Mr. Dumas started his report with a COVID report stating that there are 37 cases, but that total does not include
at home tests. Mr. Dumas stated that there will be a press release sent tonight on the 25011 Anniversary
Celebration Committee. Mr. Dumas provided an update on the Walsh Well Cate Spring projects. He then
stated that the Governor has signed the legislature for the Special Site -specific liquor licenses and the DePillo
square construction was completed prior to Memorial Day. He then announced that there would be a regional
meeting at SEMRECC on June 91h at 6:30PM to discuss adding additional communities. Mr. Dumas then stated that
Deputy Chief Merritt would be retiring in the fall and Deputy Chief Terry will be replacing him. Mr. Dumas noted
that the report emailed tonight will include a detailed Economic Development report. Lastly, Mr. Dumas provided
an update on the MHS Boiler replacement project.
Mr. Rhein and Ms. Bren had no questions or comments. Mr. Aptowitz asked about SEMRECC meeting and if
information will be provided prior to the meeting and Mr. Dumas responded that there will be. Mr. Aptowitz then
stated that he would like to thank Deputy Chief Merritt and congratulated JT for his promotion. Mr. Trowbridge
asked about the PFAS law suit that the Town had and noted that Maura Healey is going after companies and what
impact would that have for Mansfield. Mr. Dumas responded that it would be a separate law suit. Mr. DelVecchio
asked how the interest rates compares to what was estimated and Mr. Dumas responded that it is much less and
the PFAS alone has a zero percent interest rate.
3. Resident Questions and Comments
Mr. Peter Wiggins a Norton resident came forward and stated to expect delays due to Xfinity Center concerts and
to be patient and plan ahead.
4. Discussion and Consideration to Approve Overnight Residential Parking Policy
Mr. Trowbridge stated that he may have a future conflict and recused himself from the discussion and Mr. Rhein
also recused himself. Mr. Shaun Burke, Town Planner was present and stated that he did not expect the Board to
take a vote today. Mr. Burke then proceeded to explain the policy and its origin. He stated that this item came up
when a buyer purchased a building and they do not have land available for parking to conform to current zoning
requirements. This idea came up for the Select Board to approve a policy allowing for overnight parking in the
Town parking lots and then it would later require amendments to the Zoning Bylaws.
Select Board Meeting Minutes
June 1, 2022
Ms. Bren asked if this would apply to new construction or is this for existing buildings. Mr. Burke responded that it
was just for existing businesses. Mr. Aptowitz commented that the Board has been supporting businesses and
redeveloping where possible. He stated that his concern was that if someone is purchasing a property they
should know what they are purchasing. Mr. Aptowitz stated that if the Board were to pass this policy then we are
opening this up to other buildings as well. Mr. Burke stated that this would apply to more than one building and it
would apply to any of the historic reuse section of the bylaw. Mr. Aptowitz then commented that there is
disagreement as to whether there is a parking problem downtown or not. He stated that Thursday through
Saturday nights there is a parking issue. Mr. DelVecchio asked if the parking study had any information in regards
to this situation and Mr. Burke responded that it did not. Mr. DelVecchio asked how many buildings this could
apply to. Mr. Burke thought that it probably was approximately twenty that meet the historic age and size
definition. In summary Mr. Burke explained that this decision is the Select Board's call and not the Planning
Board. He believes it is an avenue worthy of consideration, but was not sure that he was in favor of it.
S. Discussion and Consideration to Approve a Moratorium Waiver Request from Eversource for 111 Park St.
Mr. Josh Reinke, Interim DPW Director was present stating that he was joined by Jared Blandino and Mr. Carl
Aiello from Eversource. Mr. Reinke explained that the request was for new gas service at a residential home
located at 111 Park Street and current the road is under moratorium until September of 2024. Mr. Trowbridge
asked if the Board had any questions. Mr. Aptowitz asked if this was new construction and Mr. Reinke responded
it was new gas service to a residential home and Mr. Aptowitz asked how they were heating the home currently
and Mr. Reinke responded that he believed it was oil. Mr. DelVecchio commented that the plan would bring the
road back to its current condition with no large pot holes and bumps and Mr. Reinke responded that it will not be
perfect, there will be cut lines and as close to new as possible. Mr. Aptowitz commented that he was concerned
and there is a moratorium for a reason and he can understand when it is a gas leak or emergency repair. Mr.
