Board of Selectmen
Minutes of January 22, 2009
Present:
Chairman Ann Baldwin, Vice Chairman Kevin Moran, Clerk Jess Aptowitz,
Selectman Sandra Levine, Selectman George Dentino.
John D'Agostino, Town Manager
Attorney Steven Torres had been retained by the Board of Selectmen to review John
D I Agostino's employment contract with the town and was provided with a copy of the
contract in addition to the Town of Mansfield's charter, personnel policy and Judge
Woodlock's instructions to the jury. Any additional information needed will be emailed or
otherwise provided at a later date.
Atty. Torres will draw up a contract for services with all the specifics for the board to
sign. A retainer will not be necessary as he already agreed to work for a sum not to
exceed $5,200.00.
Selectman Dentino asked Atty. Torres a number of questions.
· For a legal opinion regarding any civil rights violations of Kimberly Stoyle and John
Beliveau.
· What the town's vulnerability is regarding a lawsuit from Mr. D'Agostino for:
1. Termination for cause.
2. Not renewing contract.
3. Town reaching contract settlement with Mr. D'Agostino.
Selectman Aptowitz asked Atty. Torres how much severance pay the town manager would
receive. Per contract he is entitled to 6 months.
Selectman Levine asked t\tty. Torres about the copy of Mr. D'Agostino's trial transcripts
that they received from a resident. With out the seal of the court that are not a true and
valid document.
Atty. Torres stated that he would like to be able to interview employees if necessary.
Selectman Moran pointed out that while it was not in the scope of services for work to be
provided, it could possibly be re-visited at a later date.

Motion: To adjourn to executive session to discuss contract with non union personnel
contract negotiations.

Roll call vote: Dentino aye, Aptowitz aye, Levine aye, Moran aye, Baldwin aye.
Motion: To adjourn at 10:02 AM
