Although Mr. Wancour was the only manager on duty at the Easton branch at the time of the incident, the Branch Manager is Robert Jones. The applicator was John Delgado, license # 17722. It is our understanding that the "spill" leading to the drain was a result of Mr. Delgado cleaning his hands with fresh water after dealing with a small leak in his hose. We were told that the liquid fertilizer and Dursban mix which was involved, Lesco Pre-M 60 DG Herbicide, EPA REG NO: 10404-52, with a small amount of Dursban Turf Insecticide, EPA REG NO: 464-524, had evaporated, negating any cleanup procedure. Again, according to the account received on May 22, Mr. Delgado was not aware of the granular material falling from his vehicle. After you notified Chemlawn, Mr. Wancour went to the site and cleaned up any remaining material. The dry material that fell from the cargo box as Mr. Delgado drove away was; Lesco 32-5-7 Fertilizer with Dursban, EPA REG NO: 10404-29. The material is essentially a fertilizer with 0.74% chlorpyrifos, which does make it a pesticide. Chemlawn has inspected the vehicle and is of the opinion that the fertilizer fell from the cargo box, possibly as a result of the latch not being completely engaged. Chemlawn now has added an elastic cord to further secure these latches. Chemlawn reported the incident to the Pesticide Bureau as required by 333 CMR 10.15(1)(i). The Bureau has addressed the incident with Mr. David Gibson, Chemlawn's Area Technical Manager. Based on the information available at this time, no further action in this matter is being considered. If you have any further questions, or if we can be of help, please do not hesitate to contact the Bureau at 617-727-3020. Your ruly, /' ¢o n Kenney / Chief Inspector Pesticide Bureau t Er rAll t" - I 4/ f May 29, 7992 John Keeney Commonwealth of Massachusetts Pesticide Bureau 100 Cambridge St.. Boston, Ma, 02202 Dear Mr. Keeney, On May 22, 1992, at 9:30 AM, John Delgado (ChemLawn Specialist, Pesticide License #17722) had a 1 - 2 gallon spill of nitrogen, phosphates, potassium, dilute pendimethalin 60 DG (10404-52) and dilute dursban (508-261- 7366) at 14 Goose Lane, Mansfield, Ma. The cause of release was a small pinhole in the delivery hose to the second reel. With the spray system under pressure at the time of the spill, a stream of spray stained the sidewalk and the rest was spilled in the street. With the temperature in the low 80's at the time, the spill basically spread and evaporated. John then closed off the delivery to this reel and proceeded to spray the lawn with the front reel. Prior to leaving, John used approximately 2 gallons of water out of a water jug on the tanker bed to wash his hands. This "stream" of water ran 25 feet to a stormdrain. As John left the property, a small quantity of dry, Lesco 32-5-7 dursban pellets fell onto the street. This "spill" was reported to me by Scott Lee (Mansfield Board of Health). I went to the site, finished cleaning up all the dry pellets and washed the "stream" with soap and water, blocking the storm drain with a Hazorb pillow to prevent any water from going into the drain. I stayed at the site until the water had completely dried. Yours truly, lor, Ron Wancour Delgga Field Service Manager - Lawn.-S,p st Post-Ir" brand fax transmittal memo 7WI 1#0rPages r.