Dumas agreed with Mr. Aptowitz and stated that the Board should be concerned with just cutting into roads just
because someone wants a new service. Mr. Trowbridge asked how long the owners owned the house and Mr.
Reinke was not sure and Eversource was not sure either. Mr. Aiello asked if it was possible to do the road cut on
the side road that has less traffic. Mr. Reinke noted that it was still under moratorium too. The below motion was
made by Mr. Rhein, but there was no one that seconded the motion, so the motion failed.
Motion: To approve Eversource's request to excavate moratorium roadway as it pertains to a new gas service
connection at 111 Park Street. The final 3" Mill & Overlay dimensions shall be curb -to -curb, and 2' off both sides
of the trench limits as directed by Interim DPW Director.
6. Discussion and Consideration of Request to Amend Entertainment License for Lazio Corp dba Trattoria
Romana Pizzeria Bar and Grill
Mr. Ted Monahan was present from Trattoria Romana requesting an amendment to their current entertainment
license to provide some live entertainment on week nights. Mr. Trowbridge stated his concern was the residential
neighborhood. Mr. Monahan explained that he anticipated the entertainment performing from 5pm and go to
8pm and would either be a single musician or a duo to do an instrumental performance. Mr. DelVecchio asked if it
was limited to two pieces and if it would be instrumental and Mr. Monahan explained that it could be some vocal.
Mr. Rhein asked how they would address complaints that may come from the residents that live nearby. Mr.
Monahan asked if the neighbors were notified when they applied for this application and Mr. Trowbridge noted
that they were not with this application. Mr. Monahan responded that they intend to have this entertainment on
Tuesday, Wednesday, Thursday evenings from 5-8pm and it would not be on the weekends because there is not
enough space for music and the needed tables for a busy weekend night. Mr. Dumas added that the Board could
be specific and put parameters on the license that specified only 5-8pm. Ms. Bren asked if the amplification
system was provided by the restaurant and they could control it or if it was the musician. Mr. Monahan
responded that it would be provided by the musician, but the restaurant could control it.
Motion: To approve amended entertainment license for Lazio Corp dba Trattoria Romana Pizzeria Bar and Grill.

second request be submitted and it can go on the June 15th agenda.
Motion: To approve the one -day beer/wine license for the Mansfield Elks for June 18, 2022 and to waive the $25
fee.(Rhein/DelVecchio) Passes 5:0
Mr. Aptowitz thanked Mr. Burke for hosting the Memorial Day event.

Mr. Trowbridge asked Officer Jeff Collins to come forward and he provided a summary of the events that have
occurred in relation to the dog owned by Tina DiMascio of 45 Donegal Way. He stated that in March of 2021 he
got a call and investigated the situation and advised the DiMascio's of keeping their dog in the fenced in yard or
on a leash when outside the home. He then stated that on April 10, 2022 Sargent John Armstrong was dispatched
to Donegal Way to speak to a mother and daughter regarding an incident involving an aggressive dog in the
neighborhood. Officer Collins stated that he received the report the next day and went to the DiMascio's home to
investigate the incident that was reported by the Kiely's of 39 Donegal Way, he learned of other instances that the
dog was off leash in the neighborhood. The most recent incident occurred on April 10, 2022 in which the garage
door was open and Skylar charged towards Vanessa Giordano and Elizabeth Kiely and their dogs. At this point a
formal report was filed by them. Officer Collins then went back to the DiMascio's home and they provided an
Select Board Meeting Minutes

account of what happened which also matched the camera footage provided by the DiMascio's. Officer Collins
stated that from the video he was unsure if the dog made any contact with the dogs, but the witness statements
confirmed that the dog did not make contact.
