Board of Selectmen
Minutes of November 11, 2007
Present:
Chairman Louis Amoruso, Vice Chairman Sandra Levine, Clerk Ann Baldwin,
Selectman George Dentino, Selectman David McCarter.
John D'Agostino, Town Manager, Jack Vultaggio, Chairman ZBA are also
present
The Board of Selectmen's meeting was called to order at 7:00pm
Motion: To convene to Executive Session to discuss pending litigation. (Dentino/Baldwin)
3:0 passes. Roll call vote to go into Executive Session: Chairman Amoruso aye, Vice Chair
Levine aye, Selectman Dentino aye, Selectman Baldwin aye, Selectman McCarter aye.
Rosewood Realty vs. the Zoning Board of Appeals. Chairman Vultaggio gave a brief recap
of this case. (Copeland Crossing 40B on the corner of Rt. 140 and Rt. 106)
Rosewood and Fairfield court expenses were taken out of affordable housing account and
should have been taken out of Selectmen's legal expenses line item so that correction will
be made at town meeting.
Selectman Dentino asked how or why didn't the ZBA handle case in a timely fashion?
The legal time frame for a decision is 20 days. Chairman Vultaggio stated that it wasn't
feasible at the time (it was close to Christmas) and the board didn't meet during that time
in order to submit decision in 20 days.
Motion: To Atty. Talerman file Superior Court brief and negotiate with developer.
(Dentino/Baldwin) 5:0 passes. Roll call vote: Chairman Amoruso aye, Vice Chair Levine aye,
Selectman McCarter aye, Selectman Dentino aye, Clerk Baldwin aye.
Motion: To adjourn executive session and return to open session. (Baldwin/Levine) 5:0
passes. Roll call vote: Chairman Amoruso aye, Vice Chair Levine aye, Selectman McCarter
aye, Selectman Dentino aye, Clerk Baldwin aye.
