Burke, Director of Planning and Development DATE: May 30, 1996 SUBJECT: Massapoag Estates Drainage Area You will recall we visited the Massapoag Estates drainage area last week and reviewed the washed out outfall, stagnant water, and uncovered drainage outfall pipe. At that time, I inquired as to whether or not the Board of Health could be of assistance in forcing the owner to resolve some of these issues. Since that meeting, I have reviewed an opinion from Town Counsel dated October 23, 1995 (copy attached) concerning Eastleigh Estates. My question, then, is as follows. Having viewed the site, do you feel any of the issues fall under the definition of nuisance as identified in Town Counsel's opinion? You asked whether the Town has any right to go upon private property to clean up hazardous conditions. The Board of Health has express authority to order the owner, at his own expense, to remove any nuisance existing upon any private premises. General Laws Chapter 111, Section 123. If the owner fails to comply with such an order, the Board of Health may cause the nuisance to be removed, and all expenses incurred in connection with the removal constitutes a debt due to the Town from the owner. General Laws Chapter 111, Section 125. Nuisance is commonlv defined as a condition which affects the health, habits, or comfort of ordinary people. Burnham v. Beverly Airways 311 Mass 628, 42 NE 2d 575, 577 (1942). I suggest that the Planning Board inform the Board of Health of what it considers to be the hazardous conditions at Eastleigh. If the Board of Health then concludes that those conditions constitute a nuisance, it may act to abate the nuisance in accordance with its authority under General Laws Chapter 111, Section 123-125. sincerely, `lTL-wT� Robert S.