Mr. Rhein had no questions. Mr. DelVecchio asked for clarification on how many occurrences there have been
with this dog. Officer Collins responded that there was one in March in 2021 and then in April 10, 2022 was the
second incident that he was aware of, but through conversations he learned that there have been other times
throughout the year, but they were not reported to the Police Department. Mr. Aptowitz asked Officer Collins if
the dog has bitten anyone and Officer Collins stated he was not aware of any bites. Ms. Bren asked if it has bitten
or touched another dog or person during that time and Officer Collins stated that the he was not aware that it did
but in the first instance the dog was close enough to be stricken by Mr. Kiely. Mr. Trowbridge asked Officer Collins
what his recommendation was and Officer Collins recommended that if the dog is not in a yard or house it needs
to be leashed.
Ms. Valerie Astle, of 16 Wexford came forward stating that she was the one who called Officer Collins last year.
She provided a summary of the incident she had with Skylar. She began by stating that her and her husband were
walking with their rescue dog and were approximately 300 feet down the street and well out of view from the
DiMascio's house. She turned around when she could hear paw prints. She stated that it was a dog charging and
galloping towards them and it was a dog with intent to do harm. She stated that she yelled, but it did not deter
the dog. She stated that the dog did not make contact. Her husband did kick and strike the dog, knocking it down,
but it got up and jumped a second time and he struck it again. She stated that the owner was not there and when
she looked back the owner was down the street about 300 feet saying that the dog was just being friendly. Ms.
Astle stated that this cannot happen again.
Mr. Brian Kiely, 39 Donegal Way was present and stated that they walk all the time in the neighborhood and
described an incident at the bus stop where he had to get in between his dog and the DiMascio's dog and was
going to kick the dog if it came to that. He stated that Ms. DiMascio said the dog was too strong and got away
from her. He also stated that they used the excuse that the electric fence was broken. Mr. Kiely stated that his
wife and daughters can give a description of their encounters, but the owners do not take responsibility.
Ms. Gabrielle Kiely, 39 Donegal Way came forward and stated that the first incident occurred about a year ago
when walking their 20-301b dog and stated that Skylar was running towards them, but Ms. DiMascio was coming
right behind Skylar and she put her dog between a tree and her. She did not hear everything that Ms. DiMascio
saying but she heard her say that the dog was friendly. Ms. Kiley said that she just was trying to get away as
quickly as possible because it was scary, and has scared us enough to not walk that way anymore.
Ms. Vanessa Giradano, 49 Robert Drive in Easton stated that she moved back from California and has worked in
dog rescues for fifteen years and thinks all dogs can be trained. She described the incident that traumatized her
and her dogs who are all small and weigh 20, 25 and 30 pounds. She said she and her mom were walking the dogs
and her mom said "Oh no" and then she saw a German Shepard running towards them. She stated that she
started screaming, but the dog came closer and circled my dogs. She then saw the neighbors standing in their
garage and not coming after their dog. Ms. Giradano believed that her dog was going to die in this situation. The
dog did return home, but the owners never came out, they just went inside their home. Later that night when
discussing the incident, she told her mother that it is not okay and her mother informed her of the previous
incident. Ms. Giradano also went on the neighborhood Facebook group and saw a post the Ms. DiMascio posted
about Ms. Astle saying that the dog officer sided with the DiMascio's and I thought it was inappropriate and it
appears that they do not want to take responsibility for their dog.
Ms. Elizabeth Kiley, 39 Donegal Way stated that the incident happened so fast and the biggest problem is that no
one came out even when they heard screaming. She stated that she just wants to feel safe in the neighborhood
Select Board Meeting Minutes
June 1, 2022
she has lived in forth irty years. She does not want this to happen again and does not want to be fearful. Ms. Kiley
stated that if her dog did this she would feel awful and this has happened more than once now.
Ms. Tina DiMascio, 45 Donegal Way stated that she was the dog owner. She began by stating that they do not
have an electric fence and was unsure where that confusion came from. She stated that they invited the Kiley's
and Ms. Giordano to meet her dog Skyler after the incident when Officer Collins came to the house. She stated
that Skylar is a friendly and is a high energy working line breed of dog and she is harmless. She stated that she
does not believe that Ms. Giordano lives in our neighborhood and feels bad for anyone who has a fear of our dog.
