XXII. Regulation of Downgradient Properties Adjacent to a Disposal Site or Area Otherwise Affected.
No person, shall dig, drive, drill or otherwise install or construct a private domestic well, private auxiliary well or other well for water in a downgradient properties adjacent to
a disposal site, as defined by 310 CMR 40.0000 Massachusetts Contingency Plan, or area otherwise affected.
The Board of Health may grant a variance for private auxiliary well. A condition of granting a variance to this section shall be a recorded deed restriction.
Any failure by any person to comply with the provisions of this Section 22 shall be deemed a violation of these regulations and such person shall be subject to fines pursuant to Section XVII
of these regulations.
The provisions of this Section XXII shall be effective as of XXX XX, 2013.
