John D'Agostino, Town Manager, Town Counsel Robert Mangiaratti and Lenard Kesten are also present The Board of Selectmen's meeting was called to order at 7:30pm Motion: To convene to Executive Session to discuss pending litigation. (Dentino/Levine) 3:0 passes. Roll call vote to go into Executive Session: Chairman Amoruso aye, Vice Chair Levine aye, Selectman Dentino aye, Selectman Baldwin aye, Selectman McCarter aye. John D'Agostino's contract as the Town Manager has an indemnification clause in it.The town may not have to pay $500k if the indemnification clause holds up as you can't switch back penalties to the town from Mr. D'Agostino if the judgment is revised from Judge Woodlock. Selectman Dentino asked about civil rights violations. This should affect the judgment. The indemnification clause won't hold up if this was the case. The town has tried to settle with Ms. Stoyle and they have not been able to come to an agreement. Mr. Dentino stated that he read on the court website that Atty. Kesten had appealed the judge's decision already. He was not aware that the board had voted on this. Selectman Dentino was also distressed to find that upon his return home from out of state business that Selectman Levine had read a statement that included him at the last board of Selectmen's meeting. He is back now and would like to refute her accusations. He believes that her letter was full of fabrication and half truths. He further stated that if anyone prompted Atty. Balliro to call Mrs. Levine it was Kimberly Stoyle. That is more logical than to assume it was him. Selectman Levine should be quiet about this case as warned as she has publicly stated in the past that the board members shouldn't talk about the case untiJ it is settled. Selectman Levine stated that she did not say anything about Mr. Beliveau except that he was a friend of Selectman Dentino. Board of Selectmen Minutes of October 10, 2007 , Selectman Dentino then ended the discussion by quoting his uncle, "Confusion Dentino" in saying that "he who attempts to try a case in public doesn't have one for the court." Motion: To adjourn executive session. Roll call vote: Chairman Amoruso aye, Vice Chair Levine aye, Selectman McCarter aye, Selectman Dentino aye, Clerk Baldwin aye. Jl~ ~W?