She stated that it was seven seconds of her running and three seconds back and she did not start barking until
they were yelling. She stated that she feels bad and this is only the second year they have lived in the
neighborhood and they do not know everyone yet. She stated the Skyler is around kids, adults, elderly and has not
had any biting, growling or incidents and is a great dog. She attends doggie day care and she provided the letters
from the professional dog trainers and she felt like this may be breed shaming.
Mr. John Storrs, 45 Donegal Way came forward and said he should have gone over to apologize for the incident.
He stated that they are new to neighborhood and do not want any bad blood with the neighbors. He stated that
there is a door in the garage that occasionally gets left open and, in the past, the dog has gone out, she gets
excited and runs across the street, but stated that he was very confident that his dog would not bite. The day of
the recent incident he was concerned with getting the dog inside and scolding his daughter for leaving door open
instead of going over to Ms. Kiley and Ms. Giordano. He stated that he didn't want people afraid to walk by their
home and did not realize how badly this affected the neighbors and he apologizes for it.
Ms. Anya Poole, 126 South High Street, Foxboro came forward and stated that she was a friend of Mrs. DiMascio
and has known Skylar since she was a puppy. She stated that the dog is a sweetheart and shows no aggression,
and has never seen her behave in a way that is concerning when she has taken her to the dog park or babysat her.
Mrs. Poole stated that she adopted a dog and had to learn to manage the situation of a dog rushing up to her
because it happens all the time. She then asked if the Board had seen the video and she noted that what she saw
is Skylar running down the driveway, across the street and then she circles the dogs which is common of dogs to
investigate one another. She stated that Skylar only started barking once they started yelling at her. She then
noted that the length of the video was short and what she has heard described today is not the dog that she
knows. She is a German Shepard and they do bark. She then offered to help the other dog owners learn how to
manage the encounters because they happen all the time. Lastly, she stated that it was rude of Skylar, but it was
not aggressive and she hopes that she provided another picture of Skylar. Mr. Aptowitz asked if she was a licensed
professionally. She responded that she was working on getting a certification.
Ms. Jessica Howlett -Cobbs, 148 Main Street, came forward and stated that she was the breeder of the dog Skylar.
She stated that her parents are very well trained and do not have aggressive behaviors. Skylar is on the smaller for
a German Shepard. She added that she only allows a few people to watch her child who is very active and she
trusts her daughter to be at the DiMascio's house with Skylar. Ms. Astle asked Ms. Howlett -Cobbs how she selects
the homes that her dogs go to as the breed normally go to work for police departments. Ms. Howlett -Cobbs
responded that she has a lengthy application that is ten pages, there is a home visit and they come to her house.
She makes sure they have German Shepard experience, which Ms. DiMascio had and she also confirms they
financially can afford to take the dog to training, doggie day care for socialization and health bills.
Mr. Trowbridge asked Officer Collins to come back to the microphone. Mr. Rhein asked when he first visited their
home was it in April of 2022 or before and Officer Collins stated that it was back in March of 2021 and visited once
and then a second time in April of 2022. He then asked if there were any conditions put in place. Officer Collins
responded that the situation sounded like it had been an accident where the door left open and he advised the
DiMascio's that it could not happen again.
Select Board Meeting Minutes
June 1, 2022
Mr. Brian Kiley came forward again and stated that Ms. DiMascio used the excuse that their electric fence was not
working when the dog got loose the first time, however they didn't even have one.
Ms. Tina DiMascio came forward again and stated that she would never say they have an electric fence when they
don't have one and, in the documents, she provided she would never use an electric fence type of device.
Ms. Vanessa Giordano came forward again and stated that she has experience working with aggressive dogs and it
may have been lost in translation but they did not get an invitation to meet Skylar.
Mr. Trowbridge asked Officer Collins to come forward once again and asked him what his recommendation was.
Officer Collins responded that when outside the domicile or an enclosed area the dog needs to be restrained.
