff is trained as well. Motion: To approve Shannon Deluca as the new manager of record. (Aptowitz/Dentino) 3:0 passes Joseph Gratton is the proposed new manager of Qdoba and has been with the store for 7 months. He is tips certified and his staff is trained as well. Motion: To approve Joseph Gratton as the new manager of record. (Aptowitz/Dentino) 3:0 passes Postponed until next week. Jack Goldberg, FinComm member asked if the board has retained an attorney in relations to union contract negotiations. Mr. D'Agostino stated that Mike Lehane will be the labor attorney who will be assisting him. He has provided labor law assistance to the town for years and is well versed in labor negotiations. Selectman Dentino thought we were looking at a more "hands on" consultant than labor counsel. Mr. D'Agostino asked: what actually does the board want? Selectman Dentino Board of Selectmen Minutes of February 25, 2009 2 T would like labor counsel to be involved in every labor/union negotiations meeting to ensure continuity. Mr. D'Agostino stated that will be the case with Atty. Lehane. If Atty. Lehane is not available for a particular meeting someone from his office will be. Selectman Dentino and Mr. D'Agostino disagree with the term "be a part of each meeting." Mr. Dentino would like labor counsel to be present at all meetings and take an active part in negotiations as opposed to just general oversight. Mr. D'Agostino stated that it is not cost effective to have labor counsel at all meetings, such as ground rules or simple matters and 30 minute meetings. Andy Gazzolo, FinComm Chair, stated "he would be more comfortable with having labor counsel at every meeting, not that he doesn't trust the town manager. The continuity is well worth the money that it will cost." Selectman Dentino wants Mr. D'Agostino to schedule union meetings all on one day or have the union reps and John travel to Braintree to meet with Lehane. Mr. D'Agostino stated that it is not cost effective to have everyone travel to Braintree or even possible to schedule all day meetings as everyone's schedule may not permit all day sessions. . Mr. D'Agostino stated that he will have more information for the board to review in a couple of weeks. Mr. D'Agostino further stated he is a professional and has done a pretty good job for this community over the last 11 years and the role of the town manager has been diminished and deviated from the charter. He feels he is being micro managed by the board and leaned on by the FinComm with all of their suggestions. He continued to state that he has endured extreme job interference from the Bos and FinComm tell him how to do his job. He is continually receiving mixed messages and it is apparent that he is not trusted to do his job. The negotiations of health care cost containment and wage freezes lie with the manager, not with the bos or the FinComm. The completion of the matrix is in draft form tonight. However, he would like a week or two to make changes/tweaks and this will not hold up union negations. Selectman Dentino asked if there is a plan B if union concessions do not come to fruition. Mr. D'Agostino replied that would cost the town a significant amount of Board of Selectmen Minutes of February 25, 2009 4 . . ,"" '~~'"~'''~''''''''M'''''_~"'~__________,,~,~~,"__"...,~_,_~,~,__~_ T -"'-~~'""".'_'_'~_""""'_"'A"" money and layoffs would be inevitable. The complete matrix should be ready for the March 11th meeting with the schools and FinComm. Selectman Aptowitz followed up with his desire to make it clear that all options are on the table for the town manager to balance the budget. He wants to make it clear that the bos directive to the town manager is that all options including layoffs are to be considered to balance the FYlO budget and that Mr. D'Agostino will make those decisions. FinComm Chair Gazzolo stated that they are waiting for information about the matrix from Mr. D'Agostino and that it is important to look beyond FYlO and put a 5 year plan in place. Selectman Aptowitz also stated that the bos does not want to go to town meeting with a town manager budget and a FinComm budget, they need to work together and present one budget at town meeting. Mr. D'Agostino briefly commented on the contract with the MBTA. If the town wants to change the contract they will have to terminate/renegotiate the terms of the lease. He will send a letter to them. · Old business from Selectman Levine: Not present · Old business from Selectman Dentino: Looking for update on tm search firms that he requested. New business from Selectman Dentino: Certification and workshop issues with light dept personnel that was approved by the town manager after the fact. A lengthy discussion of why this occurred ensued. Selectman Dentino stated that light dept personnel deliberately disregarded the bos directive of no training/seminars unless it is for licenses and then submitted the bills. Mr. D' Agostino stated that personnel need training some times that does not result in certifications. . New business from Selectman Moran: None .
