Board of Selectmen
Minutes of February 13, 2008
Present:
Chairman Louis Amoruso, Vice Chairman Sandra Levine, Clerk Ann Baldwin,
Selectman George Dentino, Selectman David McCarter.
John D'Agostino, Town Manager, Town Counsel Robert Mangiaratti and
Katherine Murphy are also present
The Board of Selectmen's meeting was called to order at 7:00pm
Motion: To convene to Executive Session to discuss pending litigation. (Baldwin/Levine)
4:0 passes. Roll call vote to go into Executive Session: Chairman Amoruso aye, Vice
Chairman Levine aye, Selectman Dentino aye, Selectman Baldwin aye.
Shawmut Ave property RFP
The right of reverter clause on pg 5 could be a problem for the art center to get
financing. If the language was changed to "If building sold to another party, the amount of
$ that was gifted to art center would be returned to Town of Mansfield." That would
protect the town's interest. Selectman Dentino stated that the town should retain the
property and lease it to the art center long term. The lease would not include rentals so
parking would be less of an issue. After a lengthy discussion the board could not get to
consensus on how to move forward.
John Beliveau MCAD complaint
Attys. Mangiaratti and Murphy updated the board on the motion to clarify. Vice Chairman
Levine asked if the board still needs to act on this. Yes, the town needs to defend
themselves and, after a response is filed MCAD, will decide if the case should go forward.
The board will provide a CD of the October 17, 2007 meeting in question. Atty.
Mangiaratti stated that Dr, Beliveau must show that this retaliation is due to the previous
suit. He has to file a claim with MCAD first before he can file suit again. Once the claim
is filed in court you have to shown probable cause, however you don't need to do so to file
MCAD claim.
Atty. Murphy will have to interview Mr. D'Agostino and Mrs. Levine separately and then get
deposition from board.