Motion: To close the public hearing at 7:2113M. (Rhein/DelVecchio) Passes 5:0
Mr. Trowbridge asked Mr. Paul DeRensis to come forward and asked him to confirm what the Select Board
needed to decide. He believed the first item is to determine if it is a dangerous dog or a nuisance dog. Mr.
DeRensis responded that when there is a complaint of a dangerous dog the Board has to decide if the dog is a
dangerous dog or they can dismiss the complaint, deem it a nuisance dog or deem it a dangerous dog. If the Board
dismisses the complaint that's the end. If the Board deems it a nuisance dog then there are many options and
flexibility to what the Board can order by law. If the Board decides it is a dangerous dog then there is a list seven
things that can be done to remediate the situation.
Mr. Rhein stated that this is a difficult decision for the Board and it is traumatizing when a dog comes charging at
you, but the dog didn't bite, but there have been multiple incidents and the dog needs to be prevented from
getting out. Mr. Rhein stated that he was more inclined to declare the dog a nuisance dog and made the motion.
Motion: To declare the dog a nuisance. (Rhein/DelVecchio)
Mr. Aptowitz stated that there is one common thing that has been standing out all night is the door. The dog
cannot get out the door again. He stated that he was thankful no one was bit. He stated that he cannot have
people walking around Town afraid of the dog and it is the owner's responsibility. Ms. Bren agreed with the
nuisance and people need to feel safe to walk in the public way. Mr. Trowbridge stated that in these instances
many times the dog gets loose and it bites and he was glad that no one was bitten. Mr. DelVecchio stated that it
is not a breed thing, having something charge at you is scary.
The Board then voted on the above motion. Passes 5:0
Motion: To order that the dog Skyler be on a leash under the control of an adult, when not restrained in the home
or fenced yard and that a self -closing storm door be installed and inspected by the Animal Control Officer.
(Rhein/DelVecchio) Passes 5:0
The Select Board took a break and then continued to agenda number ten.
9. Discussion and Consideration to Approve the First Amendment to the Host Community Agreement for
Community Gardens LLC
Mr. LaCasse stated that on May 61h he, Mr. Dumas and Mr. Chris McDermott, Economic Development Director
met with Community Gardens new CFO and he explained what is going on with their company, however that
information is confidential at this time. This amendment is a result of that meeting and contains a clause that if
the business is not operational within two years the contract becomes null and void.

Ms. Bren stated that she attended the graduation and congratulated all the graduates. Ms. Bren then stated that
there is a Pride Day ceremony on June 8th at 6PM at Town Hall with a rain date of June 9tn
Mr. Aptowitz stated that the Memorial Day parade was good and thanked all the participants especially the
Veteran's Agent, Michael Raymond for coordinating. He then offered congratulations to Mr. Raymond who is now
the State Commander of the State VFW.
Mr. DelVecchio commented that he was going to note the Pride event and then commented that over the years
the Chair has made changes to the format of the agenda and he is proud that seven years ago the Board created
the consent agenda so that every little license does not need to be voted individually. He believed having the
Town Manager's report at the beginning of the meeting has been helpful and residents comments are on the
agenda twice. He then stated that residents can send comments via email if they can't be in person.
Mr. Rhein had no comments or questions.
Mr. Trowbridge asked for goals and objectives to be on the next meeting if possible to update. He then asked if
concert notifications could be done in another way besides social media to give a heads up to residents of a
concert. Mr. Trowbridge didn't want it to be the message boards but maybe the sign at Police Station.
Mr. Aptowitz asked if it would be possible to introduce Jason Sandoval from the Xfinity Center to restaurant
owners though Mr. Chris McDermott the Economic Development Director and lead concert goers to the
restaurants in Town. Mr. Dumas responded that it can be mentioned to Mr. Sandoval.
Mr. Trowbridge noted the issue with bike path and people are actually diving on it, so DPW will be putting
construction barrels and then a more permanent solution. He then asked about the Flag Pole at the DPW building,
it does not need to be substantial, but Mr. Reinke will be looking into that as well as one for the Water
Department.
